PLAN FOR CONSIDERATION OF ADOPTION BY COUNCIL
RECOMMENDATION:
That the "Staff Response to Comments Received on the Final Draft of Proposed
City of Kitchener Official Plan", attached as Appendix `B' to Report CSD-14-031,
be acknowledged as forming part of the public record for the adoption of the
City's new Official Plan; and
That City-initiated Official Plan Amendment OP14/04/COK/TMW, to remove those
lands proposed to be included within the boundary of the new Urban Growth
Centre in the City's new Official Plan, to remove one property from the North
Ward Secondary Plan, and which includes the final version of the City's new
Official Plan, be adopted, in the form shown in the proposed Official Plan
Amendment attached to Report CSD-14-031 as Appendix `A', and accordingly
forwarded to the Region of Waterloo for approval; and
That Council's adoption of the new Official Plan, attached as Schedule `H' to
Appendix `A' to Report CSD-14-031, meets the requirements of the Ontario
Planning Act including Sections 2 and 26, that is conforms to the Growth Plan for
the Greater Golden Horseshoe, has regard to matters of Provincial Interest, and is
consistent with the Provincial Policy Statement and conforms to all applicable
Provincial plans and the Regional Official Plan; and further

That Deferral No. 1, Deferral No. 3a and an unnumbered Deferral by City Council
dated August 27, 2001 on Map 5 - Land Use Plan of the City's current Official Plan
(1994) be recommended for removal and that this recommendation be forwarded
to the Region of Waterloo for approval.
BACKGROUND:
The purpose of this report is to inform Council of the public and agency comments that
were received, both oral and written, on the final draft of the City's new Official Plan
from the March 17th, 2014 Statutory Public meeting (Report CSD-13-011) and to seek
adoption of the new Official Plan.
Since that public meeting, Planning staff has evaluated all of the submissions and
provided a detailed written response. Planning staff held two days of meetings with
those commenters that wished further clarification of the staff response.
As a result of considering all of the comments on the final draft dated February 21,
2014, Planning staff has prepared a final version of the City of Kitchener Official Plan,
dated June 2014, for consideration for adoption by Council.
REPORT:
Highlights of New Official Plan
This Plan provides direction for Kitchener's growth and development during this and the
next decade and continues to pursue areas of policy that this community has embraced
for decades. It allows opportunity to reduce our environmental impact, further
strengthen our economy, provide park and recreational facilities, conserve our natural
heritage and cultural heritage resources, have regard for urban design, improve our
transportation options and celebrate our arts and culture.
In addition to supporting transit and intensification objectives, the direction in the new
Plan is to ensure Kitchener continues to develop as a complete and healthy community.
Some of the highlights of the new Official Plan include:
• A land use vision and goals that reflect our strategic documents and the
community's visioning;
• The desire to comprehensively manage our growth;
• An evolved city structure based on a hierarchy of nodes and corridors linked by
transit and the focus of intensification;
• Policies to support a healthy Kitchener with emphasis on an integrated
transportation system, walkability and locating mixed use areas, commercial,
institutional and employments lands in close proximity to where residents live;
• Increased emphasis on protecting lands for industrial employment and
institutional uses;

