APPOINTMENT OF ACTING CHAIR Mayor C. Zehr advised that neither the Committee's Chair nor Vice-Chair were able to chair this meeting; and accordingly, the Committee would need to appoint an Acting Chair. On motion by Councillor D. Glenn-Graham- it was resolved: "That pursuant to Kitchener Municipal Code Chapter 25 (Procedure) Section 25.10.8 b), Councillor K. Galloway-Sealock, be appointed Acting Chair for the June 9, 2014 Community and Infrastructure Services Committee meeting." 2. CSD-14-050 - LIMITING DISTANCE AGREEMENT-1440 KING STREET EAST The Committee considered Community Services Department report CSD-14-050, dated May 21, recommending approval of a limiting distance agreement with the owner of 1440 King Street East to permit the construction of new exterior windows. On motion by Councillor D. Glenn-Graham- it was resolved: "That the Mayor and Clerk be authorized to execute an agreement with the registered owner(s) of Plan 657 Lot 68, Part Lots 56— 57, Plan 5884491 Part 4, known as 1440 King Street East, pursuant to Section 3.2.3.1.(11) of the Ontario Building Code, said agreement to permit the construction of new exterior windows with the limiting distance for the exposing building face being measured to a point beyond the property line on the adjacent City open park space, Plan 657 Lot 59, Part Lot 58, Plan 5881889 Parts 1- 4, Part Lot 16 Subdivision of Lot 1 German Company Tract, Plan 5885751 Part 3, known as Edmund Green, as outlined in Community Services Department report CSD- 14-050." 3. CSD-14-067 - NOISE EXEMPTION -CONSTRUCTION WORK AT MCLENNAN PARK The Committee considered Community Services Department report CSD-14-067, dated May 22, 2014 recommending approval of a noise exemption request for Facilities Management staff to undertake repairs to the washroom facilities at McLennan Park. It was noted that any recommendation arising from the Committee regarding this matter would be considered at the special Council meeting being held later this same date. On motion by Councillor D. Glenn-Graham- it was resolved: COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 9.2014 -34- CITY OF KITCHENER 3. CSD-14-067 - NOISE EXEMPTION - CONSTRUCTION WORK AT MCLENNAN PARK (CONT'D) "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Facilities Management Division, for necessary repairs to the washroom facilities at McLennan Park on various evenings between June 10, 2014 and July 9, 2014, as outlined in Community Services Department report CSD-14-067." 4. INS-14-058 - NOISE EXEMPTION -WESTMOUNT ROAD PAVING OPERATIONS The Committee considered Infrastructure Services Department report INS-14-058, dated May 21, 2014 recommending approval of a noise exemption request to the Region of Waterloo for the road construction work on Westmount Road. On motion by Councillor D. Glenn-Graham- it was resolved: "That the Region of Waterloo and its contactor(s) be exempt from the provisions of the City of Kitchener Municipal Code Chapter 450 (Noise) Article 6 Construction Work, between the hours of 7:00 p.m. to 7:00 a.m. for the period from Friday, June 20, 2014 to Sunday, June 22, 2014, for the paving of surface asphalt of Westmount Road from Greenbrook Drive to Queens Boulevard, as outlined in Infrastructure Services Department report INS-14-058." 5. CAO-14-022 - PUBLIC ART CONSERVATION PLANNING The Committee considered Chief Administrator's Office report CAO-14-022, dated May 26, 2014 regarding the restoration and ongoing maintenance of the City's public art and industrial artifacts collections. In response to questions, Ms. S. DiDonato agreed to provide additional information outlining the amount of restoration work that has been previously undertaken by the City as well as a copy of the report prepared by George Prytulak, Conservator, Public Art and Industrial Collections. On motion by Councillor D. Glenn-Graham- it was resolved: "That the Public Art and Industrial Artifact Conservation Planning for restoration and ongoing maintenance be approved, as outlined in Chief Administrator's Office report CAO-14-022." Mayor C. Zehr left the meeting at this time. 6. INS-14-057 - SCHOOL PEDESTRIAN SAFETY-J.W. GERTH PUBLIC SCHOOL