MINUTES OF THE REGULAR MEETING HELD APRIL 15, 2014
MEMBERS PRESENT:

Mr. A. Head, Vice-Chair, called this meeting to order at 11:15 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider an application regarding a variance to the City of Kitchener Sign By-law. The
Committee will not make a decision on this application but rather will make a recommendation which
will be forwarded to the Committee of the Whole and Council for final decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday, May 5, 2014 at 7:00 p.m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant is requesting permission to to legalize a pylon
sign for Canadian Tire Petroleum located within the driveway visibility triangle to have a
clearance from grade to the bottom of the sign of 2.1m (6.89’) whereas the By-Law requires
signs located within the driveway visibility triangle to have a clearance of 2.44m (8.01’).
The Committee considered the report of the Planning Division, dated April 3, 2014, advising
that the ground supported sign is located at the central interior entrance of the property at 1080
Victoria Street North.
The applicant is requesting a minor variance to legalize an existing ground supported sign
located in the driveway visibility triangle with a clearance of 2.1 metres (6.89 feet) from the
ground rather than the required 2.44 metres (8.005 feet).
In considering the requested variance to the Sign By-law, Planning staff offers the following
comments:
The applicant has recently replaced the original ground supported sign with a new modern
ground supported sign. The new ground supported sign was constructed in the same location
on property as the original sign. The ground supported sign has been built on the existing sign
base which was installed in 1979. The original sign permit was issued with a clearance of 3.4

metres (11 feet) and therefore was allowed within the driveway visibility triangle. However the
newly renovated sign located within the driveway visibility triangle with a clearance of 2.1
metres (6.89 feet) does not meet the required 2.44 metres (8.005 feet).
The intent of the driveway visibility triangle regulation in the Sign By-law is to allow for
pedestrian and vehicles views to be unobstructed by ground supported signs. However the
height reduction of 0.34 metres is minor and does not majorly affect pedestrian or vehicle
visibility. The ground supported sign complies with all other regulations of the Sign-By-law.
Transportation Services has no concerns with the sign.
The Committee considered the report of the Region of Waterloo Transportation Planner, dated
April 3, 2014, advising that they have no concerns with this application.
In response to questions, Mr. Cole advised that the style and design of the sign is standard for
all Canadian Tire gas stations across Canada. He indicated that the signs are purchased in
bulk to reduce the costs.

That the application of Canadian Tire Real Estate Limited requesting permission to legalize a
ground supported sign for Canadian Tire Petroleum located within the driveway visibility triangle to
have a clearance from grade to the bottom of the sign of 2.1m (6.89’) whereas the By-Law
requires signs located within the driveway visibility triangle to have a clearance of 2.44m (8.01’),
on Lots 2 and 3, Plan 971 and Lots 3 and 4, Plan 972, 1080 Victoria Street North, Kitchener,
BE APPROVED
Ontario,, subject to the following condition:
1. That the owner shall obtain a sign permit from the City’s Planning Division for the existing
ground supported sign.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of Chapter 680 (Signs) of the City of Kitchener Municipal
Code is being maintained on the subject property.
