SUBJECT: NOISE EXEMPTION REQUEST – MARKET SQUARE
GARAGE REHABILITATION PROJECT

RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code
be granted to Albatech Construction for construction work on the Market Square
parking garage, on various evenings, between the hours of 7PM and 7AM, from
July 2 to August 25, 2014.
BACKGROUND:
The owner of the Market Square parking garage must undertake significant repairs to
the concrete parking garage structure at the corner of Duke Street and Scott Street.
Some work was undertaken after 7PM on a several evenings in June. Complaints were
registered to the By-law Enforcement office. Due to the nature of the required repairs,
the building owner and contractor are requesting an exemption from Chapter 450
(Noise) of the City’s Municipal Code.
REPORT:
Staff have discussed the rehabilitation project with the building’s property management
company, who is coordinating the project with the contractor. The required concrete
repairs are significantly more extensive than first anticipated, which has required the
contractor to adjust his work schedule.
The phase of work that is of primary consideration with regard to having to work after
hours is the repairs to the driveway ramp from the garage to street level. It is extremely

difficult to close the ramp to customer traffic during normal business hours. The
property manager also advises that the repair work that creates the most noise, that
being the chipping of deteriorated concrete, will not be occurring every night and the
contractor will do its best to limit the number of night involved.
Further, the property manager and contractor will commit to providing the By-law
Enforcement office an updated schedule of intended repairs at the beginning of each
week.
Given the extent of the work involved, the building owner is requesting to do work
throughout the night, although not every night, and understands that this issue may
need to be re-evaluated in mid-August when the Council meeting schedule resumes.
Concerns expressed from any nearby residential area will factor into how this exemption
is re-evaluated. At this time, staff advise that they are not able to clearly identify the
area from which the previous concerns originated. As such, staff’s ability to have a
dialogue with the person(s) previously affected is extremely limited.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
Approval of a noise exemption request supports the Community Priorities of Quality of
Life, as contained in the City’s Strategic Plan.
FINANCIAL IMPLICATIONS:
N/A
COMMUNITY ENGAGEMENT:
The property management and contractor will be updating City staff with periodic work
schedules. Staff will then communicate this information to anyone identified as being
affected by the project, to the best of their ability given all information available to them.