• A continued recognition of the importance of the City's Natural Heritage features,
Energy Conservation and Green Development, Cultural Heritage resources, a
high quality of Urban Design and Arts and Culture in our community.
Highlights of the Process
A significant amount of consultation has occurred to date in conjunction with the
development of the new Official Plan. In addition to the multiple years of engagement on
the Background Studies and Master Plans that provide some of the foundation for the
document (e.g., Parks Strategic Plan, Transportation Master Plan, etc.), there were
numerous opportunities for input into the Official Plan.
On March 8, 2010, a Statutory Public Meeting required by the Planning Act was held to
obtain preliminary ideas or suggestions to be considered in drafting the City's new
Official Plan. As a result of the input received at that meeting and following the
completion of the background reports and master plans, and meetings with the City's
Advisory Committees a first draft of the City's new Official Plan was tabled at the
Planning & Strategic Initiatives Committee (PSIC) meeting on June 20, 2011.
In response to 769 comments made by 30 public agencies, public bodies, consultants,
and property-owners, a second draft of the City's new Official Plan was prepared and
tabled at the Planning & Strategic Initiatives Committee meeting on May 27, 2013.
Two Council Strategy Sessions were held on August 12, 2013 and on August 26, 2013.
The first Council Strategy Session reviewed the Urban Structure policies, and
Institutional policies. The second Council Strategy Session reviewed the Employment
Area policies, the Special Policies, policies related to drive-throughs, Sustainable
Development policies (water/energy/air quality/ waste management) and the Natural
Heritage System policies, particularly the policies with respect to the Locally Significant
Features.
Two Open Houses were held on September 23, 2013 at the Kitchener Operations
Facility and on September 24, 2013 in the Rotunda at Kitchener City Hall. Twelve (12)
persons attended the first Open House and nine (9) persons attended the second Open
House.
On October 4, 2013 planning staff hosted an Industry Session for consultants and their
clients to provide more information and answer any questions on the second draft of the
new Official Plan. Thirteen (13) consultants/developers were in attendance.
After the commenting period on the second public draft ended on October 11, 2013,
Planning staff made available four (4) half days to hold meetings with those
consultants/developers who wished to discuss their submission further.
On November 26, 2013, an information session on the second draft of the new Official
Plan was held with the City's Joint Advisory Committee.

In response to 358 comments submitted from 48 public agencies, public bodies,
consultants, property-owners, and comments from internal staff, planning staff produced
a third and proposed final draft of the City's new Official Plan for consideration at a
Statutory Public Meeting on March 17, 2014.
A total of 132 comments have been received from 37 persons/agencies on the final
draft of the Official Plan, dated February 21, 2014. A copy of each of the comments
received on the final draft of the new Official Plan and corresponding responses are
included in Appendix 'B' to this report.
After sending out the Response Document, Planning Staff met with 7 planning
consultants/property owners to discuss the staff response that was provided in respect
of 14 different properties.
In total, since the first public draft of the new Official Plan was tabled in June of 2011,
Planning staff have made just over 400 revisions to the draft versions of the new Official
Plan.
On the basis of this final phase of consultation, staff is now recommending a final
Official Plan for Council's consideration.
Response to Comments
Planning staff appreciates the level of public and agency input that has assisted with the
preparation of the various drafts of the revised Official Plan.
As noted above, comments were received from 37 persons/agencies on the final draft of
the City's new Official Plan, dated February 21, 2014. A copy of each of the comments
received on the final draft of the new Official Plan and corresponding staff response are
included in Appendix 'B' attached to this report. The content of Appendix 'B' is
organized to correspond to organization of the final version of the new Official Plan,
starting with general comments that apply to the document overall.
At the conclusion of the commenting period on the second draft of the new Official Plan
in October 2013, Planning staff prepared 48 individualized response letters. The
majority of the comments received on the final draft of the new Official Plan, dated
February 21, 2014, were issues/comments that staff had already heard and responded
to on previous versions. While staff were able to make some revisions to the new
Official Plan as per the most recent requests and/or suggestions, we were not able to
make all of them. We can appreciate and understand the reasons for many of the
requests, however it may not have been possible to make the revisions due in part to
not meeting the vision and all of the goals in the Plan, competing objectives within the
Plan, new policy direction, or fit within the new urban structure, to name a few of the
reasons why. Individual requests that were received asking for more consideration of
land use and density permissions on their site in the new Official Plan are best
considered through the submission of a site-specific application or the zoning
implementation stage.

