N. RECOMMENDATION: "That, subject to obtaining all necessary approvals, the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with Rogers Communications Inc. to legalize the existing Rogers pedestal and authorize the installation of fibre optic cable running approximately 14m connecting the existing Rogers pedestal to an existing Allstream grade level vault within the Civic Centre Park." BACKGROUND: Rogers Communications Inc. approached the City of Kitchener for permission to enter onto parklands and install a fibre optic cable, which would connect two already existing structures within the park. Currently, there is a Rogers pedestal and an Allstream vault already in existence within Civic Centre Park at the northeast corner of Ahrens Street and Queen Street North. The location of the proposed installation of the fibre optic cable connects these two existing structures and would run 1.5m inside the property line for approximately 14m. REPORT: Rogers Communications Inc. would like to legalize the existing pedestal on City parkland known as Civic Centre Park. Furthermore, Rogers Communications Inc. would like permission to install fibre optic cable which will encroach approximately 1.5m from the road allowance at Queen Street North for length of approximately 7.8m, at which point it will curve at a right angle for the remainder of the total trenching length of approximately 14m. Through the encroachment circulation process, it was discovered that there is a 6" gas main approximately 0.5m in front of the existing Allstream vault. Utilities staff has confirmed that the location of the existing gas main is not an issue for the installation of the fibre optic cable, provided Rogers Communications Inc. takes necessary precautions when working with the gas main. Attached is a drawing illustrating the location of the existing Rogers pedestal and Allstream vault and the proposed connection of the fibre optic cable between these two structures. 9 -1 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Efficient and Effective Government — Customer Service FINANCIAL IMPLICATIONS: The application fee is $249 which will be paid in accordance with the City's fee schedule. An additional $212 fee will be payable if the encroachment is approved to process the agreement and register the agreement on title. The minimum encroachment fee of $300 /year and the agreement processing fee will also be applicable if Council authorized this agreement. COMMUNITY ENGAGEMENT: Community engagement is not necessary for this process. CONCLUSION: Once support for legalizing the existing pedestal and permission for the installation of the fibre optic cable has been received from the appropriate staff, it will be in order to authorize the execution of an encroachment agreement with Rogers Communications Inc.
