CSD-14-056 - HERITAGE PERMIT APPLICATION HPA 2014-IV-010 - 41-45 KING STREET WEST - REPLACEMENT OF EXISTING WOOD WINDOWS The Committee considered Community Services Department report CSD-14-056, dated May 7, 2014 recommending approval of Heritage Permit Application HPA 2014-IV-010 to permit the replacement of the existing wood windows. On motion by Councillor F. Etherington - it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-IV-010 be approved to permit the replacement of existing wood windows with new wood windows, at the property municipally addressed as 41-45 King Street West in accordance with the supporting information submitted with the application." 2. CSD-14-057 - HERITAGE PERMIT APPLICATION HPA 2014-IV-014 - 35 GORDON AVENUE - REPLACEMENT OF EXTERIOR STEPS TO ENCLOSED PORCH The Committee considered Community Services Department report CSD-14-057, dated May 13, 2014 recommending approval of Heritage Permit Application HPA 2014-IV-014 to permit the removal and installation of exterior steps to an enclosed porch at the property municipally addressed as 35 Gordon Avenue. On motion by Councillor F. Etherington - it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-IV-014 be approved to permit the removal and installation of exterior steps to an enclosed porch at the property municipally addressed as 35 Gordon Avenue, in accordance with the supporting information submitted with the application and subject to the following conditions: i) That the final building permit drawings be reviewed and heritage clearance provided by heritage planning staff prior to the issuance of a building permit." 3. CSD-14-058 - HERITAGE PERMIT APPLICATION HPA 2014-IV-013 - 39 DOON VALLEY DRIVE - REPLACEMENT OF EXISTING CEDAR SHINGLE ROOF The Committee considered Community Services Department report CSD-14-058, dated May 7, 2014 recommending the approval of Heritage Permit Application HPA 2014-IV-013 to permit replacement of the existing cedar shingle roof with cedar or asphalt shingles at the property municipally addressed as 39 Doon Valley Drive. On motion by Councillor F. Etherington - it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-IV-013 be approved to permit the installation of cedar or asphalt shingles at the property municipally addressed as 39 Doon Valley Drive in accordance with the supporting information submitted with the application." CSD-14-055 - HERITAGE PERMIT APPLICATION HPA 2014-V-006 - 1122 DOON VILLAGE ROAD - DEMOLITION OF EXISTING SINGLE DETACHED DWELLING AND ACCESSORY STRUCTURES AND PROPOSED CONSTRUCTION OF A NEW SINGLE DETACHED DWELLING The Committee considered Community Services Department report CSD-14-055, dated May 7, 2014 recommending the approval of Heritage Permit Application HPA 2014-V-006 to permit the demolition of the existing single detached dwelling and accessory structures, and the construction of a new single detached dwelling on the property municipally addressed as 1122 Doon Village Road. Mr. L. Bensason presented the Report advising that the house at 1122 Doon Village Road is designated under Part V of the Ontario Heritage Act and is not identified as a Group A property within the Upper Doon Heritage Conservation District Plan and is therefore considered to a be a non-historic property. He stated that the dwelling the applicant proposes to construct is generally in line with the existing setbacks and reviewed the merits of the application as detailed in the Report. In response to questions from the Committee, Mr. Bensason indicated that the proposed height of the dwelling, 30 feet, is consistent with a number of new homes approved for construction in the area. He elaborated that the proposed dwelling will have a larger setback from the road than the adjacent properties. With regard to tree preservation, Mr. Bensason stated that there are a number of trees along the existing driveway that will remain unaffected by the proposed development. On motion by Ms. E. Rudland - it was resolved: "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-V-006 be approved to permit the demolition of an existing single detached dwelling and accessory structures, and the construction of a new single detached dwelling on the property municipally addressed as 1122 Doon Village Road, in accordance with the supporting information submitted with the application and subject to the following condition: i) That the final building permit drawings be reviewed and heritage clearance provided by heritage planning staff prior to the issuance of a building permit." 5. CSD-14-062 - HERITAGE PERMIT APPLICATION HPA 2014-V-009 - 51-53 DAVID STREET - PROPOSED DEMOLITIONS The Committee considered Community Services Department report CSD-14-062, dated May 14, 2014 recommending the approval of Heritage Permit Application HPA 2014-V-009 to permit the demolition of all structures at the property municipally addressed as 51-53 David Street. Mr. L. Bensason presented the Report advising that the applicant is proposing to demolish the 1.5 storey residential building at 51 David Street and the 2 storey dwelling at 53 David Street that were originally constructed in 1890, as well as the garage and shed (c. 1999) in order to comply with a property standards order that directed the owner to repair the buildings. He indicated that as a formal application to redevelop the property