RECOMMENDATION:
That the oral and written submissions received by the Statutory Public Meeting on the
proposed new Official Plan,dated February 21, 2014, and related Official Plan
Amendment,-14-011, be considered in the
preparation of the fin

That following the March 17, 2014 Statutory Public Meeting on the proposed new
Official Plan and related Official Plan Amendment, staff will bring forward a final version
of the new Official Plan and related Official Plan Amendment for consideration of
adoption by Council.
BACKGROUND

REPORT:
As noted above, at the end of the October 11, 2013 commenting pe
the new Official Plan, staff had received 358 comments from 48 public agencies, public bodies,
consultants and property-owners. Several meeting times were set up to review the submissions
and discuss the comments and answer questions with individual consultants, developers and
public agencies. Planning staff also provided 48 individualized letters to respond to the
submissions that had been received.
Unlike the comments on the first draft, the questions and issues were much more focused on
specific topics such as:
the density/intensification level targets;
policies related to the Region of Waterloo Official Plan appeal
the Natural Heritage System policies and mapping, particularly
Restoration Area policies;
Industrial Employment Areas and office uses;
Map 11 Integrated Transportation System;
drive-throughs; and
several property specific issues related to the proposed offici
application of other general official plan policies.

Statutory Public Meeting
The public meeting on March 17, 2014 is a Statutory Public Meeti

After the Statutory Public meeting, staff will review the oral a

Once adopted, it is forwarded to the Region for approval. The existing Official Plan remains in
place until the new Plan is approved and in effect. It is anticipated that portions of our new
Official Plan that relate to appeals of the Regional Plan will be formally deferred by the Region.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The Official Plan Review aligns with the City of Kitchener Strat

Council and the City of Kitchener to the Ontario Municipal Board.

AMENDMENT NO. __ TO THE OFFICIAL PLAN
OF THE CITY OF KITCHENER
SECTION 1 TITLE AND COMPONENTS
This amendment shall be referred to as Amendment No. __ to the Official Plan of the City of Kitchener. This
amendment is comprised of Sections 1 to 4 inclusive.
SECTION 2 PURPOSE OF THE AMENDMENT
The purpose of the amendment is to adopt a new Official Plan for the City of Kitchener, save and except the
Secondary Plans. The amendment also proposes to remove some lands from some of the deferred Secondary
Plans as these lands are proposed to be included as part of the Urban Growth Centre in the new Official Plan.
SECTION 3 BASIS OF THE AMENDMENT
The effect of the amendment is to adopt a new Official Plan for the City of Kitchener.
The third has regard and is in conformity with the Provincial Policy
Statement (2005), the provincial Places to Grow Act (2005) and Growth Plan for the Greater Golden
Horseshoe (2006), changes to the Planning Act through Bill 51 (Royal Assent in 2006, in effect January
2007) and the new Regional Official Plan (2009). It incorporates recommendations from a number of City
master plans and other major initiatives.

The existing Secondary Plans continue to be deferred as part of this Official Plan Review and are not part
of the new Official Plan as the majority of the existing secondary plans are located within Major Transit
Station Areas. Th
Through this exercise, the City may determine that the existing Secondary Plans affected by Station Area
Plans may be amended to implement the recommendations of the Station Area Plans, consolidated into
one or more plans or they may be determined to be no longer required.
Although the Secondary Plans are proposed to be deferred, some of the lands within the Secondary Plans
will be located within the boundary of the new Urban Growth Centre (UGC). The UGC boundary
contained in the new Official Plan was determined by the Province in consultation with the City of

from the deferred Secondary Plans. Amendments are also proposed to the Floodplain and Environmental
Areas Secondary Plan Maps to reflect the proposed new boundaries of the Secondary Plans.
The amendment to the Secondary Plans also includes removing the lands, municipally known as 809
Wellington Street, from the North Ward Secondary Plan and bringing these lands into the new Official
Plan. The amendment also proposes to redesignate the lands
for Business Park Employment uses.

SECTION 4 THE AMENDMENT
1. The City of Kitchener Official Plan is hereby amended as follows:
a) That Part 3, Section 13.1, Civic Centre Secondary Plan, is amended as follows:
i) removing the lands as shown in the area of amendment on the attached Schedule
- Map 9 Civic Centre Secondary Plan from the Civic Centre Secondary
Plan.
b) That Part 3, Section 13.3, Cedar Hill Secondary Plan, is amended as follows:
i) removing the lands as shown in the area of amendment on the attached Schedule
- Map 11 Cedar Hill Secondary Plan from the Cedar Hill Secondary Plan.
c) That Part 3, Section 13.4, Mill Courtland-Woodside Park Secondary Plan is amended as
follows:
i) removing the lands as shown in the area of amendment on the attached Schedule
- Map 12 Mill Courtland-Woodside Park Secondary Plan from the Mill
Courtland Woodside Park Secondary Plan.
ii) removing the lands as shown in the area of amendment on the attached Schedule
- Map13 Floodplain and Environmental Areas from the Mill Courtland
Woodside Park Secondary Plan.
d) That Part 3, Section 13.5, Victoria Park Secondary Plan, is amended as follows:
i) deleting Policy 13.5.4.6.
