CSD-13-098 - SAFE & HEALTHY COMMUNITY ADVISORY COMMITTEE WORK PLAN

2013-2014
The Committee considered Community Services Department report CSD-13-098, dated
September 13, 2013 recommending approval of the Safe and Healthy Community Advisory
Committee Work Plan 2013-2014.
Mr. Doug McKlusky, Safe and Healthy Community Advisory Committee and Mr. M. Hildebrand
presented the Work Plan.
On motion by Councillor Y. Fernandes -
it was resolved:
“That the Safe and Healthy Community Advisory Committee Work Plan 2013-2014, as
attached to Community Services Department report CSD-13-098, be approved.”
The Committee then recessed at 1:21 p.m. and reconvened at 2:25 p.m. Chaired by Councillor B.
Ioannidis, with all members present except Mayor C. Zehr and Councillor B. Vrbanovic.
CSD-13-097 - DEMOLITION CONTROL APPLICATION DC13/07/D/JM

- 1209 DOON VILLAGE ROAD
- OWEN WILFONG
The Committee considered Community Services Department report CSD-13-097, dated
September 17, 2013 recommending approval of Demolition Control Application DC13/07/D/JM
for 1209 Doon Village Road, subject to conditions.
It was noted that the condition pertaining to the approval of the Demolition Control Application
incorrectly referenced a semi-detached dwelling as outlined in the recommendation contained
in Report CSD-13-097; whereas, it should refer to the construction of a single detached
dwelling. The Committee agreed to amend the staff recommendation to correct the condition.
Councillor Y. Fernandes questioned whether the applicant was permitted to undertake any part
of the demolition prior to receiving Council approval. She noted that the applicant has already
begun to tear down portions of the home and appears to be burning the discarded materials in
the rear yard of the property. Ms. D. Ross advised that the applicant is not permitted to begin
demolition until receiving approval and noted that she would follow-up with Building staff
regarding this matter.

- 1209 DOON VILLAGE ROAD
- OWEN WILFONG (CONT’D)
“That Demolition Control Application DC13/07/D/JM requesting permission to demolish
one (1) vacant single detached dwelling located at 1209 Doon Village Road, owned by
Owen Wilfong, be approved, as outlined in Community Services Department report
CSD-13-097, with the following condition:
The Chief Building Official may authorize and issue a demolition permit under Section
33(6) of the Planning Act subject to the following condition:
In the event that construction of the new single detached dwelling is not
substantially complete within two years from the day demolition of the existing
residential property is commenced, the City Clerk may enter on the collector’s
roll, to be collected in like manner as municipal taxes, $20,000 for each dwelling
unit contained in the residential properties in respect of which the demolition
permit is issued and such sum shall, until the payment thereof, be a lien or
charge upon the land in respect of which the permit to demolish the residential
property is issued.”
INS-13-080 - ON-STREET PARKING REGULATIONS

- QUEEN STREET SOUTH
The Committee considered Infrastructure Services Department report INS-13-080, dated
September 18, 2013 recommending an amendment to the existing on-street parking
regulations on a portion of Queen Street South.
On motion by Councillor D. Glenn-Graham -
it was resolved:
“That the Uniform Traffic By-law be amended to implement a 30 minute parking time
limit on Queen Street South from a point 20 meters south of St. George Street to a point
21 meters south thereof, as outlined in Infrastructure Services Department report INS-
13-080.”
INS-13-088 - ON-STREET PARKING REGULATIONS

- HEINS AVENUE
The Committee considered Infrastructure Services Department report INS-13-088, dated
September 18, 2013 recommending a parking prohibition on a portion of Heins Avenue.
On motion by Councillor D. Glenn-Graham -
it was resolved:
“That on-street parking be prohibited on the west side of Heins Avenue from Joseph
Street to a point 26 meters south thereof; and,
That on-street be permitted on the west side of Heins Avenue from Jubilee Drive to a
point 26 meters south of Joseph Street for a maximum period of two (2) consecutive
hours, 8:00 a.m. - 6:00 p.m., Monday to Friday; and further,
That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure
Services Department report INS-13-088.”
INS-13-091 - ON-STREET PARKING REGULATIONS

- LORRAINE AVENUE
The Committee considered Infrastructure Services Department report INS-13-091, dated
September 16, 2013 recommending an amendment to the on-street parking regulations for
portions of Lorraine Avenue.

On motion by Councillor D. Glenn-Graham -
it was resolved:
“That ‘Schedule 1 - No Parking’ of the Uniform Traffic By-law be amended to reflect the
on-street parking regulations for specified sections of Lorraine Avenue, as outlined in
Appendix ‘A’ of Infrastructure Services Department report INS-13-091.”
INS-13-092 - NOISE EXEMPTION REQUEST

- HIGHWAY 401 BRIDGE IMPROVEMENTS
The Committee considered Infrastructure Services Department report INS-13-092, dated
September 18, 2013 concerning a noise exemption request for the Ministry of Transportation
(MTO) and its contractor(s) for the construction work related to the Highway 401 and Bridge
Improvements.
On motion by Councillor D. Glenn-Graham -
it was resolved:
“That the Ministry of Transportation of Ontario (MTO) and its contractor(s) be exempt
from the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article
6 Construction Work during the Highway 401 and Bridge Improvements in the City of
Kitchener, as outlined in Infrastructure Services Department report INS-13-092; and
further,
That the requested noise by-law exemption is for a period between the hours of 7:00
p.m. and 7:00 a.m. for the period May 1, 2014 to November 30, 2014.”
INS-13-020 - KOLB CREEK - CLASS ENVIRONMENTAL ASSESSMENT

The Committee considered Infrastructure Services Department report INS-13-020, dated
September 25, 2013 recommending that the Kolb Creek - Class Environmental Assessment
(EA) be endorsed and to permit a Notice of Filing.
Mr. Chris Denich, Aquafor Beech Ltd. and Mr. S. Allen presented the report indicating that the
primary objective of the study is to determine a preferred alternative to alleviate local flooding
issues along the identified study area for a portion of Kolb Creek. Mr. Denich advised that the
various alternatives were evaluated using 23 equally weighted criteria; resulting in selection of
Alternative 2, an overflow sewer along Rothsay Avenue as the preferred alternative. He
further advised that the study also evaluated the opportunities to retrofit an existing stormwater
management facility (Pond 6) within Forfar Park to improve water quality within Kolb Creek.
He indicated that the preferred alternative identified for Pond 6 is Alternative 3, a Wetland
retrofit.
A motion was brought forward by Councillor Y. Fernandes to refer consideration of the
recommendation outlined in Report INS-13-020 to the October 7, 2013 Council meeting to
allow for the circulation of the September 19, 2013 Environmental Committee minutes.
On motion by Councillor Y. Fernandes -
it was resolved:
“That consideration of the following recommendation contained in Infrastructure
Services Department report INS-13-020 pertaining to Kolb Creek Class Environmental
be referred to the October 7, 2013 Council meeting,
Assessment to allow time for the
circulation of the September 19, 2013, Environmental Committee minutes:
“That the Kolb Creek Class Environmental Assessment Report prepared by
Aquafor Beech, dated September 30, 2013, be received; and further,

accordance with the requirements of the Class Environmental Assessment for
Remedial Flood and Erosion Control Projects, as outlined in Infrastructure
Services Department report INS-13-020.”
