HomeMy WebLinkAboutCSD-13-040 - Noise Exemption Request - 4295 King St E REPORT TO: Community and Infrastructure Services Committee DATE OF MEETING: April 22, 2013 SUBMITTED BY: Michael May, Deputy CAO, Community Services (519-741-2200, ext. 7079) PREPARED BY: Shayne Turner, Director of By-law Enforcement, (519-741- 2753) WARD(S) INVOLVED: 3 DATE OF REPORT: April 12, 2013 REPORT NO.: CSD-13-040 SUBJECT: NOISE EXEMPTION REQUEST – 4295 KING STREET EAST RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to SG Cunningham Ltd. for purposes of concrete pouring and curing on 3 nights between April 29, 2013 and May 8, 2013, between the hours of 7 PM and 12 midnight. BACKGROUND: SC Cunningham is the general contractor for the construction of a 4 storey office building at 4295 King Street East. They are in the process of constructing the floors which involves pouring and curing concrete slabs. It is likely that the curing process will extend past 7PM, which is the time limit for when construction noise is to cease. This site is in proximity to a residential area to the north and west of the property. Thus they are requesting an exemption from the City’s Noise By-law (Chapter 450). REPORT: The contractor advises that there are 3 floors remaining to be constructed. The concrete work involved in each individual floor can be completed within 1 day, however the curing process will th extend past 7PM. At this point, they are not able to identify the specific days between April 29 th and May 8, when the concrete will be poured, but have assured staff that they will be notified as soon as each date is confirmed. Once the work has started, they cannot halt the process before full completion. The contractor advises that they will be enclosing the subject area with sheathing and tarps as best as they can and will also be including an additive into the concrete to expedite the curing process. Nonetheless, they do believe it is possible for some noise to extend into the adjacent residential area. 6 - 1 To date, the By-law Enforcement Division is not aware of any complaints being registered with regard to noise at this site. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: This request supports the Community Priority of Quality of Life, as contained in the City’s Strategic Plan. FINANCIAL IMPLICATIONS: N/A COMMUNITY ENGAGEMENT: The contractor will advise the By-law Enforcement Division once the date of each individual concrete pour has been established.