has not been submitted, the demolition will result in a vacant lot, and noted that future redevelopment will require the submission of a Heritage Permit Application and Heritage Impact Assessment (HIA). He stated that the requirement for an HIA in support of the proposed demolition was waived due to the recent history of the subject property and a description of the conditions and cost estimate to repair/replace versus demolish the building was required. He stated that Heritage, Building, and By-law staff have conducted a visual assessment of the buildings resulting in the estimation that the proposed repairs and replacements required to conserve the existing buildings could range from $100,000. to $300,000. more than the costs to demolish and construct new buildings. Mr. Bensason then reviewed the merits of the application contained HERITAGE KITCHENER MINUTES JUNE 3.2014 -16- CITY OF KITCHENER 5. CSD-14-062 - HERITAGE PERMIT APPLICATION HPA 2014-V-009 - 51-53 DAVID STREET - PROPOSED DEMOLITIONS (CONT'D) within the Report resulting in the recommendation of approval of the subject application for demolition of 51-53 David Street. Concern was expressed from the Committee regarding the condition of the site once the buildings have been demolished. Mr. Bensason indicated that there is a requirement with a timeline for applying seed and sod to the property if not redeveloped. He reiterated that any proposal for redevelopment will require a Heritage Permit Application and may require an HIA if site plan approval is required. Councillor F. Etherington pointed out that under the property standards order the City could demolish the structures if the owner does not. On motion by Councillor F. Etherington - it was resolved: "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-V-009 be approved to permit the demolition of all buildings at the property municipally addressed as 51-53 David Street." 6. CSD-14-036 - LISTING OF DEFERRED NON-DESIGNATED PROPERTIES OF CULTURAL HERITAGE VALUE OR INTEREST ON THE MUNICIPAL HERITAGE REGISTER -85 QUEEN STREET NORTH AND 61 MADISON AVENUE The Committee considered the listing of 85 Queen Street North and 61 Madison Avenue on the Municipal Heritage Register that were deferred at the May 26, 2014 Council meeting. Mr. L. Bensason addressed the Committee regarding 85 Queen Street North stating that consideration of listing this property on Municipal Heritage Register was deferred to allow additional time for the Library Board to receive the information and consider the implications of listing. He indicated that no concerns have been received and recommended proceeding with listing 85 Queen Street North on the Municipal Heritage Register. Mr. Bensason then addressed the Committee regarding listing 61 Madison Avenue on the Municipal Heritage Register and stated that members were in receipt of the Statement of Significance for the subject property and noted that staff has met with the property owner and the Ward Councillor. He indicated that Mr. Neumann was in attendance to address the Committee in opposition to listing 61 Madison Avenue on the Municipal Heritage Register. Mr. Neumann addressed the Committee in opposition to listing of his property located at 61 Madison Avenue expressing concerns that the property will become isolated as adjacent properties are developed. He indicated that there are many properties located on Church Street which exemplify similar characteristics and yet they have not been listed on the Municipal Heritage Register. He further expressed concern that the value of his property is affected by the listing and indicated he would like the Committee to consider not listing 61 Madison Avenue. Councillor F. Etherington stated that he had met with Mr. Neumann regarding his concerns and inquired if the properties on Church Street that Mr. Neumann referred to are listed on the Municipal Heritage Register. Mr. Bensason indicated that Heritage Planning Staff have identified at least one property as being of cultural heritage value or interest. Mr. Bensason then agreed to confirm with Mr. Neumann which properties on Church Street have been listed. On motion by Ms. E. Rudland - it was resolved: "That pursuant to Section 27 of the Ontario Heritage Act the property municipally addressed as 61 Madison Avenue South be listed on the Municipal Heritage Register as a non-designated property of cultural heritage value or interest, in accordance with the respective Statement of Significance attached as Appendix 'A' to Community Services Department report CSD-14-036." CSD-14-036 - LISTING OF DEFERRED NON-DESIGNATED PROPERTIES OF CULTURAL HERITAGE VALUE OR INTEREST ON THE MUNICIPAL HERITAGE REGISTER -85 QUEEN STREET NORTH AND 61 MADISON AVENUE (CONT'D) On motion by Ms. B. Glenn-Graham- it was resolved: "That pursuant to Section 27 of the Ontario Heritage Act the property municipally addressed as 85 Queen Street North be listed on the Municipal Heritage Register as a non-designated property of cultural heritage value or interest, in accordance with the respective Statement of Significance attached as Appendix 'A' to Community Services Department report CSD-14-036." 