SUBJECT: NOISE EXEMPTION REQUEST – MARKET SQUARE GARAGE
REHABILITATION PROJECT

RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code
be granted to Albatech Construction for construction work on the Market Square
parking garage, on various evenings, between the hours of 7PM and 7AM, from
August 25, 2014, to August 29, 2014.
BACKGROUND:
At the meeting of June 30, 2014, Council considered Report CSD-14-073 and
subsequently approved the following recommendation:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to Albatech Construction for construction work on the Market Square parking
garage, on various evenings, between the hours of 7PM and 7AM, from July 2 to
August 25, 2014.
The owner and property manager are now seeking a few extra days to complete the
repairs that are required to be undertaken after normal business hours.
REPORT:
The end date of the original exemption recommendation was set at August 25, 2014, by
staff in order for the exemption to be reconsidered at the next available Council
meeting, if required. The property manager originally requested an exemption until the
end of October. However, staff felt that it was prudent to have the matter considered
again, if necessary, at the earliest possible time.
As indicated in the original report, certain aspects of the concrete repairs are required to
be done after normal business hours when the majority of cars have vacated the
parking garage.
Several complaints were received in July, after the noise exemption had been
established. Staff anticipated that there may be some complaints, which factored into

the decision to place a limit is August 25 on the exemption. Staff were in contact with
the property management who worked with the contractor to limit the impact of the
construction noise.

Information received from the property management on Friday August 22 indicates
that the phase requiring work after 7PM is nearing completion and they are requesting
an additional 4 nights to complete the work. They indicate that the alternative would be
for the work to extend into the weekends for the next 6 weekends.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The aforementioned amendments support the Community Priority of Quality of Life, as
contained in the City’s Strategic Plan.
