HomeMy WebLinkAboutFCS-14-013 - Committee of Adjustment Various REPORT TO:Committee of the Whole DATE OF MEETING: January 27, 2014 SUBMITTED BY: Dianna Saunderson, Secretary-Treasurer, Committee of Adjustment (519-741-2200 ext. 7277) PREPARED BY: Holly Dyson, Administrative Clerk (519-741-2200 ext. 7594) WARD(S) INVOLVED: 5 & 8 DATE OF REPORT: January 21, 2014 REPORT NO.: FCS-14-013 SUBJECT: Fence Variance – 2 Sweet William Street; and, Sign Variance – 370 Highland Road West RECOMMENDATION: “That the application of Lisa Turner (FN 2013-005 – 2 Sweet William Street) requesting permission to legalize an existing 1.82m (6’) high wooden privacy fence having a setback from an exterior side lot line abutting Activa Avenue of 0.45m (1.476’) rather than the required 1.5m (4.92’), on Part Block 10, Registered Plan 58M-267, being Part 184 on Reference Plan 58R-13912, 2 Sweet BE APPROVED William Street, Kitchener, Ontario, , subject to the following condition. 1. That the owner shall submit and obtain approval of a landscape plan from the City’s Director of Planning. The landscape plan shall show landscaping to be installed between the fence and the exterior side lot line abutting Activa Avenue. All landscaping shall be maintained in accordance with the approved landscape plan.” - and - “That the application of Strathallen Property Management Inc. (SG 2013-004 – 370 Highland Road West) requesting permission to replace the existing tower sign with a new ground supported sign having a height of 10.5m (34.448’) rather than the permitted 7.5m (24.6’); and, an area of 32.5 sq.m (349.827 sq.ft) rather than the permitted 20 sq.m (215.278 sq.ft), on Part Lot 86, Part Lots 88 BE APPROVED to 92 & Part Lot 96, Plan 786, 370 Highland Road West, Kitchener, Ontario, , subject to the following condition: 1. That the owner shall obtain a sign permit shall from the City’s Planning Division for the proposed ground supported sign.” REPORT: The Committee of Adjustment met as a standing committee of City Council on Tuesday December 10, 2013, to consider one application pursuant to Chapter 630 (FENCES) of the City of Kitchener Municipal Code. 4 - 1 The Committee of Adjustment also met as a standing committee of City Council on Tuesday January 21, 2014, to consider one application pursuant to Chapter 680 (SIGNS) of the City of Kitchener Municipal Code. These recommendations are being forwarded to you on behalf of the Committee of Adjustment for your consideration. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment operates as a Standing Committee of City Council, and as such represents efficient and effective government. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: As directed by the Sign By-law and Fence By-Law, notice of Applications for Variance to the Sign By-law and Fence By-law are published in the Record 15 - 18 days prior to the Committee of Adjustment meeting at which the application will be considered.
