HomeMy WebLinkAboutINS-14-051 - Parkiland Acquisition - 571 Huron Rd Staff Rport I r rc'.�►E t .R Infrastructure Services Department wmkitchener.ca REPORT TO: Finance & Corporate Services Committee DATE OF MEETING: April 28, 2014 SUBMITTED BY: Jim Witmer Director Operations, INS 519-741-2600 ext 4657 PREPARED BY: Tim O'Brien, Landscape Architect 519-741-2600 ext 4399 WARD(S) INVOLVED: Ward 5 DATE OF REPORT: March 14, 2014 REPORT NO.: INS-14-051 SUBJECT: PARKLAND ACQUISITION — 571 HURON ROAD RECOMMENDATION: That the Mayor and Clerk be authorized to execute an Agreement of Purchase and Sale, satisfactory to the City Solicitor, with Activa Holdings Inc., for the purpose of acquiring a portion of the residential building lot on Huron Road known as Part of Lot 4, RCP No. 1382 being Part 7 & 8, 58R-18138 and municipally known as 571 Huron Road, Kitchener, for the purpose of improving community access by creating a continuous trail corridor to link Huron Natural Area trail to Huron Road as identified by the City's Multi-Use Pathway Master Plan, to an upset purchase price of $10,000 plus HST, associated real estate fees, land transfer tax, and transaction costs, and further, That the Mayor and Clerk be authorized to execute the necessary documentation to complete the conveyance. BACKGROUND: The Multi-Use Pathway and Trails Master Plan (approved May 2010) identifies a continuous network of open space trails within the emerging communities of south west Kitchener. The acquisition of trail corridors identified by the Master Plan is to be achieved through new residential development approvals. The ongoing planning, corridor acquisition and construction of new trails guided by the Master Plan document, progressively brings to reality Council's vision of a high quality connected system of multi-use pathways that link neighbourhoods with places of recreation, shopping and employment. The proposed land acquisition would achieve a minor yet significant section of open space trail corridor that would extend the existing Huron Natural Area trail network 130 metres, to link with Huron Road at Strasburg Creek and Parkvale Drive, as identified by the Master Plan. Two residential lots are recently created at the former 571 Huron Road municipal address, as a result of a successful consent/zone change application (82013-034 & ZC13/02/H/ATP). The proposed residential development is subject to park land dedication, which will convey to the City a portion but not all of the land area necessary to achieve the trail corridor identified by the Master Plan at this location. An additional benefit of a trail at this location is to establish a maintenance access to an existing sanitary sewer maintenance hole recently constructed near this location and currently not accessible. 1 - 1 REPORT: The proposed acquisition of 148.9 square metres at 571 Huron Road, including the 38 square metre park land conveyance to be dedicated as a result of consent application B2013-034, together achieves an open space corridor required to construct a trail and complete the multi- use pathway section identified by the Master Plan. The purchase price is in accordance with the average generalized valuation R3/R4 residential property as prepared for the City in July 2010 by their consulting real estate agent. Staff recognizes the proposed land purchase as a one-time opportunity to acquire a trail corridor at this location in accordance with the approved Master Plan. Not proceeding with the purchase of the land required for a trail corridor would mean a gap in the trail network at this significant location and would leave the community to use municipal sidewalks as a by-pass route to access the Huron Natural Area trail system. Trail construction will be prioritized as part of the 10 Year Capital Forecast approvals process. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Achieving a continuous network of high quality open space multi-use pathways provides a variety of transportation, recreation, economic, environmental and community health benefits. The proposed trail corridor acquisition aligns with key themes and community priorities stated within the City's Strategic Plan, particularly the Quality of Life, Development and Environment themes. FINANCIAL IMPLICATIONS: Funding for the land purchase is from the Parkland Acquisition reserve account. These funds are sourced by way of park dedications contributed by new subdivision, consent and site plan development, where these are taken as cash in lieu of land in the cases where land dedications are not possible. Revenue: Balance on 3/31/2014 Reserve Parkland General Provision 6527006 $3,715,661.00 Expenses: Purchase of Land including HST $11,300.00 Legal fees (in-house and vendor, upset limit) $1,500.00 Less: HST rebate of purchase of Land ($1,124.00) Total Expenses: $11,676.00 Balance in account after acquisition $3,703,985.00 COMMUNITY ENGAGEMENT: A consultation and agency review process will form a part of the trail planning and design work in advance of trail construction.
