SUBJECT: Delegated Authority—Tenders — Fall 2014
RECOMMENDATION:
That, notwithstanding Chapter 115 of Kitchener's Municipal Code, the Chief
Administrative Officer shall approve any tenders which otherwise can't be
brought before Council in a timely manner between the period of September 16
through November 30, 2014, provided that the total costs are within the approved
budgets contained in the relevant departmental budgets and that a report
regarding these tenders is brought to Council at its next regular meeting; and
further
That notwithstanding Chapter 170 of Kitchener's Municipal Code, the Director of
Supply Services be authorized to execute any agreements pertaining to tenders
approved by the Chief Administrative Officer between the period of September 16
through November 30, 2014.
BACKGROUND:
The fall Council schedule has a 2 month period of time between Council agendas as
well as the possibility of being in a lame duck situation as of the Election Day, which will
impact the ability for divisions to proceed with their work, acquisition of necessary
equipment and services as contemplated in their respective budgets.
REPORT:
In order to ensure normal business continues in a timely manner this fall, staff need the
ability to advance the tenders in a timely manner, similar to what they do for the summer
recess. Staff will endeavor to take any tenders to the closest Council meeting, but if the
time lapse is too great, delegated approval to the Chief Administrative Officer will allow
staff to seek the approval of the Chief Administrative Officer, following the same
protocol that is in place for Council's summer recess.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
Effective and efficient government — Approving the delegation of authority for the fall
Council schedule and in the event of a "lame duck" status ensures that staff will be able
to proceed with approved projects and the acquisition of equipment and services
required to carry out City business.
FINANCIAL IMPLICATIONS:
Total costs are within the approved budgets contained in the relevant departmental
budgets.
