SPECIAL COUNCIL MINUTES
SEPTEMBER 9, 2013 CITY OF KITCHENER
A special meeting of City Council was held at 5:30 p.m. this date, chaired by Mayor C. Zehr with all
members present except Councillors J. Gazzola and K. Galloway-Sealock.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
1. CSD-13-095 – NOISE EXEMPTION REQUEST – CENTRE IN THE SQUARE
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date, regarding a noise exemption request from the Centre
in the Square
Moved by Councillor B. Ioannidis
Seconded by Councillor Z. Janecki
“That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to The Centre In The Square for their Bandaloop event to be held on September 13 and
September 14, 2013, between the hours of 5:00 PM and 10:00 PM each day, as outlined in
Community Services Department report CSD-13-095.”

2. INS-13-076 – MARGARET AVENUE BRIDGE – SHORT AND LONG TERM SOLUTIONS
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date, regarding the Margaret Avenue bridge.
Moved by Councillor B. Ioannidis
Seconded by Councillor D. Glenn-Graham
“That the recommendation to remove the existing Margaret Avenue Bridge in the near term
and initiate an Environmental Assessment to replace it, be approved, as outlined in
Infrastructure Services Department report INS-13-076; and,
That the reallocation of funds from existing federal gas tax sources for the removal of the
existing Margaret Avenue Bridge ($250,000) and initiation of an Environmental Assessment
and predesign to replace it ($150,000), be approved, as outlined in Infrastructure Services
Department report dated INS 13-076; and,
That staff be directed to work towards identifying funding sources for a new bridge during the
2014 budget process; and,
That the Chief Administrative Officer or designate, be delegated the authority to approve the
tender for the removal of the Margaret Avenue Bridge, with a report to be provided on this
award at the next regularly scheduled Council meeting; and further,
That staff be directed to report back to the October 21, 2013 Community and Infrastructure
Services meeting, on a proposed project timeline and identified areas where processes can be
expedited to advance the construction schedule for the new bridge.”

3. FCS-13-146 – REQUEST TO EXTEND CANOE RENTAL – VICTORIA PARK
Council considered Finance and Corporate Services Department report FCS-13-146 (P.
Harris) recommending an extension of the temporary canoe rental business licence to permit
Canoeing on the Grand to operate in Victoria Park until October 14, 2013.

“That pursuant to Section 25.7.14 of Chapter 25 (Council Procedure) of the Municipal Code,
Council waive the requirement for Notice of Motion with respect to a motion to extend the
temporary canoe rental business operated at Victoria Park by Canoeing on the Grand.”
Carried with the required 2/3 vote of all members present.
Moved by Councillor F. Etherington
Seconded by Councillor Y. Fernandes
“That the request of Canoeing on the Grand to operate a temporary canoe rental business in
Victoria Park be extended to October 14, 2013 provided the required licence is obtained.”
Carried.
4. IN-CAMERA MEETING AUTHORIZATION
Moved by Councillor S. Davey
Seconded by Councillor B. Ioannidis
“That an in-camera meeting of City Council be held immediately following this special meeting to
consider a matter subject to solicitor-client privilege.”
Carried.
5. BY-LAW FOR THREE READINGS
Moved by Councillor B. Vrbanovic
Seconded by Councillor Z. Janecki
“That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2013-108 by the Clerk.”
Carried.
On motion the meeting adjourned at 5:33 p.m.
