SUBJECT: HOUSEKEEPING AMENDMENTS TO CHAPTER 549 and
CHAPTER 501 OF THE CITY OF KITCHENER MUNICIPAL
CODE
RECOMMENDATION:
That Chapter 549 (Itinerant-Temporary Vendor, Permanent-Temporary Markets) and
Chapter 501 (Business Licence Fees) of the Municipal Code be amended as outlined in
Finance and Corporate Services Report FCS-13-098.
BACKGROUND:
On May 13, 2013 Council approved several housekeeping amendments to a number of
Licensing By-laws. After the Finance and Corporate Services meeting it was noted that a minor
amendment to Chapter 549 had been omitted and after discussion with the Cycle Refreshment
Vehicle owner regarding the licensing of his drivers for the upcoming season that a minor
amendment should be made to Chapter 501.
REPORT:
The following changes are being proposed:
Chapter 549 – Itinerant-Temporary Vendor, Permanent-Temporary Markets
require a temporary retail market licence for sales held outdoors on private or public
property
A temporary retail market licence is required when there are 5 or more vendors selling goods,
wares or merchandise at a particular location such as a hotel, motel, public hall, etc. As part of
the Licensing requirements, a list of the vendors with their names, addresses and phone
numbers is required. This helps to protect the public in case there is a problem with an item that
they may have purchased at the sale.
In reviewing Chapter 549 it was noted that although Licensing has always required a temporary
retail market for sales that are held outdoors on private or public property, the requirement was
not written into the by-law. The amendment is to correct this omission.
Chapter 501 – Business Licence Fees
add a class and associated fees for “Cycle Refreshment Vehicle Driver – under 18 years
old”

Currently any person who operates a cycle refreshment vehicle requires a licence. Those over
18 must complete an application and obtain a Police Clearance Letter in order to obtain a
licence to operate a cycle refreshment vehicle. The current licence fee is $70.00 which can be
quite high for a student under the age of 18.
Cycle refreshment vehicle drivers under the age of 18 are required to complete an application
for a grant of licence but no approvals are required. Therefore, although an application for a
grant of licence will be required in order for the City to be aware of who is operating a cycle
refreshment vehicle, no licence fee will be required for anyone under the age of 18.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
Efficient and Effective Government – Continually adapting and improving to provide for a more
customer focused environment and providing efficiencies to the day to day operations of the
City.
FINANCIAL IMPLICATIONS:
There should be no revenue decrease as currently there are no refreshment vehicle drivers
operating in Kitchener under the age of 18.
COMMUNITY ENGAGEMENT:
The above amendments to these chapters are a result of a review of the licensing by-laws and
feedback from customers.