7. CSD-14-063 - HERITAGE PERMIT APPLICATION HPA 2014-V-012 AND HPA 2014-V-015 - 64-66 WEBER STREET WEST AND 96 YOUNG STREET - ALTERATIONS TO FRONT PORCH The Committee considered Community Services Department report CSD-14-063, dated May 20, 2014 recommending the refusal of Heritage Permit Applications HPA 2014-V-012 and HPA 2014-V-015 to permit alterations to the front porches at the properties municipally addressed as 64-66 Weber Street West and 96 Young Street. Mr. L. Bensason presented the Report advising that there are two separate Heritage Permit Applications which are similar in nature for both properties. He reviewed the recommendations for HPA 2014-V-012 for 64-66 Weber Street West and HPA 2014-V-015 for 96 Young Street, advising that the proposals relate to the installation aluminum and glass front porches and a second railing behind wood pickets for cosmetic purposes. He stated that both properties are located in the Civic Centre Heritage Conservation District (CCHCD) and are identified as Group B examples of the Italianate architectural style. He reviewed the background of the application as detailed in Report CSD-14-063 and advised that the owner of the properties has not complied with the applicable regulations to obtain a building permit or conservation guidelines which require approval of a Heritage Permit Application. He summarized that refusal of the Heritage Permit Applications is recommended as the alterations to the front porches will negatively impact the significance of the properties and the integrity of the CCHCD. Mr. Stephen Litt addressed the Committee in support of the applications, stating that building permits were obtained for the interior of the 64-66 Weber Street and 96 Young Street which have since been renovated and comply with fire safety regulations. He stated that as the original drawings showed the aluminum and glass railings, it was an oversight not to obtain Heritage Permit approvals and requested that the Committee consider approval of the applications so that the railings can be installed to ensure life-safety measures at the residences. In response to questions from the Committee, Mr. Litt advised that he was not aware that the subject properties were located in the Heritage Conservation District until the building permit application process. He indicated that once he became aware of the HPA requirements he conducted research which demonstrated that 30" glass, as proposed within the application, is not compliant in Kitchener but is of common use in other large municipalities. Mr. Bensason responded to further questions from the Committee advising it is the intention of Heritage Planning staff to continue working with the applicant, with the hope that the applicant will remove the glass and aluminum railings, and resubmit an application that complies with the guidelines established in the CCHCD. On motion by Ms. B. CSD-14-054 - HERITAGE PERMIT APPLICATION HPA 2014-V-008 - 4 THERESA STREET - PROPOSED ALTERATIONS AND ADDITIONS The Committee considered Community Services Department report CSD-14-054, dated May 15, 2014 recommending the refusal of Heritage Permit Application HPA 2014-V-008 to permit alterations and additions to the property municipally addressed as 4 Theresa Street. In addition, the Committee was in receipt this date of correspondence from Mr. S. Litt entitled `Design Review in Accordance with VPHCD presented by applicant and architect'. Mr. S. Burrows declared pecuniary interest as he works with the proponent of the subject application. In addition, Councillor F. Etherington declared pecuniary interest as he owns property in proximity to the subject lands. Accordingly, neither Mr. Burrows nor Councillor Etherington took part in any discussion or voting of this matter. Mr. L. Bensason presented the Report advising that 4 Theresa Street is located within the Victoria Park Heritage Conservation District (VPHCD), which is designated under Part V of the Ontario Heritage Act. He advised that the VPHCD provides policies and guidelines for alterations and additions to properties within the District, and specifically requires heritage permits for major work which must follow the building conservation policies. He noted that the subject property is located in E-1 zone in the floodway portion of the floodplain which only permits existing uses and does not permit a new dwelling without approvals. He reviewed the proposed major alterations and additions to the existing single detached dwelling and stated that staff suggests that the proposal is not in compliance with the VPHCD conservation guidelines, Parks Canada Standards or Ministry of Tourism Culture and Sports' Eight Guiding Principles in the Conservation of Built Heritage Properties. He noted that additional approvals would be required for the proposal as the Heritage Permit Application does not represent a waiver of other approvals, notably a zone change approval as this proposal would be deficient front yard setback, side yard setbacks, maximum additional building floor area, off-street parking setback and possibly the minimum parking requirements. He then reviewed the merits of the application, as detailed in Report CSD-14-054, recommending refusal of Heritage Permit Application HPA 2014-V-008. Mr. Stephen Litt addressed the Committee advising that the design iteration has been completed over a 16 month period with the collaboration of Architects Laird Robertson and Gabriel Guy, who were in attendance regarding the proposal. He indicated that in