The Planning and Strategic Initiatives Committee met this date, commencing at 6:30 p.m.

CSD-14-027 - COMPREHENSIVE REVIEW OF THE ZONING BY-LAW (CROZBY)

- PROCESS AND COMMUNICATIONS APPROACH
The Committee considered Community Services Department report CSD-14-027, dated April
17, 2014 recommending the process for staff to utilize for conducting a comprehensive review
of the City’s Zoning By-law (CRoZBy), as outlined in the Report.
Ms. N. Goss presented the Report advising of the work plan for the comprehensive review of
the Zoning By-law and gave a timeline for the phases of the project as well as public
consultation. She described the scope of the review and the processes that will be undertaken
during each phase of the work plan and indicated that staff is requesting endorsement of the
processes as detailed in the Report.
In response to questions, Ms. Goss advised that a variety of methods and format for public
consultation spanning the existing and new term of Council will be provided as an opportunity
to comment on drafts of the Zoning By-law.
On motion by Councillor Z. Janecki -
it was resolved:
Carried.
“That staff be directed to conduct a review of the City’s Zoning By-law 85-1 generally in
accordance with the process outlined in Community Services Department report CSD-
14-027.”
The meeting recessed at 6:46 p.m. and reconvened at 7:00 p.m.
The Chair read aloud the following statement:
“This is a formal public meeting to consider applications under the Planning Act. If a person or
public body does not make oral or written submissions to the City of Kitchener before the
proposed applications are considered, the person or public body may not be entitled to appeal
the decision to the Ontario Municipal Board and may not be added as a party to a hearing of
an appeal before the Ontario Municipal Board.”

The Committee considered Community Services Department report CSD-14-008, dated April
15, 2014 recommending approval of Draft Plan of Subdivision 30T-08201 and Zone Change
Application ZC13/14/H/JVW for lands located on Amand Drive, in the northwest quadrant of
Huron Road and Fischer Hallman Road.

Ms. J. vonWesterholt presented the Report advising the lands are within the Rosenberg
Secondary Plan and received draft plan of subdivision approval in July 2012. She indicated
that the applicant have since acquired the parcel located at 1705 Huron Road, located in the
southwesterly corner of the property, which are zoned A1, and are being assembled for storm
water management purposes. She stated that the applicant is seeking a change in zoning
from Open Space (P-2) to (R-6) Residential Six with Special Regulations, to accommodate a
row of residential lots that where displaced by the storm water management design. She
indicated that Area 3 will incorporate a trail connections and parkland which require rezoning to
(P-1) Public Park. In addition, she noted that Holding Provision 66H was placed on a small
portion of the plan of subdivision which required completion and approval of a noise study that
has since received approval by the Region of Waterloo and can be lifted.
On motion, Councillor K. Galloway-Sealock the recommendation within Community Services
Department report CSD-14-008 was brought forward for consideration.
Councillor Y. Fernandes expressed concern with the zone change in Area 2 that would permit
intensification by 10 residential units within the Plan of Subdivision. She requested that the
portion of Councillor Galloway-Sealock’s motion pertaining to Area 2 be voted on separately.
In accordance with Councillor Fernandes’ request, the zone change applicable to Area 2, from
Open Space (P-2) to Residential Six (R-6) with Special Regulations, was voted on and was
Carried.
On motion by Councillor -
it was resolved:
“That Zone Change Application ZC13/014/H/JVW (Tru–Villa Inc. and 2040796 Ontario
Limited (Mattamy Homes)) requesting a change in zoning from Agriculture (A-1) ,Open
Space (P-2), Residential Four (R-4) with Special Regulations and Residential Six with
Special Regulations and Holding Provision 66H to Open Space (P-2), Residential Six
(R-6) with Special Regulations 604R, 606R and 612R, and Public Park (P-1) Zone and
removal of Holding Provision 66H be approved in the form shown in the ‘Proposed By-
law’ dated April 28, 2014, attached to Community Services Department report CSD-14-
008 as Appendix ‘B’.”
CSD-14-032 - CITY-INITIATED OFFICIAL PLAN AMENDMENT – OP14/02/COK/GS

- PLANNING AROUND RAPID TRANSIT STATIONS (PARTS)
- PHASE 2: INTERIM DIRECTION IMPLEMENTATION
The Committee considered Community Services Department report CSD-14-032, dated April
24, 2014 recommending that City-initiated Official Plan Amendment OP14/02/COK/GS, as
shown in report CSD-14-032 as Appendix ‘A’ be adopted, and accordingly forwarded to the
Region of Waterloo for approval.
Councillor P. Singh declared a pecuniary interest as his family owns property in the affected area. In
addition, Councillor B. Ioannidis declared a pecuniary interest as he owns property in the subject area;
and accordingly, neither took take part in any discussion or voting regarding the matter.
Ms. T. Malone-Wright presented the Report advising that the purpose of the proposed
amendment is to implement new policies to provide interim policy framework for reviewing
development applications until the PARTS project is completed in 2017. She stated that the
approach is to add a Special Policy Area to the current Official Plan located in the vicinity of
rapid transit Station Study Areas with in the Central Transit Corridor, which recognizes that not
all lands within the identified area are appropriate for redevelopment and intensification. She
reviewed the policies which focus on Transit Orient Development (TOD) to ensure
development within the Special Policy Area will support existing and planned transit service
levels that is both pedestrian and transit friendly; Conversion of Employment Land to allow
lands designated for industrial purposes in the rapid transit station areas for consideration to

potential transition to other non-employment areas; Stable Residential Neighbourhoods which
provides support for protection of these stable areas. She referred to community engagement
and indicated that comments received are contained within the Report and advised that all
comments were responded to via email correspondence.
In response to questions regarding the comments received, Ms. Malone-Wright indicated that
staff is not aware of any issues that remain outstanding. She added that there have not been
any overarching concerns related to the impact of the policies on the existing neighbourhoods.
Mayor C. Zehr questioned if assurances are within the By-law that protect development rights
for existing businesses. Ms. Malone-Wright responded that as current zoning is not changing
through the proposed amendment, development rights are not impacted. She then referred to
a comment received from a business owner related to a site plan application for an auto-
oriented and indicated that the site plan has been able to proceed under current zoning. She
clarified that Station Area plans will be reviewed at a future date and will require a full public
consultation process.
Generally, members expressed support for flexibility of the recommended interim policies,
particularly those that protect established neighbourhoods.

The following motion was then voted on and was by all members
present save and except Councillors P. Singh and B. Ioannidis who had declared Pecuniary
Interest, and accordingly did not vote.
On motion by Councillor Z. Janecki -
it was resolved:
“That City-initiated Official Plan Amendment OP14/02/COK/GS to implement interim
policy direction for the Central Transit Corridor and Rapid Transit Station Study Areas in
Kitchener by adding Special Policy Area 52 in Part 3, Section 12 and on proposed Map
23 of the Official Plan, be adopted, in the form shown in the proposed Official Plan
Amendment attached to Community Services Department report CSD-14-032 as
Appendix ‘A’, and accordingly forwarded to the Region of Waterloo for approval.”