Councillor P. Singh entered the meeting at this time. The Committee considered Infrastructure Services Department report INS-14-057, dated May 15, 2014 recommending the temporary installation of an Adult Crossing Guard Facility at J.W. Gerth Public School. On motion by Councillor D. Glenn-Graham- it was resolved: "That the Adult Crossing Guard Facility be installed, on a temporary basis for a period from September 1, 2014 to June 30, 2016 on Apple Ridge Drive at Pine Valley Drive, as outlined in Infrastructure Services Department report INS-14-057." COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 9.2014 -35- CITY OF KITCHENER 7. CSD-14-065 - SAFE AND HEALTHY COMMUNITY ADVISORY COMMITTEE - TERMS OF REFERENCE The Committee considered Community Services Department report CSD-14-065, dated April 22, 2014 recommending revisions to the Terms of Reference for the Safe and Healthy Community Advisory Committee. At the request of Councillor Y. Fernandes, the Committee agreed to amend Section 2.a)iv. of the draft Terms of Reference to increase the representation on the Committee from residents living in other suburban wards from one to two. On motion by Councillor D. Glenn-Graham- it was resolved: "That the Safe and Healthy Community Advisory Committee continue as an advisory committee of Council; and further, That existing Council Policy 1-125 (Safe and Healthy Community Advisory Committee - Terms of Reference), be repealed and replaced with the revised Terms of Reference attached to Community Services Department report CSD-14-065, save and except for Section 2.a)iv. whereby the representation from other suburban wards has been increased to two residents." Councillor B.Vrbanovic entered the meeting at this time. 8. CSD-14-053 - FOREST HEIGHTS COLLEGIATE / POOL / LIBRARY PARKING LOT RENOVATION The Committee considered Community Services Department report CSD-14-053, dated April 22, 2014 recommending the allocation of an additional $67,400. to fund the City's portion of the parking lot renovations at Forest Heights Collegiate. Mr. M. Hildebrand reviewed the re po rt. In response to questions, Mr. Hildebrand advised that this project is being undertaken by the Waterloo Region District School Board and the request is based on the City's shared use of the subject parking lot. He agreed to provide additional information outlining how this project compares to costs incurred by the City for other similarly shared facilities. On motion by Councillor S. Davey- it was resolved: "That an additional $67,400 be allocated to fund the City's portion of the Forest Heights Col leg iate/Pool/Library/Sportsfields/Tennis Court parking lot renovations scheduled to be undertaken by the Waterloo Region District School Board (WRDSB); and further, That the additional funding required for the City's portion of this project be re-prioritized from existing City capital budgets, as outlined in Community Services Department report CS D-14-053." Mayor C. Zehr re-entered the meeting at this time. 9. CAO-14-031 - BIG MUSIC FEST-EVENT CONTRACT, NOISE EXEMPTION, LICENSING The Committee considered Chief Administrator's Office report CAO-14-031, dated May 29, 2014 regarding the necessary approvals related event contract, noise exemptions and licensing to facilitate the Big Music Fest event taking place in McLennan Park from July 11-13, 2014. Mr. J.Young reviewed the report. In response to questions, Mr. Young estimated the City's costs related to Big Music Fest could range between $15,000-$20,000. He confirmed that the promoter would cover all of the costs related to having Waterloo Regional Police (WRP) at the event, which is estimated to cost approximately $35,000-$40,000. He indicated that the promoter provides the City with the COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 9.2014 -36- CITY OF KITCHENER 9. CAO-14-031 - BIG MUSIC FEST - EVENT CONTRACT, NOISE EXEMPTION, LICENSING (CONT'D) funds to cover the costs related to the WRP, which are then passed on to the Region of Waterloo. He noted that as part of the event contract, the promoter will provide the City with a $50,000 letter of credit for event related expenses. He agreed to