1. CSD-14-061 -NOISE EXEMPTION -KITCHENER-WATERLOO OKTOBERFEST
The Committee considered Community Services Department report CSD-14-061, dated June
5, 2014 recommending approval of noise exemptions for Oktoberfest events being held at
various clubs between October 10 and October 18, 2014.
On motion by Councillor K. Gal loway-Sealock-
it was resolved:
"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to K-W Oktoberfest Inc. for a series of events being held at various clubs
between October 10 and October 18, 2014, as outlined in the letter from K-W
Oktoberfest Inc., dated May 6, 2014, as attached to Community Services Department
report CSD-14-061."
2. CSD-14-064-NOISE EXEMPTION -19 UXBRIDGE CRESCENT
The Committee considered Community Services Department report CSD-14-064, dated June
5, 2014 recommending approval of a noise exemption for a wedding celebration being held on
August 2, 2014.
On motion by Councillor K. Gal loway-Sealock-
it was resolved:
"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to Kimberly Cleveland for a wedding celebration at 19 Uxbridge Crescent on
August 2, 2014, between the hours of 3:00 p.m. and 11:00 p.m., as outlined in
Community Services Department report CSD-14-064."
3. INS-14-060 -NOISE EXEMPTION -KW EXPRESSWAY AT VICTORIA STREET(MTO)
The Committee considered Infrastructure Services Department report INS-14-060, dated June
5, 2014 recommending a noise exemption for the Ministry of Transportation (MTO) and its
contractors for the construction work related to the K-W Expressway project at Victoria Street.
On motion by Councillor K. Gal loway-Sealock-
it was resolved:

3. INS-14-060 -NOISE EXEMPTION - KW EXPRESSWAY AT VICTORIA STREET (MTO)
(CONT'D)
That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be exempt from
the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6
Construction Work, between the hours of 7:00 p.m. to 7:00 a.m. for the period from July
2, 2014 to August 22, 2014, during the Geotechnical Investigation For Bridge
Replacement and Road Rehabilitation project on the K-W Expressway at Victoria Street
in the City of Kitchener, as outlined in Infrastructure Services Department report INS-
14-060.
4. INS-14-059 -ON-STREET PARKING REGULATIONS -DUKE STREET
The Committee considered Infrastructure Services Department report INS-14-059, dated June
6, 2014 recommending approval of the relocation of a 15 minute loading zone on Duke Street
East and the installation of an on-street accessible parking space.
On motion by Councillor K. Gal loway-Sealock-
it was resolved:
"That the Uniform Traffic By-law be amended so that the existing 15 minute loading
zone on the south side of Duke Street East from a point 13 meters east of Frederick
Street to a point 25 meters east of Frederick Street be relocated to the south side of
Duke Street East from a point 20 metres east of Frederick Street to a point 12 metres
east thereof; and further,
That an on-street accessible parking space be installed on the south side of Duke
Street from a point 13 metres east of Frederick Street to a point 7 metres east, as
outlined in Infrastructure Services Department report INS-14-059."
5. INS-14-065-ARDELT SNOW DUMP -LEASE RENEWAL
The Committee considered Infrastructure Services Department report INS-14-065, dated June
6, 2014 regarding the approval of a lease agreement renewal for the use of 75 Ardelt Place as
of a snow dumping facility.
On motion by Councillor K. Gal loway-Sealock-
it was resolved:
"That the Mayor and Clerk be authorized to execute a lease agreement, subject to the
satisfaction of the City Solicitor,with the current property owner at 75 Ardelt Place in the
City of Kitchener for the use of the lands for the purpose of providing a snow dumping
facility for the exclusive use of City staff and their contractors, as outlined in
Infrastructure Services Department report INS-14-065."
Mayor C. Zehr entered the meeting at this time.