On April 25, 2014, Planning staff circulated the responses to comments received on the
February 21St, 2014 version to all those individuals that provided comments. Over two
days, Planning Staff met with the representatives of 14 property owners to discuss the
staff responses. At the conclusion of the meetings, Planning staff confirmed staff's
professional opinion/position with respect to the policy direction in the new Official Plan,
provided further clarification, where necessary, and were able to make some minor
revisions to the Plan to address some of the concerns.
Comments and Issues
Throughout the consultation process, Planning staff heard a number of different
comments and issues. Some were consistent between the first, second and final drafts
and some were specific to a particular draft. In general, the common comments and
issues related to the relationship of the evolved urban structure with the land use
designations (e.g. Mixed Use), drive-throughs, and the Ecological Restoration Area
Policies and mapping. Further, some comments suggested that certain policies were
too specific and thus may not be flexible, but at the same time raised concern that the
policies did not go far enough to provide certainty.
The policy direction in the new Plan is based on a need to balance competing goals and
objectives, provide specific direction and guidance to property owners while at the same
time providing some flexibility and direction for the implementing zoning. The intent is to
minimize future Official Plan Amendments where possible. For example, the land use
designation policies, particularly the `Mixed Use' and `Commercial' land use designation
policies, were written to given guidance to the zoning while meeting the planned
function of the urban structure component the lands are situate in. The land use polices
in the Official Plan will allow the implementing zoning to be applied area or site
specifically based on the property's location and context and may avoid the need for
future Official Plan Amendments in cases where properties may transition or redevelop
to meet the objectives of the Plan.
Ecological Restoration Areas
Ecological Restoration Areas and policies are new to the City's Official Plan. Ecological
Restoration Areas were identified through the Kitchener Natural Heritage System and
Technical Background Report as being an important component of the Natural Heritage
System. For this reason, they have been identified in the new Official Plan by `an
overlay' over the land use designation and policies have been proposed to ensure that
regard is had for these features as part of the development/redevelopment process.
Where site alteration and/or development/development are proposed, a proponent may
be required to submit an Environmental Impact Study to demonstrate no adverse
impacts to the feature and to the Natural Heritage System. The policies also allow the
City to scope or waive the requirement for an Environmental Impact Study depending
on the nature of the site alteration and/or development/ redevelopment proposal.
Site-specific requests
During the Official Plan Review process some requests were made by individual
property owners to consider changes in their land use designation. In general, the

Official Plan Review process and the new Official Plan was the not the appropriate
mechanism to deal with individual requests to change the land use designation on
specific properties or to request the application of other site-specific policies. Some
changes were made to the land use designation of individual properties to reflect the
new Urban Structure, the planned function of a particular area or adjacent lands, or their
identification as part of the Natural Heritage System. Where requests would significantly
change the existing land use permissions of a particular property and in the absence of
any approved master plan, Council direction or initiative, property owners were advised
to make site-specific applications.
Secondary Plans
The existing Secondary Plans, including the Rosenberg Secondary Plan, are proposed
to be deferred as part of this new Official Plan as they have been recently approved by
the Ontario Municipal Board or the secondary plans may be located within Major Transit
Station Areas proposed to be reviewed as part of the City's Station Area Planning
exercise (PARTS). Through this exercise, the City may determine that the existing
Secondary Plans affected by Station Area Plans may be amended to implement the
recommendations of the Station Area Plans, consolidated into one or more plans or
they may be determined to be no longer required.
Although the Secondary Plans are proposed to be deferred, some of the lands within
the Secondary Plans will be located within the boundary of the new Urban Growth
Centre (UGC). The UGC boundary contained in the new Official Plan was determined
by the Province in consultation with the City of Kitchener in 2008. As part of the Official
Plan Amendment to approve the City's New Official Plan, the amendment also proposes
to remove those lands proposed to be part of the new Urban Growth Centre from the
deferred Secondary Plans.
The amendment also includes an amendment to the North Ward Secondary Plan to
remove the property municipally known as 809 Wellington Street North, from the North
Ward Secondary Plan and designates these lands `Business Park Employment" on new
Map 3 — Land Use Plan.
Deferrals to Current Official Plan
There are currently three areas of deferral in the current Official Plan. The land use
designations for these areas were deferred at different points in time under previous
approvals for the current Official Plan. What this means is that these lands do not have
a land use designation in the current Official Plan. The new Official Plan will address the
deferrals by the assignment of land use designations.
The first deferral, Deferral No. 1, refers to lands in Doon South, Phase 2. The land use
designation of these lands was deferred as part of the Ontario Municipal Board approval
of Doon South, Phase 2 on April 9. 2009. The new Official Plan proposes to assign a
land use designation of Natural Heritage Conservation with an overlay of Ecological
Restoration Area to these lands. Accordingly, Deferral No. 1 can be removed.

