HomeMy WebLinkAboutFCS-13-104 - Request to Amend Liquor Licence Agreement - Caesarie Inc. - 320 King St. W REPORT TO: Finance and Corporate Services Committee DATE OF MEETING: June 17, 2013 SUBMITTED BY: Liquor Licensing Review Committee PREPARED BY: Patricia Harris, Manager of Licensing, 7854 WARD(S) INVOLVED: 9 DATE OF REPORT: June 10, 2013 REPORT NO.: FCS-13-104 SUBJECT: REQUEST TO AMEND LIQUOR LICENCE AGREEMENT CAESARIA INC. 320 KING STREET WEST RECOMMENDATION: That Condition #4 of the agreement between Caesaria Inc. located at 320 King Street West and the City of Kitch BACKGROUND: A request has been received from Israel Alshech, President of Caesaria Inc. located at 320 King Street West, requesting that Condition #4 of the agreement between Caesaria Inc. and the City of Kitchener be amended. REPORT: All new applicants for a liquor licence in the downtown core are requested to sign a private agreement with the City of Kitchener whereby they agree to certain conditions as approved by City Council. The signed agreement is forwarded to the Alcohol and Gaming Commission of Ontario (AGCO) with the request that the conditions be added to their liquor licence. In order to have the condition amended on the applicants liquor licence the AGCO requires that Council approve the removal of the condition. Condition #4 of the agreement requires that the applicant daily The applicant signed the agreement on October 15, 2012 agreeing to all the conditions. Recently, business has suffered as they are having difficulty booking private events into the restaurant because of the restricted serving hours. As well, customers who are in the establishment do not stay to listen to the live music once service is cleared at 12:01 a.m. This is causing hardship for the establishment as all other bars and restaurants in the downtown core are permitted to serve alcohol until 2:00 a.m. Staff has received input from the Liquor Licensing Inspector of the AGCO, the Waterloo Regional Police and By-law Enforcement as well as the BIA. There have been no reported incidents with this establishment since it opened. Waterloo Regional Police indicated that they are a clean, fine dining establishment and a good addition to downtown Kitchener. The BIA has 3 - 1 met with the owner several times and has found him to be an upstanding operator of the establishment. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Community Priority Dynamic Downtown The Liquor Licence Review Committee is in place to review all establishments that propose to sell liquor in the Downtown Core. This allows Council to review and provide comments regarding the establishment in order to continue to provide a safe and dynamic downtown core. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: The Downtown Business Improvement Association was consulted and they are supportive of the proposed amendment. ACKNOWLEDGED BY: D.
