HomeMy WebLinkAboutFCS-13-194 - Land Purchases from Region - Freeport Sewage Pumping StationStaff Report Finance and Corporate Services Department REPORT TO: Committee of the Whole DATE OF MEETING: December 9, 2013 SUBMITTED BY: Steve Ross 519 - 741 -2200 ext.7266 PREPARED BY: Steve Ross 519 - 741 -2200 ext.7266 WARD(S) INVOLVED: 3 DATE OF REPORT: December 2, 2013 REPORT NO.: FCS -13 -194 wvmkitrhener ca SUBJECT: Purchase of Land from Region of Waterloo — Freeport Sewage Pumping Station RECOMMENDATION: That part of the lands adjacent to the Freeport Sewage Pumping Station and located within the road allowance for King Street, being Parts 1, 2 and 3 on the draft reference plan attached (the "Subject Lands ") be purchased from the Region of Waterloo for nominal consideration, subject to the reservation of an easement over Part 2 on the draft reference plan; That the City assist in ensuring KW Hydro receives an easement from the Region of Waterloo over Part 4, on the draft Reference Plan attached; and, That the City pay all costs associated with the transaction, including the Region's road closure and advertising costs, as well as all other administrative fees, to the satisfaction of the City Solicitor; and further, That the Mayor and Clerk be authorized to execute all documents required to complete the foregoing transaction to the satisfaction of the City Solicitor. EXECUTIVE SUMMARY: N/A REPORT: The Freeport Sewage Pumping Station (FSPS) is located at 3563 King Street East, Kitchener near the Freeport Hospital Long Term Care Facility. An Environmental Study Report was completed in November 2010 and approved by council. The upgrades to the existing pumping station and forcemain will be completed as recommended in this report. The City retained MTE Consultants for the design and contract administration to complete the proposed upgrades. FSPS design was completed by MTE Consultants in October 2013 and project was tendered for construction in November 2013, a separate council report has been 2. -1 submitted for award of the tender. During the site plan approval process it was noted that the lands where FSPS is located belongs to The Region of Waterloo. The City's planning staff has indicated that these lands must be owned by the City to meet Site Plan requirements. Staff had several meetings with Region's Planning and Legal department for purchase /easement of this land in City's favor. The Region and City's staff have reviewed the attached reference plans and are in agreement for such transfer. Given these lands are required for a municipal purpose; these lands for a nominal consideration of $1( disbursements for the highway closure and registratior easements will be paid by the City. As per this transfer, as shown in attached reference plan; however Region part 2 which facilitates the storm sewer conveying storm FINANCIAL IMPLICATIONS: Region has agreed to convey one dollar only). However i of these lands and relevant City will own parts 1, 2 and 3, will have an easement over water from King Street East. There will be a nominal financial impact to the City as detailed in this report. COMMUNICATIONS: N/A CONCLUSION: Staff recommends that Council authorize the purchase of this land from Region and granting of this easement to Region to facilitate the construction of required works.
