WARD(S) INVOLVED: Ward 3
DATE OF REPORT: April 9, 2014
REPORT NO.: FCS -14 -070
SUBJECT: LRT Project - Proposed Easement to Hydro One Networks
Inc. Prior to conveyance to Region
Part 9, Plan 58R -17989 — Former Vanier Dr. Road Allowance
RECOMMENDATION:
That the City grant an easement to Hydro One Networks Inc. ( "Hydro One ") on part of the
lands located in the former Vanier Drive road allowance, being Part 9, Plan 58R- 17989,
previously declared surplus, and approved by council to be conveyed to the Regional
Municipality of Waterloo ( "Region "), prior to these lands being conveyed to the Region;
and further,
That Mayor and Clerk be authorized to execute any documentation in this regard to the
satisfaction of the City Solicitor.
BACKGROUND:
Council approved two recommendations on October 21, 2013 pertaining to the lands being
granted to Hydro One for easement purposes and lands being conveyed to the Region for
purposes of the LRT project. Part of the lands, (specifically, Part 9, Plan 58R- 17989) that are
to be conveyed to the Region now require an easement in favour of Hydro One prior to the
conveyance to the Region.
REPORT:
On October 21, 2013, Council declared Parts 8, 9, 10 & 11, Plan 58R -17989 surplus (see
attached Schedule "A ") with the intention of granting an easement over parts 10 and 11 to
Hydro One and conveying Parts 8 and 9 to the Region. Hydro One desires to have an
easement over additional lands being Part 9 with the understanding that any easement will first
and foremost be subject to the use and needs of the rapid transit. The Region has confirmed
its agreement to allow the easement to Hydro One over Part 9 prior to the conveyance to the
Region.

FINANCIAL IMPLICATIONS:
There should not be any financial implications to the City as the additional lands will be included
in the same easement documentation as previously approved and all costs in this matter are to
be borne by the Region.
COMMUNITY ENGAGEMENT:
N /A.
CONCLUSION:
Staff recommends that Council authorize the granting of this easement to Hydro One resulting
from the construction of the LRT.
