HomeMy WebLinkAboutINS-14-005 - Cycling Advisory Committee By-Law Review Recommendation and Annual Update REPORT TO:Community and Infrastructure Services Committee DATE OF MEETING: January 13, 2014 SUBMITTED BY: Justin Readman, Director of Transportation Services PREPARED BY: Josh Joseph, Transportation Demand Management Coordinator WARD(S) INVOLVED: All Wards DATE OF REPORT: January 6, 2014 REPORT NO.: INS-14-005 SUBJECT: CYCLING ADVISORY COMMITTEE BY-LAW REVIEW RECOMMENDATIONS RECOMMENDATION: That staff be directed to review Kitchener Cycling Advisory Committee’s recommendations for changes to existing City of Kitchener Bylaws to improve cycling- related safety and provide comments within 90 days. BACKGROUND: On August 27, 2012, Kitchener City Council endorsed a report arising from the Office of the Chief Coroner entitled “Cycling Death Review, A Review of All Accidental Cycling Deaths in Ontario from January 1st, 2006 to December 31st, 2010”, and passed a motion to “review all of its Bylaws related to cycling to ensure consistency, ease of understanding and better promotion and enforcement”. The City of Kitchener Cycling Advisory Committee (KCAC) was tasked with presenting recommendations to Kitchener City Council. There is a substantial body of knowledge and practice that has been collected and implemented in various jurisdictions both here and abroad and it is the committee’s intention not to create an overwhelming process to address cycling safety through a review of Bylaws but to present the best collected wisdom that is currently in use elsewhere. The current By-Law Number 2007-138 has been in force since November 1, 2007. REPORT: The attached annex provides an overview of the cycling advisory committee’s By-law recommendations, which focus on the following: 3 - 1 1. Passing a municipal “safe passing bylaw” or 1 metre rule 2. Rescind the prohibition on riding abreast 3. Explicitly prohibit dooring 4. Motorist turns at intersections where cyclists present 5. Yield to cyclists entering/in roundabouts 6. E-scooters/bikes on multi-use pathways 7. Cyclist behaviour on multi-use pathways Staff are requiring formal Council direction to review these proposed By-law recommendations. FINANCIAL IMPLICATIONS: None at this time. CONCLUSION: While these are recommendations for changes to City of Kitchener By-laws, the cycling advisory committee anticipates that the City engage and collaborate with other local municipal jurisdictions as well as the Province of Ontario to ensure consistent Bylaws in the pursuit of safe cyclist and motorist interaction.
