BACKGROUND obtain On March 8, 2010, a Statutory Public Meeting required by the Pla preliminary ideas or suggestions to be considered in drafting th Official Plan. As a result of the input received at the March 8, 2010 meeting a number of background studies and reports and master plans, a fir Official Plan was tabled at the Planning & Strategic Initiatives Committee (PS June 20, 2011. In response to 769 comments made by 30 public agencies, public bodies, consultants, property-owners, a was prepared and tabled at the Planning & Strategic Initiatives Committee meeting on May 27, 20 Two Council Strategy Sessions were held on August 12, 2013 and o first Council Strategy Session reviewed the Urban Structure poli 3 - 1 The second Council Strategy Session reviewed the Employment Area Policies, policies related to drive-throughs, Sustainable Develo quality/ waste management) and the Natural Heritage System polic with respect to the Locally Significant Features. Two Open Houses were held on September 23, 2013 at the Kitchener on September 24, 2013 in the Rotunda at Kitchener City Hall. Twe the first Open House and nine (9) persons attended the second Op On October 4, 2013 planning staff hosted an Industry Session for to provide more information and answer any questions on the seco Plan. Thirteen (13) consultants/developers were in attendance. After the commenting period on the second public draft ended on staff made available four (4) half days to hold meetings with th wished to discuss their submission further. REPORT: As noted above, at the end of the October 11, 2013 commenting pe the new Official Plan, staff had received 358 comments from 48 public agencies, public bodies, consultants and property-owners. Several meeting times were set up to review the submissions and discuss the comments and answer questions with individual consultants, developers and public agencies. Planning staff also provided 48 individualized letters to respond to the submissions that had been received. Unlike the comments on the first draft, the questions and issues were much more focused on specific topics such as: the density/intensification level targets; policies related to the Region of Waterloo Official Plan appeal the Natural Heritage System policies and mapping, particularly Restoration Area policies; Industrial Employment Areas and office uses; Map 11 Integrated Transportation System; drive-throughs; and several property specific issues related to the proposed offici application of other general official plan policies. 3 - 2 Some comments continued to be received after the commenting peri. Statutory Public Meeting The public meeting on March 17, 2014 is a Statutory Public Meeti This is the second statutory public meeting required by the Plan Official Plan. After many months and aft the new Official Plan for public review on June 20, 2011 and on , planning staff have produced a final draft of the new Official Plan for review before it is adopted by Council. Next Steps After the Statutory Public meeting, staff will review the oral a to bring a final version of the new Official Plan for the City o Committee/Council meeting in June 2014. Once adopted, it is forwarded to the Region for approval. The existing Official Plan remains in place until the new Plan is approved and in effect. It is anticipated that portions of our new Official Plan that relate to appeals of the Regional Plan will be formally deferred by the Region. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The Official Plan Review aligns with the City of Kitchener Strat new Official Plan will incorporate the Community Vision in Part . The goals, objectives and policies also support and align with all of the 6 Strategic Plan. FINANCIAL IMPLICATIONS: There are no new capital budget implications as part of this rep being prepared in house with minimal funds used to date from the Planning Studies accou other than staff time for part of one temporary position. COMMUNITY ENGAGEMENT: Community engagement of the Official Plan is mandated and regula Act. CONCLUSION: The proposed final incorporates much of the master planning that has already taken place through a number of major 3 - 4 development over the next two decades on is to ensure that the City of Kitchener is a complete and healthy community. Planning staff look forward to receiving additional community in final draft of the new Official Plan to be able to take a final Council for adoption in June 2014. This amendment is comprised of Sections 1 to 4 inclusive. SECTION 2 PURPOSE OF THE AMENDMENT The purpose of the amendment is to adopt a new Official Plan for the City of Kitchener, save and except the Secondary Plans. The amendment also proposes to remove some lands from some of the