HomeMy WebLinkAboutFCS-14-067 - Licence Agreement - Regional Electrical Conduits - 85 Queen St N REPORT TO:Committee of the Whole DATE OF MEETING: March 31, 2014 SUBMITTED BY: Lesley MacDonald, City Solicitor 519-741-2200 x7267 PREPARED BY: Lesley MacDonald, City Solicitor 519-741-2200 x7267 WARD(S) INVOLVED: 10 DATE OF REPORT: March 26th, 2014 REPORT NO.: FCS-14-067 SUBJECT: LICENSE AGREEMENT REQUEST – REGIONAL ELECTRICAL CONDUITS – 85 QUEEN STREET NORTH RECOMMENDATION: That the Mayor and Clerk be authorized to execute a License Agreement with The Regional Municipality of Waterloo to permit the construction, operation and maintenance of electrical conduit and appurtenances thereto through the City owned Civic District Parking Garage located at 85 Queen Street North so that the Region may provide electrical service between its adjacent properties; said agreement is to be to the satisfaction of the City Solicitor. BACKGROUND: The Region owns the lands located at 150 and 134 Frederick Street, 73 and 77 Queen Street North, and 20 Weber Street East, Kitchener (the “Region Lands”). The City owns the lands located at 85 Queen Street North, Kitchener upon which the Civic District Parking Garage is located (the “City Lands”).The Region would like to provide electrical service from the generator room located on part of the Region’s Lands to other adjacent buildings on Region Land. REPORT: The Region has asked the City for permission to access and use the City Lands by way of a License Agreement for the purposes of the construction, operation and maintenance of electrical conduit and appurtenances thereto through the Civic District Parking Garage to provide electrical service from the generator room located on part of the Region Land to their other adjacent buildings on Region Lands. City staff have reviewed their request and support the issuance of a non-exclusive license to the Region for use of parts of the Civic District Parking Garage for such purposes; said permission to be effective upon the approval of City Council and to expire on the earlier of the destruction and/or demolition of the Civic District Parking Garage and October 14, 2109. 4. - 1 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Efficient and Effective Government FINANCIAL IMPLICATIONS: N/A COMMUNITY ENGAGEMENT: N/A CONCLUSION: This request is in keeping with the collaboration between the City and the Region on this block.
