CSD-14-095 - TERMITE CONTROL AND ENFORCEMENT The Committee considered Community Services Department report CSD-14-095, dated August 13, 2014 regarding termite control and enforcement. In addition, the Committee was in receipt this date of 80 petitions regarding termite enforcement and support for City assisted funding options for residents who are dealing with termite infestation. Mr. T. Benedict was in attendance and responded to questions from the Committee. Dr. T. Myles, Manager, Termite Control Program, City of Guelph presented information materials on subterranean termites, including various termite control mechanisms and potential recommendations that the City could consider for managing the spread of the insect. The Committee then recessed at 9:50 a.m. and reconvened at 9:53 a.m. Chaired by Councillor B. loannidis,with all members present. Councillor K. Galloway-Sealock brought forward the recommendation contained in Report CSD-14-095 for consideration. Councillor P. Singh brought forward a motion to defer the recommendation to the September 15, 2014 Council meeting to provide a further opportunity for members of the public to address this matter. Councillor D. Glenn-Graham advised that he has potential amendments to the staff recommendation that could be brought forward at the September 15, 2014 Council meeting, including: the restriction of polystyrene below grade when building / constructing within City boundaries; directing staff to begin preventative area wide management immediately; and, adoption of funding options 2 and 4 as outlined in Report CSD-14-095. On motion by Councillor P. Singh - it was resolved: "That consideration of the following motion contained in Community Services Department report CSD-14-095, be deferred to the September 15, 2014 Council meeting to provide a further opportunity for members of the public to address this matter: `That no funding be provided to individual home owners for the treatment of termites on private property, and, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE SEPTEMBER 8. 2014 -55- CITY OF KITCHENER 1. CSD-14-095 - TERMITE CONTROL AND ENFORCEMENT(CONT'D) That staff be directed to undertake a review of the existing by-law Chapter 689 (Termite-Wood-Destroying Insects Control)of the City of Kitchener Municipal Code, and further, That staff be directed to implement a Public Education Program about termites for the entire city starting in 2015, as outlined in Community Services Department report CSD-14-095."' 2. CSD-14-084 - NOISE EXEMPTION REQUEST-AUDITORIUM NEIGHBOURHOOD ASSOCIATION -WADDLEFEST The Committee considered Community Services Department report CSD-14-084, dated August 21, 2014 recommending approval of a noise exemption for the Auditorium Neighbourhood Association, for their Waddlefest event taking place on September 14, 2014. It was noted that any recommendation arising from the Committee regarding this matter would be considered at the special Council meeting being held later this same date. On motion by Mayor C. Zehr- it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Auditorium Neighbourhood Association, for their annual Waddlefest event taking place at Knollwood Park on September 14, 2014, between the hours of 11:00 a.m. and 7:00 p.m., as outlined in Community Services Department report CSD-14-084." 3. CSD-14-093 - NOISE EXEMPTION REQUEST-46 GRAVEL RIDGE TRAIL The Committee considered Community Services Department report CSD-14-093, dated August 21, 2014 recommending approval of a noise exemption for Sherry Landry for a wedding celebration being held on October 5,2014. On motion by Mayor C. Zehr- it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Sherry Landry for a wedding celebration at 46 Gravel Ridge Trail on October 5, 2014, between the hours of 4:00 p.m. to 11:00 p.m., as outlined Community Services Department report CSD-14-093." 4. CSD-14-097 - NOISE EXEMPTION REQUEST-CENTER IN THE SQUARE The Committee considered Community Services Department report CSD-14-097, dated August 21, 2014 requesting approval of a noise exemption for the Center in the Square for an outdoor event, entitled "Strange Fruit Australia" being held on September 12 and 14, 2014. It was noted that any recommendation arising from the Committee regarding this matter would be considered at the special Council meeting being held later this same date. On motion by Mayor C. Zehr- it was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to The Centre in The Square for an outdoor event entitled "Strange Fruit Australia", to be held on September 12, 2014, between the hours of 6:30 p.m. and 8:30 p.m., September 14, 2014, between the hours of 4:00 p.m. and 8:30 p.m. and the event's rehearsal period on September 11, 2014, intermittently between the hours of 10:00 a.m. and 8:00 p.m., as outlined in Community Services Department report CSD- 14-097." COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE SEPTEMBER 8. 