SPECIAL COUNCIL MINUTES
MAY 27, 2013 CITY OF KITCHENER
A special meeting of City Council was held at 12:36 p.m. this date, chaired by Acting Mayor P. Singh
with all members present except Mayor C. Zehr and Councillor Y. Fernandes.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
Moved by Councillor S. Davey
Seconded by Councillor K. Galloway-Sealock
“That an in-camera meeting of City Council be held immediately following this special meeting to
consider two land acquisition / disposition matters and a matter subject to solicitor-client
privilege.”
Carried.
The meeting then recessed at 12:38 p.m. and re-convened at 5:30 p.m., chaired by Mayor C. Zehr with
all members present except Councillor Y. Fernandes.
Mayor C. Zehr advised staff has requested that three additional items be added to the agenda this date
regarding matters arising from the Community and Infrastructure Services Committee meeting held
earlier this date which are time sensitive.

“That in accordance with Section 25.4.4 (f) of Chapter 25 of the Municipal Code (Procedure), the
following matters be added to the special Council agenda for discussion this date:
Noise Exemption Request – Queen Street South Reconstruction;
Noise Exemption Request – 139 Franklin Street North; and,
Noise Exemption Request – Henry Sturm Green Festival.”
Carried by required 2/3 of members present.
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date concerning the lifting of a Holding Provision related to a zone
change application for 1 Adam Street.

Seconded by Councillor D. Glenn-Graham
“That Zone Change Application ZC13/04/A/AP (1 Adam Street, and 175, 217, 225 St. Leger
Street, and 316, 320, 340 Louisa Street; 184136 Ontario Inc.) for the purpose of changing the
zoning by removing Holding Provisions 21H and 48H from the lands specified in Map No.1, in
the form shown in the “Proposed By-law” dated April 30, 2013, attached to Community
Services Department report CSD-13-048 as Appendix ‘A’, be approved.”

Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date concerning the naming of private streets within the
development at 1 Adam Street.

“That the City of Kitchener acknowledge that 1841362 Ontario Inc. proposes to name private
streets and lanes within the proposed multiple residential redevelopment located at 1 Adam
Street, 175, 217, 225 St. Leger Street and 316, 320, 340 Louisa Street; and,

That the City’s Legal Services be directed to proceed with the required advertising and
preparation of the necessary By-law for the naming of the private streets and lanes; and
further,
That the public park to be conveyed to the City through Draft Approved Plan of Subdivision
Oscar Lauber Park
30T-11203 be named .”

Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date concerning a noise exemption request related to the Queen
Street South reconstruction project.
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor S. Davey
“That the City of Kitchener and its contractor(s) be exempt from the provisions of Chapter 450
Noise of Kitchener Municipal Code Article 6 Construction Work during the Queen Street
Reconstruction Contract #T13-013 preparation from Courtland Avenue to Charles Street, and
Joseph Street from Queen Street to Ontario Street, in the City of Kitchener; and further,
That the requested noise by-law exemption shall apply only between the hours of 7:00 PM to
7:00 AM for the period from May 8, 2013 to May 31, 2013.”

Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date concerning a noise exemption request for an event to be held
at 139 Franklin Street North.
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor S. Davey
“That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to Jared Marantha for a family celebration to be held at 139 Franklin Street North on Saturday,
June 1, 2013, between the hours of 7:00 PM, and 10:30 PM.”
Carried.
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date concerning a noise exemption request for the Henry Sturm
Green Festival.
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor S. Davey
“That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to the Victoria Park Neighbourhood Association for The Henry Sturm Green Festival on
Sunday, June 2, 2013, between the hours of 1:00 PM and 5:00 PM.”
Carried.
In accordance with the approval of Zone Change Application ZC13/04/A/AP to lift the Holding Provision
for 1 Adam Street, an additional by-law was added for three readings this date.

“That leave be given the Mover and Seconder to introduce the following by-laws for three
readings and that the same be taken as read a first, second and third times, be finally passed and
numbered serially by the Clerk.

(a) Being a by-law to amend By-law 85-1, as amended, known as the Zoning By-law for the
City of Kitchener – 1841362 Ontario Inc. – 1 Adam Street, and 175, 217, 225 St. Leger
Street, and 316, 320, 340 Louisa Street.
(By-law No. 2013-069)
(b) To confirm all actions and proceedings of the Council.
(By-law No. 2013-070).”
Carried.