provide copies of the City's financial statements outlining the estimated costs the City is anticipated to incur in relation to hosting Big Music Fest. Mr. S. Turner advised that during a discussion with the company who will be providing the audio equipment for the event, it was indicated that sound tests will need to take place on Thursday, July 10, 2014. Accordingly, he requested that Clause 3 of the recommendation contained in Report CAO-14-031 be revised to provide a noise exemption for July 10th from 2:00 p.m. to 7:00 p.m. Mr. Mark Higgins, Big Musicfest Inc., addressed the Committee to respond to questions related to the event, noting that moving Big Music Fest to Kitchener has enabled him to expand and broaden the potential audience. He indicated a preference for maintaining the existing method of providing funding to the City to cover the costs associated with having WRP personnel attend the event. He further agreed to increase the letter of credit for the event from $50,000. to $70,000., as a means of alleviating some of the concerns that have been expressed regarding the potential costs that might be incurred by the City. On motion, Councillor S. Davey brought the recommendation contained in Report CAO-14-031 forward for consideration,with the inclusion of the additional noise exemption for July 10, 2014 from 2:00 p.m. to 7:00 p.m. A motion was brought forward by Councillor P. Singh to amend Councillor Davey's motion to include a provision indicating that the letter of credit for event related expenses has been increased from $50,000. to$70,000. Councillor Singh's amendment was then voted on and was Carried Unanimously on a recorded vote by all members present. The following motion was then voted on and was Carried on a recorded vote with Mayor C. Zehr and Councillors B. Vrbanovic, D. Glenn-Graham, F. Etherington, K. Gal loway-Sealock, J. Gazzola, S. Davey, Y. Fernandes and Z. Janecki voting in favour; and, Councillor P. Singh voting in opposition. Councillor B. loannidis was absent and accordingly did not vote. On motion by Councillor S. Davey- it was resolved: "That the Mayor and Clerk be authorized to execute an agreement, subject to the satisfaction of the City Solicitor, with Big Musicfest Inc. for an event to be held at McLennan Park from Friday, July 11, 2014 to Sunday, July 13, 2014, and to sign any further agreements with Hydro One Inc. and the Regional Municipality of Waterloo as may be required to obtain their consent for the Event, as outlined in Chief Administrator's Office report CAO-14-031; and, That the Manager of Special Events be authorized to execute such further minor ancillary agreements on behalf of the City as are necessary to give effect to the foregoing, subject to the satisfaction of the City Solicitor; and, That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Big Music Fest on July 10, 2014, between the hours of 2:00 p.m. and 7:00 p.m., and on July 11, 2014, between the hours of 3:00 p.m. and 11:00 p.m. as well as on July 12 and 13,2014, between the hours of 3:00 p.m. and 11:00 p.m.; and, That the approach to the on-street parking plan and enforcement in the residential areas adjacent to McLennan Park, be endorsed as outlined in Report CAO-14-031; and, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JUNE 9.2014 -37 - CITY OF KITCHENER 9. CAO-14-031 - BIG MUSIC FEST - EVENT CONTRACT, NOISE EXEMPTION, LICENSING (CONT'D) That Robertson Amusements be granted permission to operate a Midway in McLennan Park, during the Big Music Fest from July 11-13, 2014 provided the required licence be obtained prior to operating the Midway; and, That staff be authorized to conduct a random drawing to distribute 46 of the 106 free tickets obtained by the City from Big Musicfest Inc. within the neighbourhood affected by the concert, subject to contest rules satisfactory to the City Solicitor, and that the remaining 60 free tickets be distributed by the Neighbourhood Associations to be sold for fundraising purposes or otherwise distributed at their discretion; and further, That the letter of credit for event related expenses from Big Music Fest be increase from $50,000.to $70,000." 10.