2014 -56- CITY OF KITCHENER 5. CSD-14-094 - LIMITING DISTANCE AGREEMENT-58 HOWE DRIVE The Committee considered Community Services Department report CSD-14-094, dated August 12, 2014 recommending approval of a limiting distance agreement with the owner of 58 Howe Drive. Mr. T. Benedict was in attendance and responded to questions from the Committee. The following motion was voted on and was Carried on a recorded vote, with Mayor C. Zehr and Councillors B. Vrbanovic, B. loannidis, D. Glenn-Graham, F. Etherington, K. Galloway- Sealock, P. Singh and S. Davey, voting in favour; and, Councillor J. Gazzola, Y. Fernandes and Z. Janecki voting in opposition. On motion by Mayor C. Zehr- it was resolved: "That the Mayor and Clerk be authorized to execute a limiting distance agreement,subject to the satisfaction of the City Solicitor,with the registered owner(s)of Pt Lot 47, municipally addressed as 58 Howe Drive, pursuant to Section 9.10.14.2.(4)of the Building Code; said agreement to permit a stacked townhouse with the limiting distance for the construction of the exposing building face being measured to a point beyond the property line on the adjacent property, Block 44 Registered Plan 58M-442, known as Park ID 2305 (City of Kitchener Windale Park), as outlined in Community Services Department report CSD-14- 094." 6. INS-14-080 - ON-STREET PARKING REGULATIONS -OLD PARK LANE The Committee considered Infrastructure Services Department report INS-14-080, dated August 22, 2014 recommending the removal of the existing no parking prohibition and reinstatement of a three hour parking limit on Old Park Lane. On motion by Mayor C. Zehr- it was resolved: "That the Uniform Traffic By-law be amended so that the existing no parking 4:00 p.m. - 8:00 p.m.April 1 -July 31 parking regulation on the north/east/south side of Old Park lane between Highview Drive (north intersection) and a point 323m east thereof, be removed, and be reinstated with a three (3) hour parking time limit, as outlined in Infrastructure Services Department report INS-14-080." 7. INS-014-081 - ON-STREET PARKING REGULATIONS -WOODHURST COURT The Committee considered Infrastructure Services Department report INS-14-081, dated August 22, 2014 recommending approval of various parking prohibitions on Woodhurst Court. On motion by Mayor C. Zehr- it was resolved: "That stopping be prohibited at any time on both sides of the traffic island on Woodhurst Court from Westforest Trail to a point 9 metres south thereof; and, That stopping be prohibited 8:00 a.m. - 4:30 p.m. Monday - Friday on both sides of the traffic island on Woodhurst Court from a point 9 metres south of Westforest Trail to a point 11 metres south thereof; and, That stopping be prohibited on the traffic island on Woodhurst Court from a point 20 metres south of Westforest Trail to a point 18 metres south thereof; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure Services Department report INS-14-081." COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE SEPTEMBER 8. 2014 -57 - CITY OF KITCHENER 8. INS-14-053 - ON-STREET PARKING REGULATIONS -BATTLER ROAD The Committee considered Infrastructure Services Department report INS-14-053, dated July 17, 2014 recommending approval of various parking prohibitions on Battler Road. On motion by Mayor C. Zehr- it was resolved: "That parking be prohibited at anytime on the south side of Battler Road from Huron Road to Old Huron Road; and, That parking be prohibited at anytime on the north side of Battler Road from Huron Road to a point 50 metres east thereof; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure Services Department report INS-14-053." 9. INS-14-019 - REGIONAL MAINTENANCE AGREEMENT-2015-2019 The Committee considered Infrastructure Services Department report INS-14-019, dated August 12, 2014 recommending approval of a maintenance agreement with the Region of Waterloo for the City of Kitchener to provide summer and winter maintenance services on specified Regional roads. Mr. J. Witmer was in attendance and responded to questions from the Committee. The following motion was voted on and was Carried on a recorded vote, with Mayor C. Zehr and Councillors Y. Fernandes, B. loannidis, D. Glenn-Graham, F. Etherington, K. Galloway- Sealock, Z. Janecki and S. Davey, voting in favour; and, Councillor J. Gazzola, B. Vrbanovic and P. Singh voting in opposition. On motion by Mayor C. Zehr- it was resolved: "That the Mayor and Clerk be authorized to execute an agreement, subject to the satisfaction of the City Solicitor, with the Regional Municipality of Waterloo, for the City of Kitchener to provide summer and winter maintenance services on selected Regional Roads within the City of Kitchener for the contract period of 2015-2019, as outlined in Infrastructure Services Department report INS-14-019." 