6. INS-14-056-ON-STREET PARKING REGULATIONS -COMMONWEALTH STREET
The Committee considered Infrastructure Services Department report INS-14-056, dated June
6, 2014 recommending the extension of the current no stopping prohibition on Commonwealth
Street to Commonwealth Crescent. Mr. J. Readman presented the report and responded to
questions from the Committee.
Mr. Jonathan Grundy addressed the Committee in support of the implementation of a parking
prohibition on Commonwealth Street; however, he requested that the proposed parking
prohibition be implemented on the north side of the street rather than the south side as
proposed in the staff report. He indicated that if parking prohibition is extended to
Commonwealth Crescent, parents will being dropping their children off on the north side of the
street which will require those children to cross the street to attend school; thereby, increasing
the concerns for safety.

6. INS-14-056-ON-STREET PARKING REGULATIONS - COMMONWEALTH STREET

In response to questions, Mr. Readman advised that Transportation Planning staff, in response
to a request from a resident regarding the existing on-street parking regulations on
Commonweath Street, completed an assessment of the area and surveyed the residents
regarding the proposal to extend the existing no stopping at any time on the south side of the
street. He indicated that residents were offered two options in the survey: extending the
existing no stopping on the south side of the street; or, maintaining the prohibition as it
currently exists, of which the majority of the residents were in favour of the parking prohibition.
Mr. Readman further advised that one of the reasons that staff have recommended the south
side of the street rather than the north side is due to the pathway that connects to the school
property, and the concern that children would then be required to cross the street between two
parked cars; which presents additional concerns with safety concerns with children not being
seen by passing vehicles.
Questions were raised on whether staff could review the `no stopping' prohibition and provide a
recommendation that would permit it to be located on the north side of the street. It was
suggested that another survey could be sent to the area residents to gauge their preference for
the proposed north or south locations.
A motion was brought forward by Councillor K. Galloway-Sealock to defer consideration of the
recommendation contained in Report INS-14-056 to the August 11, 2014 Special Council
meeting to allow time for staff to survey the residents on the proposed location of the `no
stopping prohibition'on Commonwealth Street.
On motion by Councillor K. Galloway-Sealock-
it was resolved:
"That consideration of the following motion contained in Infrastructure Services
Department report INS-14-056, be deferred to the August 11, 2014 Special Council
meeting to allow staff time to survey the residents on whether they would prefer the
recommended `no stopping' prohibition on the north or south side of Commonwealth
Street:
`That the Uniform Traffic By-law be amended to prohibit stopping any time 8:00
a.m. to 4:30 p.m. Monday to Friday on the south side of Commonwealth Street
between Max Becker Drive and a point 125 meters east thereof, be extended
easterly to Commonwealth Crescent, as outlined in Infrastructure Services
Department report INS-14-056."
7. INS-14-064-BICYLE LANE INSTALLATION ON BATTLER ROAD AND ECKERT STREET
The Committee considered Infrastructure Services Department report INS-14-064, dated June
6, 2014 recommending approval of the installation of bicycle lanes on Battler Road and Eckert
Street, and a parking prohibition on Battler Road.
Mr. J. Readman presented the report, advising that staff are proposing to install bicycle lanes
on Battler Road and Eckert Street. He noted that the title of the Report on the agenda page
includes Doon Mills Drive, but the Report does not contain any recommendations pertaining to
that street. He stated Doon Mills Drive was identified for a 2014 Traffic Calming study, and
noted that any cycling infrastructure improvements or parking prohibitions will be addressed
and reported on at a future Committee meeting through that Study process.
Mr. Duncan Class addressed the Committee in support of the proposed cycling infrastructure
on Battler Road and Eckert Street. He expressed concerns with the portion of Battler Road
between Huron Road and Old Huron Road that has not been identified for the installation of
any type of active transportation infrastructure. He expressed further concerns with the cycling
infrastructure on Eckert Street, noting that barriers have been installed that may potentially
impede a cyclist's safety.