deferred Secondary Plans as these lands are proposed to be included as part of the Urban Growth Centre in the new Official Plan. SECTION 3 BASIS OF THE AMENDMENT The effect of the amendment is to adopt a new Official Plan for the City of Kitchener. The third has regard and is in conformity with the Provincial Policy Statement (2005), the provincial Places to Grow Act (2005) and Growth Plan for the Greater Golden Horseshoe (2006), changes to the Planning Act through Bill 51 (Royal Assent in 2006, in effect January 2007) and the new Regional Official Plan (2009). It incorporates recommendations from a number of City master plans and other major initiatives. allows opportunity to reduce our environmental impact, further strengthen our economy, provide park and recreational facilities, improve our transportation options and celebrate our arts and culture. The vision of the new Official Plan is to ensure that the City of Kitchener is a complete and healthy community. Secondary Plans The existing Secondary Plans continue to be deferred as part of this Official Plan Review and are not part of the new Official Plan as the majority of the existing secondary plans are located within Major Transit Station Areas. Th Through this exercise, the City may determine that the existing Secondary Plans affected by Station Area Plans may be amended to implement the recommendations of the Station Area Plans, consolidated into one or more plans or they may be determined to be no longer required. Although the Secondary Plans are proposed to be deferred, some of the lands within the Secondary Plans will be located within the boundary of the new Urban Growth Centre (UGC). The UGC boundary contained in the new Official Plan was determined by the Province in consultation with the City of amendment also proposes to remove those lands proposed to be part of the new Urban Growth Centre from the deferred Secondary Plans. Amendments are also proposed to the Floodplain and Environmental Areas Secondary Plan Maps to reflect the proposed new boundaries of the Secondary Plans. The amendment to the Secondary Plans also includes removing the lands, municipally known as 809 Wellington Street, from the North Ward Secondary Plan and bringing these lands into the new Official Plan. The amendment also proposes to redesignate the lands for Business Park Employment uses. 3 - 11 SECTION 4 THE AMENDMENT 1. The City of Kitchener Official Plan is hereby amended as follows: a) That Part 3, Section 13.1, Civic Centre Secondary Plan, is amended as follows: i) removing the lands as shown in the area of amendment on the attached Schedule - Map 9 Civic Centre Secondary Plan from the Civic Centre Secondary Plan. b) That Part 3, Section 13.3, Cedar Hill Secondary Plan, is amended as follows: i) removing the lands as shown in the area of amendment on the attached Schedule - Map 11 Cedar Hill Secondary Plan from the Cedar Hill Secondary Plan. c) That Part 3, Section 13.4, Mill Courtland-Woodside Park Secondary Plan is amended as follows: i) removing the lands as shown in the area of amendment on the attached Schedule - Map 12 Mill Courtland-Woodside Park Secondary Plan from the Mill Courtland Woodside Park Secondary Plan. ii) removing the lands as shown in the area of amendment on the attached Schedule - Map13 Floodplain and Environmental Areas from the Mill Courtland Woodside Park Secondary Plan. d) That Part 3, Section 13.5, Victoria Park Secondary Plan, is amended as follows: i) deleting Policy 13.5.4.6. ii) removing the lands as shown in the area of amendment on the attached Schedule - Map 14 Victoria Park Secondary Plan from the Victoria Park Secondary Plan. iii) removing the lands as shown in the area of amendment on the attached Schedule - Map 15 Floodplain and Environmental Areas from the Victoria Park Secondary Plan. e) That Part 3, Section 13.8, North Ward Secondary Plan is amended as follows: i) removing the lands shown in the area of amendment on the attached Schedule - Map 19 - North Ward Secondary Pan from the North Ward Secondary Plan. f) H g) That Part 1 - Introduction, Part 2 General Policies, Part 4 Managing the Plan and Part 5 Schedules, comprising of the City of Kitchener Official Plan, be repealed (deleted) at such time as the new Official Plan for the City of Kitchener as contained in Schedule is approved by the Regional Municipality of Waterloo and in effect. h) That Part 3 General Land Use Plan, save and except Part 3, Section 13 Secondary Plans, of the City of Kitchener Official Plan be repealed (deleted) at such time as the new Official Plan for the City of Kitchener Regional Municipality of Waterloo and in effect. 3 - 12 !! !!! 3 - 13 !! !!! 3 - 14 !! !!! 3 - 15 ! 3 - 16 !! !!! 3 - 17 ! 3 - 18 !! !!! 3 - 19
