CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Mr. E. Lucy, commencing at 4:10 p.m., with the following
members present: Ms. J. Armstrong, Ms. L. Harris, Ms. D. Kuehl, Ms. A. Moore and Messrs. J.
Countryman, K. Kirby, E. Lucy and M. Stranz.
Regrets: Councillor M. Galloway and Mr. Z. Janecki
Others Present: Ms. D. Gilchrist and Mr. L. Bensason
As Councillor M. Galloway and Mr. Z. Janecki were not in attendance the Committee appointed Mr.
E. Lucy as Acting Chair for this meeting.
100 DUKE STREET WEST (ST. JEROMES) - DEMOLITION OF COLLEGE STREET
BUILDING - AMENDMENT TO DESIGNATING BY-LAW
The Committee was in receipt of a memorandum from Mr. L. Bensason, dated December 19,
2003, advising that the Chief Building Official has issued an order to remedy unsafe conditions
at the property addressed as 20 College Street, being part of the former St. Jeromes College.
The owner will be submitting a Heritage Permit Application seeking permission to demolish the
remainder of this building which suffered from a recent fire. The owner has also requested the
designating By-law for this property be amended to include only the 1907 building, addressed
as 100 Duke Street West.
The Committee was in receipt this date or Heritage Permit Application HPA 2004-1V-02, from
the property owner, requesting permission to demolish the building municipally known as 20
College Street. Mr. J. Moon, representative or the owner, was in attendance.
Mr. L. Bensason displayed images of the property before and after the fire. He requested that
should the Committee recommend approval of the application, the motion include a request to
the owner to donate the 1909 Date Stone and Bronze Heritage Plaque to the City. Mr.
Bensason advised of the owner's request for an amendment for the designating By-law so it
would apply only to the 1907 building addressed as 100 Duke Street West.
Mr. Moon addressed the Committee, thanking them and Mr. Bensason for all their efforts over
the years to preserve this property.
On motion by Mr. K. Kirby -
it was resolved:
"That Heritage Permit Application HPA-2004-1V-02 (20 College Street) to demolish the
remaining portion of the c.1909 building be approved; and further,
That the owner be requested to donate the '1909' Date Stone and Bronze Heritage
Plaque to the City of Kitchener for archival purposes"
On motion by Ms. A. Moore -
it was resolved:
"That the legal description contained in By-law 93-43, which designates the former St.
Jeromes College as being of historic and architectural significance, be amended so the
designation applies only to the property municipally known as 100 Duke Street West; and
further,
That the reasons for designation application to c.1907 building at 100 Duke Street West
not be amended."

HERITAGE PERMIT APPLICATION HPA 2004-V-001 - OREGON COURT (UPPER DOON
HERITAGE CONSERVATION DISTRICT) - CONSTRUCTION OF NEW SINGLE FAMILY
DWELLING AND GARAGE
The Committee was in receipt of Heritage Permit Application HPA 2004-V-001, from
Charleston Homes, requesting permission to construct a single family dwelling and garage on
Lot 6, Registered Plan 58M-230, Oregon Court, located in the Upper Doon Heritage
Conservation District.
Mr. J. Kuiken of Charleston Homes was in attendance to represent the application, and
displayed samples of the building materials for the proposed single family dwelling.
Mr. Bensason displayed images of the subject property and surrounding properties.
On motion by Mr. K. Kirby -
it was resolved:
"That Heritage Permit Application HPA 2004-V-01 (Lot 6, Registered Plan 58M - 230,
Oregon Court) be approved to permit the construction of a single family dwelling and
garage as identified in the plans submitted with the application."
HERITAGE EASEMENT AGREEMENT - NEW TEMPLATE FOR TARGETED COMMERCIAL
PROPERTIES IN THE DOWNTOWN
The Committee was in receipt this date of a memorandum from Mr. L. Bensason, dated
January 5, 2004, updating the Committee with respect to the City's efforts to establish a new
Heritage Conservation Easement Agreement template for selected heritage properties that
serve as candidates for adaptive reuse. Attached to this memorandum is the standard form of
Heritage Easement Agreement supplied by the Ontario Heritage Foundation.
Mr. Bensason explained that a Heritage Easement Agreement is a form of legal agreement
between a property owner and a public body which goes beyond heritage designation. The
agreement usually gives powers to the public body. The difficulty with the template provided
by the Ontario Heritage Foundation is the fact that it is not appropriate for larger commercial
properties where rights/powers may have already been given to mortgage companies and
lease holders. Staff have undertaken research with other municipalities and mortgage
companies, and are preparing a new form of Heritage Easement Agreement, currently being
drafted by the City's Legal Services. Mr. Bensason advised that he will circulate the
Agreement to Committee members for comments once it is finalized, and requested that their
comments be submitted prior to the next meeting.
4. 2004 HERITAGE SHOWCASE
Ms. D. Kuehl agreed to head a sub-committee to look after Heritage Kitchener's participation
in this year's Heritage Showcase. All Heritage Kitchener members are invited to participate.
The Heritage Showcase will be held on Saturday February 21,2004, at Cambridge Centre.
HERITAGE KITCHENER 2004 OBJECTIVES
The Committee generally agreed to the following objectives for 2004;
a) designation of 787-811 Morrison Road (Sims Estate),
b)
review of the Heritage Inventory to determine if any of the listed properties merit
designation,
c) finish walking tour guides for the City's Heritage Conservation District, and,
d) establishing criteria for the City to enter into Heritage Easement Agreements.