In response to questions, Mr. Readman agreed to investigate the proposed limits of the Huron
Road Bike facilities.

On motion by Councillor Y. Fernandes-
it was resolved:
"That Bicycle Lanes be installed on Battler Road from Strasburg Road to Huron Road,
on Eckert Street from Dixon Drive to First Avenue; and further,
That the Uniform Traffic By-law be amended to prohibit parking at anytime on both
sides of Battler Road from Strasburg Road to Huron Road, as outlined in Infrastructure
Services Department report INS-14-064."
8. CSD-14-066-THE KITCHENER MEMORIAL AUDITORIUM COMPLEX
-VIDEO AND SCORE CLOCK REPLACEMENT
The Committee considered Community Services Department report CSD-14-066, dated June
10, 2014 regarding the transfer of funds, to the Kitchener Rangers, for the Kitchener Memorial
Auditorium Complex video and score clock replacement. Ms. K. Kugler presented the report
and responded to questions from the Committee. Mr. Steve Bienkowski, Chief Operating
Officer for the Kitchener Rangers, and Mr. R. Hagey were also in attendance to respond to
questions from the Committee.
The following motion was voted on by a recorded vote and was Carried, with Mayor C. Zehr
and Councillors B. Vrbanovic, B. loannidis, D. Glenn-Graham, F. Etherington, K. Galloway-
Sealock, P. Singh, S. Davey, Y. Fernandes and Z. Janecki voting in favour; and, Councillor J.
Gazzola voting in opposition.
On motion by Councillor B.Vrbanovic-
it was resolved:
"That the Kitchener Rangers be allocated $357,875. from the Kitchener Memorial
Auditorium Complex (KMAC) Site Upgrading capital account by August 1, 2014 to
replace the video score clock; and further,
That the KMAC Site Upgrading capital account be adjusted in the 2015 Capital Budget,
as outlined in Community Services Department report CSD-14-066."
9. CAO-14-034 - YOUTH FORUM AND MY IDEAL CITY 2013/14 PROJECT UPDATE
The Committee considered Chief Administrator's Office report CAO-14-034, dated June 6,
2014 recommending approval of the My Ideal City program staying in its current form, and
expanding the Youth Forum program. Ms. D. McCabe was in attendance and responded to
questions from the Committee.
A motion was brought forward by Councillor D. Glenn-Graham to defer consideration of the
staff recommendation contained in Report CAO-14-034 to the June 30, 2014 Council meeting
to allow time for staff to investigate whether the Youth Forum could be expanded incrementally
to include additional schools as well as additional funding partners.
In response to questions, Ms. McCabe clarified that the program is capable of expanding
within the existing budget. She noted that the Rotary Club of Kitchener is committed to
maintaining the existing funding and partnership agreement; and, staff are seeking Council's
commitment to expand this program to include all eight secondary schools in Kitchener.
Councillor D. Glenn-Graham withdrew his deferral motion.
A motion was brought forward by Councillor Y. Fernandes to approve the recommendation as
outlined in Report CAO-14-034.
The following motion was voted on and was Carried unanimously on a recorded vote.

On motion by Councillor Y. Fernandes-
it was resolved:
"That the My Ideal City program be approved in its current form and the Youth Forum
program be expanded as a pilot for the 2014/15 school year as stated in Chief
Administrator's Office report CAO-14-034; and further,
That expansion of the Youth Forum program is conditional on a minimum participation
rate of seven members of Council per forum and a continued partnership with the
Rotary Club of Kitchener, as outlined Report CAO-14-034."
10. CSD-14-018- NEIGHBOURHOOD MATCHING FUNDS GRANT
The Committee considered Community Services Department report CSD-14-018, dated June
10, 2014 regarding changes to the guidelines and funding of the Neighbourhood Matching
Funds Grant program. Mr. M. Hildebrand presented the report and responded to questions
from the Committee.
