REQUEST FOREXEMPTION FROM CHAPTER 745
(GUNS)OF THE CITY OF KITCHENER MUNICIPAL CODE
RECOMMENDATION:
That 8440590 Canada Inc. operating as The Paintball Arena, 69 Agnes Street be granted
an exemption from Chapter 745 (Guns) to permit paint ball guns and air soft guns to be
discharged.
BACKGROUND:
Chapter 745 (Guns) of the Municipal Code does not permit the discharge of any guns within the
City, except for the uses described in Sections 745.2.4 to 745.2.12. Paintball operators are not
one of the exceptions. It does, however, provide for the opportunity for a person to make
application to Council for an exemption to the by-law by providing certain information to the
Manager of Licensing, including:
The nature of the proposed exemption
A police clearance letter for the person seeking the exemption
The location of the premises to be used and
The measures to be taken to prevent accidents or damage to persons or property
REPORT:
The Manager of Licensing has received an application for gunexemption from The Paintball
Arena located at 69 Agnes Street requesting that they be granted an exemption from Chapter
745 (Guns) of the City of Kitchener Municipal Code to permit them to discharge paintball guns in
their establishment. The exemption is being requested because there is new ownership of this
business. The exemption is permanent as long as the above corporation owns the business
and there are no complaints regarding the business.
They have provided the Manager with all the relevant information with respect to the
requirements of the by-law and everything is in order. The owners have provided evidence that
they have extensive safety precautions in place and all staff has had extensive training in order

to ensure the safety and well-being of all participants. In addition to the Police Clearance letters
that were required, the Chief of Police was contacted and no concerns were identified.