10. CSD-14-088 - PARTS PHASE 2: URBAN DESIGN BRIEF The Committee considered Community Services Department report CSD-14-088, dated August 11, 2014 recommending amendment to the Urban Design Manual to include "Planning Around Rapid Transit Stations (PARTS) Design Brief' for the purpose of establishing design guidelines for the Central Transit Corridor and rapid transit Station Study Areas. Mr. B. Sloan, Ms. L. Ross and Ms. D. Lafferty presented the report and responded to questions from the Committee. On motion by Councillor B.Vrbanovic- it was resolved: "That the City-initiated amendment to Part B of the Urban Design Manual for the purpose of establishing design guidelines for the Central Transit Corridor and rapid transit Station Study Areas in Kitchener, be approved, in the form shown in the attached "Planning Around Rapid Transit Stations (PARTS) Design Brief' attached as Appendix A to Community Services Department report CSD-14-088." 11. CSD-14-089 - PARTS PHASE 2: TRANSPORTATION DEMAND MANAGEMENT STRATEGY(TDM) The Committee considered Community Services Department report CSD-14-089, dated August 11, 2014 recommending approval of Planning Around Rapid Transit Stations (PARTS) Phase 2 Transportation Demand Strategy Management(TDM)Strategy for the Central Transit COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE SEPTEMBER 8. 2014 -58 - CITY OF KITCHENER 11. CSD-14-089 - PARTS PHASE 2: TRANSPORTATION DEMAND MANAGEMENT STRATEGY(TDM) (CONT'D) Corridor and rapid transit Station Study Areas in Kitchener. Ms. L. Nelson and Messers J. Readman and J. Joseph presented the report and responded to questions from the Committee. Questions were raised regarding the emphasis on sidewalks in the TDM Strategy and how staff are trying to manage the challenges of sidewalk infill projects. Mr. Readman advised that staff will be hosting a public information session prior to the end of 2014 to receive resident feedback on the draft Policy. He noted staff anticipate bringing forward a follow-up report on the new Policy in January 2015. In response to questions regarding parking rates in the Downtown for seniors and students, Mr. Readman advised that parking rates have been established for short durations, which permits two hour parking in the Downtown. He added that staff have investigated different rate structures for various parking areas and anticipate bringing forward a report as part of the 2015 Budget process. Councillor P. Singh left the meeting at this time. Councillor D. Glenn-Graham left the meeting at this time. The following motion was voted on and was Carried Unanimously on a recorded vote, by all members present. On motion by Councillor B.Vrbanovic- it was resolved: "That the "Planning Around Rapid Transit Stations (PARTS) Phase 2 Transportation Demand Management (TDM) Strategy", attached as Appendix A to Community Services Department report CSD-14-089, be approved to establish TDM strategies for the Central Transit Corridor and rapid transit Station Study Areas in Kitchener." 12. CSD-14-090 - PARTS PHASE 2: SUMMARY AND CENTRAL STATIONS STUDY AREA PLAN/SECONDARY PLAN LAUNCH The Committee considered Community Services Department report CSD-14-090, dated August 20, 2014 regarding an update and project summary of Planning Around Rapid Transit Stations (PARTS) Phase 2 Project Summary. Mr. B. Sloan presented the report and responded to questions from the Committee. Councillor D. Glenn-Graham re-entered the meeting at this time. 13. INS-14-022 - TRAIL CROSSING AND ACCESS CONTROL The Committee considered Infrastructure Services Department report INS-14-022, dated August 22, 2014 regarding funding options and implementation of primary trail entrances and road crossings. Messers M. Parris, D. Ritz and J. Witmer presented the report and responded to questions from the Committee. A motion was brought forward by Councillor Y. Fernandes to defer consideration of the recommendation contained in Report INS-14-022 to the September 15, 2014 Council meeting to allow time for the Cycling Advisory Committee to review the report. On motion by Councillor Y. Fernandes- it was resolved: "That consideration of the following motion contained in Community Services Department report CSD-14-095, be deferred to the September 15, 2014 Council meeting to allow the Cycling Advisory Committee to review the report and provide feedback on the recommendation: COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE SEPTEMBER 8. 2014 -59 - CITY OF KITCHENER 13. INS-14-022 - TRAIL CROSSING AND ACCESS CONTROL(CONT'D) `That the Primary Trail entrances and road crossings be referred to the 2015-2024 capital budget process;and further, That the Cycling and Trails Advisory Committee be consulted to develop a hierarchy of trail entrances and crossings within the Priority A' - Primary Trail Networks, and be consulted in the implementation of all Primary Trail entrances and road crossings, as outlined in Infrastructure Services Department report INS- 14-022. 14.
