SUBJECT: HOUSEKEEPING AMENDMENT – CHAPTER 650 (LOT
MAINTENANCE)
RECOMMENDATION:
That a by-law be enacted to amend Chapter 650 (Lot Maintenance) of the City of
Kitchener Municipal Code, with respect to the outdoor storage of collectable waste, as
outlined in Report CSD-13-081.
BACKGROUND:
The City’s Lot Maintenance By-law (Chapter 650) regulates waste material on private property
as well as littering and dumping. Generally speaking, waste is not permitted to be kept on
private property. However, included is a provision that allows for the outside storage of waste
material that is intended to be placed at curbside for waste and recycling collection on the next
available collection day. This provision makes reference to the City’s older Waste Collection
By-law, Chapter 635, the majority of which was effectively rendered obsolete when the Region
assumed responsibility for waste management many years ago.
REPORT:
Staff are proposing a housekeeping amendment to Chapter 650 to change the references (to
waste material designated for collection), from the City’s old by-law, to the Region of Waterloo
Waste Collection By-law #02-011. The amendment will also speak to newer practices, such as
the blue box recycling and green composting bins, that were not entirely contemplated when the
original by-law provisions, and reference to the City’s Chapter 635, were implemented.
As part of the amendment, staff are proposing language that provides clarity with respect to how
waste material is stored outside, including measures to protect against access to the waste by
vermin.

The overall intent of the by-law provision will not change. As such, this amendment is viewed
as housekeeping in nature.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This request supports the Community Priorities of Quality of Life, as contained in the City’s
Strategic Plan.
FINANCIAL IMPLICATIONS:
N/A
COMMUNITY ENGAGEMENT:
This amendment is deemed to be housekeeping in nature, thus extensive community
engagement is not seen to be required.
