Livingstone, Committee Administrator INS-13-095 - ON-STREET PARKING REGULATIONS 1. - DAVID BERGEY DRIVE The Committee considered Infrastructure Services Department report INS-13-095, dated October 9, 2013 recommending a parking prohibition on a portion of David Bergey Drive. On motion by Mayor C. Zehr - it was resolved: “That on-street parking be prohibited on the north side of David Bergey Drive from a point 56 metres west of Activa Avenue to a point 36 metres west thereof; and, That on-street parking be prohibited on the north side of David Bergey Drive from a point 135 metres west of Activa Avenue to a point 40 metres west thereof; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure Services Department report INS-13-095.” CSD-13-102 - NOISE EXEMPTION REQUEST 2. - BETHANY EVANGELICAL CHURCH The Committee considered Community Services Department report CSD-13-102, dated October 10, 2013 recommending approval of a noise exemption request for the annual Christmas Pageant at Bethany Evangelical Missionary Church. On motion by Mayor C. Zehr - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Bethany Evangelical Missionary Church for their annual Christmas Pageant on December 6, 7 and 8, 2013, between the hours of 6:00 P.M. and 9 P.M., daily, as outlined in Community Services Department report CSD-13-102.” CSD-13-103 - SUBDIVISION AGREEMENT REPORT 3. The Committee considered Community Services Department report CSD-13-103, dated October 4, 2013 recommending that the Standard Residential Subdivision Agreement be updated to reflect current terminology, standards and conditions, without substantially changing the standard format of the agreement. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE OCTOBER 21, 2013 - 93 - CITY OF KITCHENER CSD-13-103 - SUBDIVISION AGREEMENT REPORT (CONT’D) 3. Ms. J. von Westerholt presented the report, noting that there have been no significant changes to the report; rather, the proposed Standard Residential Subdivision Agreement is intended to improve administration and reflect current regulations and conditions that will benefit the City upon implementation. She indicated that there were two clerical errors identified in the agreement noting page 3-13 of the agenda, Failure to Comply section, advising that the paragraph should reference 2.3. rather than 2.2. and agenda page 3-16, Warranty Securities section, stating that the first two references should reflect section 3.4. At the request of Councillor J. Gazzola, Ms. von Westerholt agreed to make the necessary corrections and have the final copy of the agreement posted with the online agenda. On motion by Councillor Z. Janecki - it was resolved: “That the updates to the Standard Residential Subdivision Agreement be approved, as attached Appendix “A” of Community Services Department report CSD-13-103, and as amended at the October 21, 2013 Community and Infrastructure Services Committee meeting.” INS-13-086 - VICTORIA PARK EQUIPMENT 4. The Committee considered Infrastructure Services Department report INS-13-086, dated October 16, 2013 regarding the Victoria Park Maintenance facility and the increased number of vehicles within the park, close proximity to residence, noise of the equipment and safety of the park users. Mr. J. Witmer and Mr. G. Hummel were in attendance and responded to questions from the Committee. Ms. Lesley Claire and Ms. Dominique Whelan, area residents, expressed concerns with the number of City vehicles travelling through Victoria Park. Ms. Claire stated that since their initial presentation at the August 26, 2013 Council meeting, a meeting was held on September 11, 2013 with staff and a number of the residents to discuss potential solutions to the increased City vehicle traffic in the neighbourhood surrounding the Park. She further advised that although the residents are satisfied with the initial discussions, staff has not proposed any immediate or long term solution to the increase in City vehicle traffic. A motion was brought forward by Councillor F. Etherington to direct staff to report back to the October 28, 2013 Council meeting with recommendations to relocate and reduce the total number of City vehicles stored and maintained at the Victoria Park Maintenance Facility, in an effort to reduce the amount of City vehicle traffic and noise experienced by the residents on Schneider Street, Dill Street and David Street. A motion was brought forward by Councillor D. Glenn-Graham, which was accepted as friendly, to amend Councillor Etherington’s motion to require staff to investigate alternatives that would seek to reduce the City vehicle traffic to the levels that existed prior to the closure of the Bramm Street Operations Facility in 2011. A motion was brought forward by Councillor Z. Janecki to amend Councillor Etherington’s motion to direct staff to investigate an alternative access point off West Avenue utilizing the Iron Horse Trail as the connection to the rear of the Victoria Park Maintenance Facility. Councillor F. Etherington advised that Councillor Z. Janecki’s amendment was not considered friendly due to potential safety concerns with vehicles using the trail. Mr. J. Willmer advised that any proposed recommendations arising from this matter would likely have budget implications and proposed that Councillor F. Etherington’s motion be considered at the December 12, 2013 special Finance and Corporate Services Committee meeting pertaining to the 2014 Operating budget. Councillor F. Etherington accepted the suggestion from Mr. Willmer to refer consideration of his motion to the special Finance and Corporate Services Committee meeting on December 12, 2013. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE OCTOBER 21, 2013 - 94 - CITY OF KITCHENER INS-13-086 - VICTORIA PARK EQUIPMENT (CONT’D) 4. LOST Councillor Z. Janecki’s amendment was then voted and on a recorded vote, with Councillors J. Gazzola, Z. Janecki, P. Singh and S. Davey voting in favour; and, Mayor C. Zehr and Councillors D. Glenn-Graham, B. Ioannidis, K. Galloway-Sealock, B. Vrbanovic, and F. Etherington voting in opposition. On motion by Councillor F. Etherington - it was resolved: “That staff be directed to report back on possible recommendations to reduce the number of City vehicles currently being stored and maintained at the Victoria Park Maintenance facility at the special Finance and Corporate Services meeting on December 12, 2013 dealing with the 2014 operating budget; and further, That the proposed alternatives should seek to potentially restore the traffic volumes of City vehicles to what existed in 2011.” INS-13-090 - MARGARET AVENUE BRIDGE REPLACEMENT - PROJECT TIMELINES 5. The Committee considered Infrastructure Services Department report INS-13-090, dated October 15, 2013 regarding replacement of the Margaret Avenue bridge, the steps required and the proposed schedule for the entire project. Ms. B. Robinson presented the report. Mr. S. Allen and Mr. C. Spere were in attendance and responded to questions from the Committee. Ms. B. Robinson reviewed the Report, highlighting the steps required to replace the Margaret Avenue Bridge including: environmental assessment and preliminary design; detailed design; construction; and, alternatives for cyclists and pedestrians. She stated that Class ‘C’ estimates have been provided for reference and as the process continues, more detailed estimates will be ascertained. In response to questions regarding alternatives to replacing Margaret Avenue Bridge, Ms. Robinson stated that a level crossing was discarded as the grade would be 11%. She explained that in order to lessen the grade from 11%, a large retaining wall would be required and property acquisition would be necessary with particulars to be determined through pre- engineering design. At the request of Councillor D. Glenn-Graham, Ms. Robsinson agreed to provide the cost of expanding the bridge distance to reduce the grade and information on the acceptable road grade.
