HomeMy WebLinkAboutFCS-13-141 - Delegation of Authority - Learning and Development AgreementsStaff Report KT R Finance and Corfiorate Sery ces Department WWW.kftX 'n :(a REPORT TO: Committee of the Whole DATE OF MEETING: August 26, 2013 SUBMITTED BY: Lesley MacDonald, City Solicitor and Director of Legal Services, ( #7267) Michael Goldrup, Director of Human Resources, (# 7117) PREPARED BY: Lesley MacDonald, City Solicitor and Director of Legal Services, ( #7267) Michael Goldrup, Director of Human Resources, ( #7117) WARD(S) INVOLVED: N/A DATE OF REPORT: August 20, 2013 REPORT NO.: FCS -13 -141 SUBJECT: DELEGATION OF AUTHORITY TO EXECUTE LEARNING AND DEVELOPMENT AGREEMENTS TO DIRECTOR OF HUMAN RESOURCES AND IN HIS ABSENCE,THE MANAGER OF EMPLOYEE STRATEGIES OR THE LEARNING AND DEVELOPMENT PROGRAM CONSULTANT RECOMMENDATION: That Council delegate to the Director of Human Resources, and in his absence, the Manager of Employee Strategies or the Learning and Development Program Consultant, the authority to execute the standard Learning and Development Agreement prepared by the Legal Division, pertaining to the securement of consultants to provide training programs for the City; and further that if changes are sought to any of the substantive portions of the standard Learning and Development Agreement, the changes must be reviewed and approved by the Legal Division prior to execution. BACKGROUND: From time to time, the City requires the services of a consultant with expertise in a particular area for the purpose of training City staff. REPORT: Legal and Human Resources Divisions have developed a standardized agreement that can be used to secure training consultants. This will provide some consistency from a content and format perspective. Since these business arrangements arise quite frequently and they are for services within the range of $ 500.00 to $20,000.00 but typically average $1,500.00 to $4,000.00 , it would be appropriate to delegate signing authority and therefore staff suggests that 6 -1 authorization to execute the standard Learning and Development Agreement, as prepared by the Legal Division be granted to the Director of Human Resources and in his absence, the Manager of Employee Strategies or the Learning and Development Program Consultant. Should as a result of negotiations with a consultant, changes to the substantive portions of said agreement are required, the changes need to be reviewed and approved by legal prior to the execution of the agreement. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Not applicable. FINANCIAL IMPLICATIONS: These business arrangements are typically for services within the range of $ 500.00 to $20,000.00 but typically average $1,500.00 to $4,000.00 and are accounted for out of budget. COMMUNITY ENGAGEMENT: Not applicable. CONCLUSION: In order to facilitate various training programs, the City of Kitchener secures consultants to provide specific training. Utilizing a standard Learning and Development Agreement will provide great efficiencies for staff. The delegation of signing authority will assist in the effectiveness of the standard agreement.