his option the property is on the fringe of the District and is an asset that does not have significant historic value. He stated that present day forms history and that the proposal is a reflection of the current building movement in Kitchener. He elaborated that the existing building would be reused and would not be a demolished within the context of his proposal. He referred to the circulated documents stating that the proposed structure uses green technology which is consistent with current building practices and requested that the Committee consider approving the Heritage Permit Application for 4 Theresa Street. Mr. Laird Robertson addressed the Committee in support of the application stating he is a previous member of Heritage Kitchener. He agreed that the proposal is not a minor renovation and indicated that the proposal is not about compliance but is about the right of a homeowner to live in the type of residence they select. He indicated that 4 Theresa Street is not a key historic residence in the VPHCD and sits on the fringe of the District. CSD-14-054 - HERITAGE PERMIT APPLICATION HPA 2014-V-008 - 4 THERESA STREET - PROPOSED ALTERATIONS AND ADDITIONS (CONT'D) existing dwelling is representative of the latter part of the architectural period and is adjacent to poorly renovated historic homes. He stated that the proposal represents restructuring of a historic home on the existing frame with contemporary vision and will illustrate the home in a contemporary way within the VPHCD without destroying the attributes of the District. Ms. B. Glenn-Graham commented on the submissions by Messrs. Litt and Robertson stating that although she has an appreciation for modern architecture and environmental building practices, the role of the Committee is to protect the attributes of the Heritage Conservation District. She referred to the circulated correspondence noting that although the delegations stated that the property is located on the fringe of the VPHCD, the proposal is set on the visual of Victoria Park. She elaborated that as the proposal will not support the congruence within the park setting, she cannot support the application. On motion by- it was resolved: "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-V-008, to permit alterations and additions to the property municipally addressed as 4 Theresa Street in accordance with the supporting information submitted with the application, be refused." 9. CSD-14-048 - LISTING OF NON-DESIGNATED PROPERTIES OF CULTURAL HERITAGE VALUE OR INTEREST ON THE MUNICIPAL HERITAGE REGISTER - DEFERRED FROM THE JANUARY 27, 2014 COUNCIL MEETING The Committee considered Community Services Department report CSD-14-048, dated May 5, 2014 recommending listing various properties on the Municipal Heritage Register. Mr. L. Bensason presented the Report advising that at the meeting of December 3, 2013, Heritage Kitchener recommended deferral of 69 Agnes Street; 31 Cedar Street North; 33 Cedar Street North; 35 Cedar Street North; 37 Cedar Street North; 39 Cedar Street North; 41 Cedar Street North; 43 Cedar Street North; 187 Duke Street East. and,189 Duke Street East. He elaborated that at the meeting of January 27, 2014 Council considered the Heritage Kitchener recommendations and the owners of 283 Duke Street West and 914 King Street West requested deferral to provide additional time to consider the implication of listing the properties. Council resolved all deferrals were to be considered by Heritage Kitchener on or before June 3, 2014. Mr. Bill Reitzel addressed the Committee regarding 31 Cedar Street North stating that as a lifelong resident of Kitchener he is in opposition to listing of the properties as the ramifications under the Planning Act and Ontario Heritage Act are far reaching and comprehensive. He stated that Council has voted against listing city-owned properties due to concern of deterring property investment, such as Centre Block and 48 Ontario Street. He requested that Heritage Kitchener refuse the recommendation and indicated he does not want a deferral of this matter. In response to questions, Mr. Bensason stated that with regard to the city-owned properties mentioned by Mr. Reitzel, 48 Ontario Street North has been listed on the Municipal Heritage Register. Mr. Reitzel responded to questions from the Committee advising that Ms. Drake did explain the process and implications of being listed on the Municipal Heritage Register and the difference between listing and designation of the property. He confirmed that he has attended the Open House and has had several meetings with Heritage Planning Staff. Ms. Elizabeth Gallaher addressed the Committee regarding 31-43 Cedar St and 187-189 Duke Street advising that as a past member of Heritage Kitchener and a current member of the Architectural Conservancy of Ontario, the historic value of the properties is identifiable and HERITAGE KITCHENER MINUTES JUNE 3.2014 -20 - CITY OF KITCHENER 9. CSD-14-048 - LISTING OF NON-DESIGNATED PROPERTIES OF CULTURAL HERITAGE VALUE OR INTEREST ON THE MUNICIPAL HERITAGE REGISTER - DEFERRED FROM THE JANUARY 27, 2014 COUNCIL MEETING (CONT'D) requires additional research. She explained the known historic value stating that the houses are one of four row house developments originally for workers in Kitchener. She requested a deferral of the recommendation