HomeMy WebLinkAboutCSD-14-041 - Noise Exemption Request - Holy Trinity Serbian Church Staff Report I rTC'.�► t .R Community Services Department wmkitcheneaa REPORT TO: Community and Infrastructure Services Committee DATE OF MEETING: May 12, 2014 SUBMITTED BY: Michael May, Deputy CAO, Community Services (519-741-2200, ext. 7079) PREPARED BY: Shayne Turner, Director of By-law Enforcement, (519-741- 2753) WARD(S) INVOLVED: 6 DATE OF REPORT: April 25, 2014 REPORT NO.: CSD-14-041 SUBJECT: NOISE EXEMPTION REQUEST— HOLY TRINITY SERBIAN CHURCH - 700 FISCHER HALLMAN ROAD RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road, for two (2) festivals to be held on May 25, 2014, between the hours of 12 noon and 11 PM and July 26 and 27, 2014, from 12:00 p.m. to 11:00 p.m. BACKGROUND: The Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road typically holds 2 festivals each spring/summer season involving activities that occur outdoors. As in past years, they are requesting a noise exemption. REPORT: These festivals are annual events. Staff report that complaints have been received from the adjacent residential area in previous years. Staff have advised complainants that these are annual cultural and religious events and explain the noise exemption that is in place. When necessary, staff have attended during the event to speak with the organizers to reduce the noise where possible and ensure that the music is turned off at the prescribed time. Staff have had a conversation with representatives of the Church recently to discuss concerns that have been raised in the past. The representatives assured staff that they will distribute a communications piece in the adjacent residential neighbourhood to advise of the 2 events. It is their desire to engage the neighbourhood to participate in 1 - 1 the festivals. Attached is a copy of the information they intend to distribute throughout the neighbourhood this year. In addition, staff are attempting to contact those individuals who expressed concerns last year and requested to be advised in advance of this year's exemption request. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The aforementioned amendments support the Community Priority of Quality of Life, as contained in the City's Strategic Plan. FINANCIAL IMPLICATIONS: N/A COMMUNITY ENGAGEMENT: The event organizer will ensure that the adjacent neighbourhood is apprised of the events in advance of the event dates. The Church is planning its annual "Bull Roast" which will take place on May 25, 2014 and on July 26 & 27, 2014 we will be hosting our"Serbian Food Festival". Both are outdoor events which run from 12:OOpm to 11:OOpm. We have been in contact with the City of Kitchener and will make efforts mitigate the noise as much as possible. Both events include traditional Serbian music, dance and food. We will be selling food such as spit roasted.bull, pig and lambs as well as some desserts. There will also be refreshments and games for all ages. . We are thankful for your ongoing support of our Church and the events that we run.
