SUBJECT: Easement to Hydro One due to LRT — Former Vanier Drive
Road Allowance
RECOMMENDATION:
That part of the lands located in the former Vanier Drive road allowance, being 9 on the
draft Reference Plan attached (the "Subject Lands ") be declared surplus to the City's
needs; and further
That the City grant an easement to Hydro One Networks Inc. ( "HONI ") on terms and
conditions satisfactory to the City Solicitor; and further
That all costs with respect to the transaction, including legal fees, be borne by the
Region of Waterloo; and further
That the Mayor and Clerk be authorized to execute any documentation in this regard
required by and to the satisfaction of the City Solicitor.

REPORT:
Due to the construction of the LRT system, the Region of Waterloo is causing HONI to bury its
wires along the HONI corridor between Courtland and Fairview Mall, running parallel to
Fairway. HONI requires permanent access to the corridor through the closed Vanier Drive
Road Allowance. The road, formerly known as Mill Street, was closed by By -law 436271 in
1970. Legal has confirmed with Transportation Planning that there is no proposal to ever re-
open this road. The land required is Part 9 on the draft reference plan attached as Appendix
"A" to this report. The total size of the land taking is 2087 square metres.
The required works are the result of the proposed LRT. Therefore, the Region will be
reimbursing any costs HONI has, including matters with respect to this easement. However,
HONI currently benefits from legacy rights to cross the old road allowance with its hydro wires.
The main difference going forward is that the lines will be buried down the north side of the

corridor to accommodate the LRT on the south side of the corridor. The Region has agreed
to:
1) Collaborate with HONI and the City and contribute funds to relocate and legalize the
playground established on HONI lands by the City years ago;
2) Collaborate with HONI and the City to reinstate at the Region's sole expense, an existing
multipurpose trail that runs parallel to the hydro lines; and
3) Collaborate with HONI and the City to legalize the existing sidewalk area adjacent to
Courtland but located on HONI lands.
Legal Services recommends that as HONI currently benefits from rights to cross the former
road allowance with its wires, and due to the items listed above, that only nominal
consideration be requested from HONI.
FINANCIAL IMPLICATIONS:
There will be no financial impact to the City as all costs in this matter will be borne by the
Region.

CONCLUSION:
Staff recommends that Council authorize the granting of this easement to HONI to address
access and required works resulting from the construction of the LRT.