in order to promote dialogue regarding the historic value of the property to ensure the owners know that listing would not devalue the property. Mr. Aurel Pauser and Mr. George addressed the Committee regarding 283 Duke Street West in opposition to listing the property on the Municipal Heritage Register. Mr. Pauser advised that it is the intent of the owner to redevelop the property in the future, specifically because there is currently no parking on site and requested that the Committee refuse to list the property so that renovations and improvements are not impeded. Mr. Rob Piombini appeared in opposition to listing 914 King Street West on the Municipal Heritage Register. He stated that he purchased the property in October 2013 and was not aware of the potential for listing. He commented that as a realtor in the area, stigmatization such as listing, impedes development. He stated that as King Street will be a major area of redevelopment, any type of designation will deter development and property value will suffer. He requested a deferral of listing 914 King Street West until such time as the Light Rail Transit has been completed and property values have been established. At the suggestion of the Chair, the properties were voted on separately. On motion by Councillor F. Etherington - it was resolved: "That pursuant to Section 27 of the Ontario Heritage Act, the following properties be listed on the Municipal Heritage Register each as a non-designated property of cultural heritage value or interest, in accordance with the respective Statement of Significance attached as Appendix 'A'to Community Services Department report CSD-14-048: • 69 Agnes Street." On motion by Ms. E. Rudland - it was resolved: "That pursuant to Section 27 of the Ontario Heritage Act, the following properties be listed on the Municipal Heritage Register each as a non-designated property of cultural heritage value or interest, in accordance with the respective Statement of Significance attached as Appendix 'A'to Community Services Department report CSD-14-048: • 31 Cedar Street North; • 33 Cedar Street North; • 35 Cedar Street North; • 37 Cedar Street North; • 39 Cedar Street North; • 41 Cedar Street North; • 43 Cedar Street North; • 187 Duke Street East; and, • 189 Duke Street East." On motion by Mr. S. Burrows- it was resolved: "That pursuant to Section 27 of the Ontario Heritage Act, the following property be listed on the Municipal Heritage Register each as a non-designated property of cultural heritage value or interest, in accordance with the respective Statement of Significance attached as Appendix 'A'to Community Services Department report CSD-14-048: • 914 King Street West." 10. CSD-14-060 - LISTING OF NEW NON-DESIGNATED PROPERTIES OF CULTURAL HERITAGE VALUE OR INTEREST ON THE MUNICIPAL HERITAGE REGISTER The Committee considered Community Services Department report CSD-14-060, dated May 20, 2014 recommending listing various properties on the Municipal Heritage Register. Mr. L. Bensason presented the Report. Mr. Bill Reitzel, was in attendance in opposition to listing 23-27 Cedar Street North on the Municipal Heritage Register. He expressed concerns regarding the impact of listing on the property value and requested that the Committee consider not listing the properties. Ms. Barbara Bitzer, owner of 83 Benton Street addressed the Committee in support of listing the property on the Municipal Heritage Register stating that the home has been in her family for over 100 years. Ms. Elizabeth Gallaher addressed the Committee in support of listing all the properties, particularly 148 Margaret Avenue, stating that the property exemplifies attributes of Tudor architecture. She elaborated that there is a historic connection to Krause and ethnic Germans who were integral to the construction industry in Kitchener which would be acknowledged by listing the properties on the Municipal Heritage Register. Mr. Inn Oh appeared in opposition to listing 32 Duke Street East / 58-60 Frederick Street building is less than 50 years old with decorative aluminum cladding which does not have historical value. He indicated that his family owns the property and has concerns related to the impact on potential redevelopment. He noted that the building is sited in the centre of the property with little to no parking available. He requested that the Committee refuse the recommendation to list 32 Duke Street East/58-60 Frederick Street on the Municipal Heritage Register as a non-designated property of cultural value. CULTURAL HERITAGE LANDSCAPE STUDY-UPDATE The Committee considered a verbal update on the Cultural Heritage Landscape Study provided by Mr. L. Bensason. In addition, the Committee was in receipt this date of correspondence from Mr. L. Bensason dated June 3, 2014 regarding the City of Kitchener Cultural Heritage Landscape Study — Update, enclosing a copy of the Notice advertising an upcoming public meeting as well as meeting minutes from the April 8, 2014 Project Start-up meeting and May 7th Study Team meeting. Mr. Bensason stated that there is a public meeting being held on June 11, 2014 from 7:00 p.m. to 9:00 p.m. in the Conestoga Room, City Hall. He indicated that an opportunity will be available at the public meeting for those in attendance to provide feedback and encouraged Committee members to attend.