The second deferral, Deferral No. 3a, applies to lands on the west side of Kitchener. A
portion of Deferral No. 3a was removed with the approval of the Rosenberg Secondary
Plan through Official Plan Amendment No. 90. The remainder of the lands affected by
Deferral No. 3a have been assigned land uses as shown on Map 3 — Land Use in the
proposed new Official Plan. Accordingly, Deferral No. 3a can be removed.
The final deferral refers to lands located on the southwesterly side of King Street East
near the Sportsworld Drive intersection. City Council deferred the land use designation
of these lands at the time a new Commercial structure and policies were approved as
part of Official Plan Amendment No. 36 on August 27, 2001. Since 2001, the lands have
had no land use designation in the current Official Plan. The new Official Plan proposes
to designate these lands `Commercial'. Accordingly, the Deferral of City Council, dated
August 27, 2001 can be removed.
Provincial and Regional Conformity
Overall the changes in the urban structure, land use designations and general policy
direction support provincial and regional plans, City master plans/initiatives and support
the vision for a complete and healthy Kitchener.
The new Official Plan has regard to and conforms with the Provincial Policy Statement
(including the new 2014 version), Places to Grow, other provincial policy, and the
Region of Waterloo Official Plan, 2009.
Adopting and Repealing By-law
Under the Planning Act, Council adopts the Official Plan by passing a by-law. The
adopting by-law also includes provisions so that upon final approval of all or part of the
Kitchener Official Plan by the Region of Waterloo or the Ontario Municipal Board, the
current Kitchener Official Plan will also be repealed and will no longer be in effect.
Post Adoption of the Kitchener Official Plan and Region of Waterloo Review
Once City Council adopts the Official Plan, it will be forwarded to the Region of
Waterloo for review and approval. The newly adopted City of Kitchener Official Plan will
be further reviewed by the Region to ensure that it addresses matters of Provincial and
Regional interest and to ensure conformity with the Regional Official Plan. Under the
Planning Act, the Region has 180 days to review the adopted Plan and issue a decision.
The Region of Waterloo as the approval authority, can approve, modify and approve or
refuse to approve all or parts of the adopted Official Plan.
The Region has advised that they intend to defer those sections/policies of the City's
plan related to the on-going Ontario Municipal Board appeals of the Regional Official
Plan as part of their decision on the City of Kitchener Official Plan. These
sections/policies include:
• Population and Employment Forecasts
• Residential Intensification Targets
• Designated Greenfield Area Targets

• Protected Countryside and Countryside Line
• Aggregate Policies
• Any site-specific appeals of the policies in the Regional Official Plan which lands
are located within the City of Kitchener.
At such time as the Ontario Municipal Board issues decisions on these matters, the
deferrals will be lifted and, if necessary, the policies may be modified to reflect these
decisions.
Once the Region of Waterloo issues its decision within the 180 day timeframe, a 20 day
appeal period is provided. Any person or party that has provided comments (in person,
or in writing) to City Council prior to the adoption of the Kitchener Official Plan, and/or
the Region of Waterloo prior to issuing its decision on the Kitchener Official Plan, has
the right to appeal all or part of the Kitchener Official Plan.
Transitional Matters — Processing Planning Applications During Interim Period
Once adopted by City Council, the Official Plan will be forwarded to the Region for
approval. During this interim period, the existing Official Plan remains in place and in
effect. However, while the policies in the adopted Official Plan are not fully binding, they
are considered a statement of Council policy and planning applications will be assessed
based upon the application's compliance with the current Official Plan as well as
adopted Official Plan to consider its policy implications.
In cases where an application does not comply with the current Official Plan and the
newly adopted Official Plan, an amendment to the current Official Plan and a
recommendation to amend the new Official Plan will be needed to ensure that if the
application is approved, it will be included in both Official Plans.
After the approval of the Official Plan, there may be instances where the current zoning
does not conform to the newly approved Official Plan. Planning staff recognize that the
Zoning By-law regulates what can occur on a particular property. Where development
proposals meet the current zoning they will be able to proceed under the current zoning.
However, there may be specific provisions of the new Official Plan, such as the
requirements for road or intersection widening that could impact a development
proposal.
Further, how particular development applications 'in process' are dealt with will depend
on the type of development application and the timing of the adoption/approval of the
Official Plan. This can be discussed with an applicant in more detail wherein the
specifics of the application and anticipated timing are known in relation to the status of
the new Official Plan.

ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The Official Plan Review aligns with the City of Kitchener Strategic Plan in many ways.
The new Official Plan will incorporate the Community Vision in Part B of the Plan. The
goals, objectives and policies also support and align with all of the 6 Community
Priorities in the Strategic Plan.
FINANCIAL IMPLICATIONS:
There are no new capital budget implications as part of this report. The new Official
Plan was prepared "in house" with minimal funds used from the Planning Studies
accounts.
COMMUNITY ENGAGEMENT:
Community engagement of the Official Plan is mandated and regulated by the Ontario
Planning Act. Planning staff are also utilizing the `inform' and `collaborate' themes from
the Community Engagement Strategy to further augment the public process for this
project.
Notice of the March 17th, 2014 Statutory Public Meeting, attached as Appendix `A', was
advertised in The Record on February 21, 2014 and in the Kitchener Citizen, the
Kitchener Post and given to all prescribed agencies and public bodies and to those on
the project circulation list.
Although the Committee meeting of June 9, 2014 is not a required Statutory Public
Meeting, notice of this meeting was advertised in the The Record on May 16, 2014 and
the Kitchener Post and given to all persons on the project circulation list. This report,
including the proposed Official Plan Amendment and new Official Plan, has been posted
on the City's website in advance of the June 9, 2014 meeting.
Social media has also been used to provide notification of the meeting and to direct
people to the Official Plan Review web page for further information.
CONCLUSION:
The proposed final draft of the City's new Official Plan incorporates much of the master
planning that has already taken place through a number of major initiatives. It is the
result of much public consultation and input. This Plan provides direction for Kitchener's
growth and development over the next two decades and supports the community's
vision through ensuring that the City of Kitchener is a complete and healthy community.

AMENDMENT NO. _TO THE OFFICIAL PLAN
OF THE CITY OF KITCHENER
SECTION 1 —TITLE AND COMPONENTS
This amendment shall be referred to as Amendment No. _to the Official Plan of the City
of Kitchener. This amendment is comprised of Sections 1 to 4 inclusive.
SECTION 2— PURPOSE OF THE AMENDMENT
The purpose of the amendment is to adopt a new Official Plan for the City of Kitchener,
save and except the Secondary Plans. The amendment also proposes to remove some
lands from some of the deferred Secondary Plans as these lands are proposed to be
included as part of the Urban Growth Centre in the new Official Plan.

The final version of the City's new Official Plan has regard and is in conformity with the
Provincial Policy Statement (2014), the provincial Places to Grow Act (2005) and
Growth Plan for the Greater Golden Horseshoe (2006), changes to the Planning Act
through Bill 51 (Royal Assent in 2006, in effect January 2007) and the new Regional

Official Plan (2009). It incorporates recommendations from a number of City master
plans and other major initiatives.
Secondary Plans
The existing Secondary Plans are proposed to be deferred and are not part of the new
Official Plan as the majority of the existing secondary plans are located within Major
Transit Station Areas. They will be reviewed as part of the City's Station Area Planning
exercise (PARTS). Through this exercise, the City may determine that the existing
Secondary Plans affected by Station Area Plans may be amended to implement the
recommendations of the Station Area Plans, consolidated into one or more plans or
they may be determined to be no longer required. The Rosenberg Secondary Plan was
recently approved by the Ontario Municipal Board as an amendment to the existing
Official Plan and is proposed to also be deferred at this time and will be added to the
new Official Plan once it is in effect.
Although the Secondary Plans are proposed to be deferred, some of the lands within
the Secondary Plans will be located within the boundary of the new Urban Growth
Centre (UGC). The UGC boundary contained in the new Official Plan was determined
by the Province in consultation with the City of Kitchener in 2008. As part of the Official
Plan Amendment to approve the City's New Official Plan, the amendment also proposes
to remove those lands proposed to be part of the new Urban Growth Centre from the
deferred Secondary Plans. Amendments are also proposed to the Floodplain and
Environmental Areas Secondary Plan Maps to reflect the proposed new boundaries of
the Secondary Plans.
The amendment to the Secondary Plans also includes removing the lands, municipally
known as 809 Wellington Street, from the North Ward Secondary Plan and bringing
these lands into the new Official Plan. The amendment also proposes to redesignate
the lands from `General Industrial' to `Business Park Employment' to recognize their
proximity to the provincial highway system and to other lands designated for Business
Park Employment uses.

