SUBJECT: Partial Property Acquisition for David Street – 290 Queen
St. S & 51-53 David St.

RECOMMENDATION:
That the Mayor and Clerk be authorized to execute an Agreement of Purchase and Sale,
satisfactory to the City Solicitor, with the owners of 290 Queen Street South and 51-53
David Street, for the purpose of acquiring a portion of two lots on David Street
municipally known as 290 Queen Street South and 51-53 David Street, Kitchener, for the
purpose improving the roadway cross section, at a purchase price not to exceed $11,000
plus the cost of a reference plan and all incidental costs associated with the transaction,
and further,
That the Mayor and Clerk be authorized to execute the necessary documentation to
complete the conveyance; said documentation to be to the satisfaction of the City
Solicitor.
BACKGROUND:
The David (Joseph St. to Jubilee Dr.) and Ontario (Charles St. to Joseph St.) Street
Reconstruction Project has been initiated to address aging infrastructure. The infrastructure has
reached the end of its useful life and is in need of replacement. The project involves the
replacement of the roadway, curb and gutter, sidewalk and all underground services and
surface works. In order to improve the roadway cross section on David Street, the partial
acquisition of two properties is required.
REPORT:
The proposed acquisition of an approximate 3.0 m x 13.7 m piece land from 290 Queen Street
South and 3.0 m x 16.0 m piece of land from 51-53 David Street enables the City to increase
the lane widths and install standard width sidewalks on David Street. It also allows the City to
have consistent right-of-way width for this block of David Street. Construction of the project
started on June 16, 2014.
The purchase price is in accordance with a Land Value Analysis prepared for the City by their
consulting real estate agent.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
Improving the cross section of David Street from Joseph Street to Jubilee Drive provides a
variety of transportation and community health benefits. The proposed road widening
acquisition aligns with key themes and community priorities stated within the City’s Strategic
Plan, particularly the Quality of Life and Development themes.
FINANCIAL IMPLICATIONS:
Purchase costs, reference plan expenses and all incidental costs associated with the
transaction are to be paid from the project account and is within budget.