Councillor Y. Fernandes noted that staff may want to investigate a similar reporting structure
for the Community Environmental Improvement Grants (CEIG) to assist with monitoring the
overall success of the program. She noted that CEIG recipients typically provide a follow-up
presentation to the Environment Committee once their project has been completed.
On motion by Councillor B.Vrbanovic-
it was resolved:
"That the Neighbourhood Matching Funds Grant guidelines, attached to report
Community Services Department report CSD-14-018, be approved; and,
That$10,000 per year,for three years, be budgeted for the grant program; and,
That the Neighbourhood Matching Funds Grant be funded out of the Community
Assistance Loan reserve fund; and further,
That staff evaluate and report back to Council on the effectiveness of the grant program
at the completion of year three."
11. INS-14-021 - PROPOSED CYCLING AND TRAILS ADVISORY COMMITTEE
The Committee considered Infrastructure Services Department report INS-14-021, dated June
11 2014 recommending that Council Policy 1-114 (Kitchener Cycling Advisory Committee -
Terms of Reference), be repealed and replaced with the draft Council Policy (Cycling and
Trails Advisory Committee - Terms of Reference). Mr. J. Witmer presented the report and
responded to questions from the Committee.
Mr. Peter Dedes, Chair, Kitchener Cycling Advisory Committee (KCAC), addressed the
Committee in support of the staff recommendation to expand the scope of the current Cycling
Advisory Committee. He noted that KCAC have reviewed the Terms of Reference for the
Cycling and Trails Advisory Committee and have endorsed the proposed Policy.
Councillor D. Glenn-Graham suggested that when appointments are being made to the Cycling
and Trails Advisory Committee, preference should be given to appointing at least one applicant
that possesses some expertise in accessibility awareness.
Councillor K. Galloway-Sealock brought forward a motion to approve the staff recommendation
as outlined in Report INS-14-021.
A motion was brought forward by Mayor C. Zehr to amend item 3.2 of the draft Terms of
Reference to modify the Committee's composition by substituting the word "may"with shall"

and including an additional sentence that states "the Committee membership shall include at
least one member who is not a cyclist"; and, increasing the Committee quorum from 5 to 6
people as listed in Item 3.5 of Appendix A'.
A further amendment was brought forward by Councillor K. Gal loway-Sealock to reword Item
3.4 of Appendix `A' to reflect the following: "The Committee, shall, from amongst its members,
choose a Committee Chair who is not a member of Council, and a Vice-Chair who may be a
member of Council", and, to reword Item 5.2 to reflect"The Committee shall report through the
Community and Infrastructure Services Committee unless exceptional circumstances shall
necessitate a report be made directly to Council".
On motion by Councillor K. Gal loway-Sealock-
it was resolved:
"That Council Policy 1-114 (Kitchener Cycling Advisory Committee - Terms of
Reference) be repealed and replaced with the draft Council Policy (Cycling and Trails
Advisory Committee - Terms of Reference), attached as Appendix `A' to Infrastructure
Services Department report INS-14-021, save and except for the following
amendments:
• Section 3.2- replace the word `may'with `shall';
• Section 3.2 - added `and shall include at least one member who is not a
cyclist';
• Section 3.4 - reworded to `The Committee shall, from amongst its members,
choose a Committee Chair who is not a member of Council and a Committee
Vice-Chair who may be a member of Council';
• Section 3.5-Quorum revised to 6 members from 5 members; and,
• Section 5.2- reworded to `The Committee shall report through the Community
and Infrastructure Services Committee unless the Committee Chair, in
consultation with staff, deems it expedient that a report be made directly to
Council', and further,
That the Cycling and Trails Advisory Committee begins its first term in January 2015."
12. INS-14-062 - NYBERG CYCLING INFRASTRUCTURE IMPROVEMENTS
The Committee considered Infrastructure Services Department report INS-14-062, dated June
5, 2014 recommending various parking prohibitions and cycling infrastructure improvements
on Nyberg Street.
