HomeMy WebLinkAboutCSD-13-097 - Demolition Control App - 1209 Doon Village Rd REPORT TO: Community & Infrastructure Services Committee DATE OF MEETING: September 30, 2013 SUBMITTED BY: Alain Pinard,Director of Planning PREPARED BY: Jeff Medeiros, Planning Technician(519)741-2200x7067 WARD(S) INVOLVED: Ward 4 DATE OF REPORT: September 17, 2013 REPORT NO.: CSD-13-097 SUBJECT: DEMOLITION CONTROL APPLICATION DC13/07/D/JM 1209 DOON VILLAGE ROAD OWEN WILFONG Subject Lands 1209 Doon Village Road Figure 1: Location Map 1209 Doon Village Road RECOMMENDATION: That Demolition Control Application DC13/07/D/JMrequesting permission to demolish one (1) vacant single detached dwelling located at1209Doon Village Road,owned by Owen Wilfong, be approved withthe following condition: 1 - 1 The Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act subject to the following condition: In the event that construction of the new semi-detached dwelling is not substantially complete within two years from the day demolition of the existing residential property is manner as municipal taxes, $20,000 for each dwelling unit contained in the residential properties in respect of which the demolition permit is issued and such sum shall, until the payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued. REPORT: The Community Services Department has received an application requesting the demolition of a single detached dwelling, located at 1209 Doon Village Road. The subject property is zoned Residential Two Zone(R-2) in the Zoning By-law with Special Regulation Provision 1 (1R); and Special Use Provision 187 (187U). The property is designated Low Official Plan. Figure 2: Front View of Single Detached Dwelling The property is currently developed with one single-detached dwelling, an attached garage and an accessory building, and is situated on an approximately 1,574.82 square metre lot. The Owner has indicated that the existing single-detached dwelling is to be demolished and a new single detached dwelling is proposed. Planning staff circulated the application to internal departments. No issues or concerns were identified. 1 - 2 Planning Comments: On June 24, 2013, the City passed a new demolition control by-law. Under the new By-law, only those lands within zoning classifications R-1 through R--law 85-1 are required to be considered for demolition control. The subject property falls within the the new City policy. Redevelopment is proposed for the property. The property is designated under Part V of the Ontario Heritage Act by virtue of its location in the Upper Doon Heritage Conservation District. Therefore it was determined that the subject application would require council approval for a heritage permit for demolition due to its status under the Ontario Heritage Act. th, request for demolition and Council approved the Heritage Permit at the September 162013 Council meeting. Planning staff has no concerns with the proposed demolition of the existing single detached dwelling.Staff is of the opinion that the proposed demolition will have very little impact on the adjacent lands, surrounding uses and the overall neighbourhood. Redevelopment of the site with a new single detached dwelling is consistent with the intent of the Low Rise Residential designation of the Official Plan and is a permitted use under the Residential Two Zone (R-2). ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The proposed demolition is required prior to the redevelopment of the subject site and will align with the Kitchener Strategic Plan as it ensures the implementation of the community priority Development with appropriate redevelopment that is consistent with Provincial, Regional and City planning policies. FINANCIAL IMPLICATIONS: No new or additional capital budget requests are expected with this recommendation. COMMUNITY ENGAGEMENT: The applicant shall be required to post a sign on the property advising of the pending demolition of the residential building. A courtesy notice will be circulated to all property owners within 30 metres of the subject property, advising of the pending demolition of the building for information purposes only.The sign and courtesy notice fulfill the inform theme of the Community Engagement Strategy. CONCLUSION: Planning staff has reviewed this application and is of the opinion that the proposed demolition is justified as the owner intends to build a new single detached dwelling in place of the existing dwelling. The owner has received approval from City Council for a Heritage Permit to demolish the existing dwelling. The proposed redevelopment is compatible with the neighbourhood, and is in conformity with the Official Plan and Zoning By-law.