SECTION 4—THE AMENDMENT
1. The City of Kitchener Official Plan is hereby amended as follows:
a) That Part 3, Section 13.1, Civic Centre Secondary Plan, is amended as
follows:
i) revising Policy 13.1.1.4 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F.
ii) removing the lands as shown in the area of amendment on the
attached Schedule `A' - Map 9 — Civic Centre Secondary Plan from
the Civic Centre Secondary Plan.
b) That Part 3, Section 13.2, King Street East Secondary Plan, is amended
as follows:
i) revising Policy 13.2.1.4 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F.
c) That Part 3, Section 13.3, Cedar Hill Secondary Plan, is amended as
follows:
i) revising Policy 13.3.1.4 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F.
ii) removing the lands as shown in the area of amendment on the
attached Schedule `B'- Map 11 — Cedar Hill Secondary Plan from
the Cedar Hill Secondary Plan.
d) That Part 3, Section 13.4, Mill Courtland-Woodside Park Secondary Plan
is amended as follows:
i) revising Policy 13.4.1.3 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F.
ii) removing the lands as shown in the area of amendment on the
attached Schedule `C' - Map 12 — Mill Courtland-Woodside Park
Secondary Plan from the Mill Courtland Woodside Park Secondary
Plan.
iii) removing the lands as shown in the area of amendment on the
attached Schedule `D' - Map13 — Floodplain and Environmental
Areas from the Mill Courtland Woodside Park Secondary Plan.
e) That Part 3, Section 13.5, Victoria Park Secondary Plan, is amended as
follows:
i) revising Policy 13.5.1.3 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F.
ii) deleting Policy 13.5.4.6.
iii) removing the lands as shown in the area of amendment on the
attached Schedule `E' - Map 14 — Victoria Park Secondary Plan
from the Victoria Park Secondary Plan.

iv) removing the lands as shown in the area of amendment on the
attached Schedule `F' - Map 15 — Floodplain and Environmental
Areas from the Victoria Park Secondary Plan.
f) That Part 3, Section 13.6, Victoria Street Secondary Plan, is amended as
follows:
i) revising Policy 13.6.1.4 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F".
g) That Part 3, Section 13.7, K-W Hospital Secondary Plan, is amended as
follows:
i) revising Policy 13.7.1.3 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F".
h) That Part 3, Section 13.8, North Ward Secondary Plan is amended as
follows:
i) revising Policy 13.8.1.4 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F".
ii) removing the lands shown in the area of amendment on the
attached Schedule `G' - Map 19 - North Ward Secondary Pan from
the North Ward Secondary Plan.
i) That Part 3, Section 13.9, Central Frederick Secondary Plan is amended
as follows:
i) revising Policy 13.9.1.3 by deleting "Parts 1, 2, 4 and 5" and
replacing it with "Parts A, B, C, E and F".
j) That Schedule `H' form the new Official Plan for the City of Kitchener.
k) That Part 1 - Introduction, Part 2 — General Policies, Part 4 — Managing
the Plan and Part 5 — Schedules, comprising of the City of Kitchener
Official Plan, be repealed (deleted) at such time as the new Official Plan
for the City of Kitchener as contained in Schedule `H' is approved by the
Regional Municipality of Waterloo and in effect.
1) That Part 3 — General Land Use Plan, save and except Part 3, Section 13
— Secondary Plans, of the City of Kitchener Official Plan be repealed
(deleted) at such time as the new Official Plan for the City of Kitchener as
contained in Schedule `H' is approved by the Regional Municipality of
Waterloo and in effect.