Mr. Duncan Class and Mr. Peter Dedes, Chair, Cycling Advisory Committee addressed the
Committee in support of the proposed cycling infrastructure on Nyberg Street.
Ms. Dianne and Mr. Murray Walden addressed the Committee in opposition of the proposed
parking prohibition and installation of a contra-flow cycling lane on Nyberg Street. Mr. Walden
commented that if the Committee was inclined to approve the proposed parking prohibition, he
would request that further consideration be given to prohibiting parking on the north side of the
street; rather, than the recommended south side of the street.
Mr. Derek Dawe addressed the Committee in opposition to the proposed installation of contra-
flow cycling lane on Nyberg Street, advising that the street is often used as a cut through for
traffic going the wrong direction on a one-way street. He expressed concerns that the
installation of a contra-flow bicycle lane may increase the traffic flow of people going the wrong
direction down the street.
A motion was brought forward by Councillor F. Etherington to defer consideration of the staff
recommendation outlined in Report INS-14-062 to the June 30, 2014 Council meeting, to allow
time for staff to dialogue with the residents that were in attendance this date regarding their
concerns.

On motion by Councillor F. Etherington -
it was resolved:
"That consideration of the following motion contained in Infrastructure Services
Committee report INS-14-062, be deferred to the June 30, 2014 Council meetinq to
allow time for staff to dialogue with the residents on the proposed contra-flow bicycle
lane and parking prohibition:
`That an east bound contra-flow bicycle lane be installed on Nyberg Street
between Ottawa Street South and Sydney Street South, and sharrows be
installed within the westbound travel lane of Nyberg Street between Ottawa
Street South and Sydney Street South,and,
That sharrows be installed on Nyberg Street between Borden Avenue South and
Ottawa Street south,and,
That the Uniform Traffic By-law be amended to prohibit parking at any time on
the south side (odd number side) of Nyberg Street from Ottawa Street South to
Sydney Street South,and further,
That the Uniform Traffic By-law be amended to permit for a maximum period of
three consecutive hours on the north side (even number side) of Nyberg Street
from Sydney Street South to a point 22 metres east of Ottawa Street South, as
outlined in Infrastructure Services Department report INS-14-062.
13. INS-14-061 - DOWNTOWN CYCLING NETWORK IMPROVEMENTS
The Committee considered Infrastructure Services Department report INS-14-061, dated June
6, 2014 regarding the Downtown Cycling Network Improvements.
Mr. Duncan Class addressed the Committee expressing concerns with the number of cycling
infrastructure projects that have been focused in the Downtown Core, suggesting greater focus
should be given to enhancing cycling connections throughout the entire City.
Mr. Peter Dedes, Chair, Cycling Advisory Committee addressed the Committee in support of
the proposed cycling infrastructure in the Downtown Core.
The Committee then recessed at 4:07 p.m. and reconvened at 6:15 p.m. Chaired by Councillor B.
Vrbanovic,with all members present.
13. INS-14-061 - DOWNTOWN CYCLING NETWORK IMPROVEMENTS
The Committee further considered Infrastructure Services Department report INS-14-061,
dated June 6, 2014 regarding the Downtown Cycling Network Improvements. Mr. J. Readman
presented the report and responded to questions from the Committee.
On motion by Councillor Y. Fernandes-
it was resolved:
"That the existing bicycle lane on Queen Street between St. George Street and
Courtland Avenue be removed; and,
That Queen Street between Courtland Avenue and Lancaster Street, Courtland Avenue
West/Jubilee Drive/Park Street between Queen Street and Victoria Street, Joseph
Street between Victoria Street and Queen Street, and Gaukel Street between Joseph
Street and King Street be added to the sharrow network; and,
That Henry Street between Victoria Street and Jubilee Drive, and College Street
between Ahrens Street and King Street be added to the signed bike route network; and
further,

Services Department report INS-14-061."
