Anderl, Senior Planner D. Livingstone, Committee Administrator FCS-14-080 - E-SERVICES STRATEGY UPDATE 1. The Committee considered Finance and Corporate Services Department report FCS-14-080, dated June 12, 2014 recommending that Council receive the e-Services roadmap as a component of the Corporate Customer Service Strategy Phase 2, and direct staff to proceed with various e-Services actions. Mr. D. Murray presented the Report. In response to questions from the Committee, Mr. Murray advised that the PingStreet Mobile Application will be formally launched on July 3, 2014 with full implementation of the “Report a Problem” PingStreet tile. He explained that upon submission of a problem through the application, a message is displayed that confirms receipt and provides a link to the City’s website to gain more information relative to customer expectations to establish a timeline for resolution. He stated that full efficiencies of the PingStreet Mobile Application will not be realized until the new Customer Relationship Management (CRM) program which is subject to 2015 budget deliberations, has been acquired and implemented. In response to further questions, Mr. Murray agreed to provide definitive information on resolution timelines and whether staff would respond to problems reported through the “Report a Problem” tile by email subsequent to receiving notification of receipt and link to the information on the City’s website. Members expressed support for the implementation of the PingStreet Mobile Application and anticipated efficiencies to be gained through the joint application of the CRM which would enable two-way communication between City staff and citizens. Members suggested increased usage potential such as providing information on storms and hydro outages, as well as turf and grass maintenance. On motion by Councillor B. Ioannidis - it was resolved: “That the e-Services Roadmap as a component of the Corporate Customer Service Strategy Phase 2 be received, as outlined in Finance and Corporate Services report FCS-14-080 and staff be directed to proceed with the following priority e-Services actions: Internet website improvements to better promote and improve access to existing e-Services and mirror PingStreet “Report a Problem” categories to our website e-Service offerings; and, Parking systems review to enable parking exemption capabilities and parking complaints e-Services; and further, Examine additional e-Services through the existing AMANDA public portal product” PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 23, 2014 -35- CITY OF KITCHENER CSD-14-004 - DRAFT PLAN OF SUBDIVISION - 30T-11205 2. - ZONE CHANGE APPLICATION - ZC11/14/W/GS - 250 WOOLWICH STREET, JOE SESTAN Councillor B. Vrbanovic read aloud the following statement: “This is a formal public meeting to consider applications under the Planning Act. If a person or public body does not make oral or written submissions to the City of Kitchener before the proposed applications are considered, the person or public body may not be entitled to appeal the decision to the Ontario Municipal Board and may not be added as a party to a hearing of an appeal before the Ontario Municipal Board.” The Committee considered Community Services Department report CSD-14-004, dated May 16, 2014 for the lands located at 250 Woolwich Street. The Report recommends approval of a Draft Plan of Subdivision and Zone Change Application, exemptions to the City’s Sidewalk Policy for Old Cottage Place and Old Cottage Close, as well as exemptions to the City’s Emergency Services Policy to allow for one emergency access to serve two cul-de-sacs. Mr. B. Bateman presented the Report. With regard to the proposed upgrade and extension of Old Cottage Place Laneway during Stage 1 of the development, members expressed concern for the preservation of trees that would be impacted during installation of a sanitary sewer. Mr. Bateman acknowledged that it is likely that the root systems of approximately 15 trees would be impacted by the installation; however, he explained that in order to address this concern, a detailed screening plan has been requested as a condition to the draft plan approval. Mr. Hugh Handy, GSP Group, appeared on behalf of Mr. Sestan in support of staff’s recommendation. Mr. Handy provided background for the proposal stating that the subject lands are identified as “Priority A” in the Kitchener Growth Management Plan for growth and intensification. He indicated that the extension of services was suggested by Engineering staff who encouraged providing sanitary sewer connections to existing homes. With regard to tree management, Mr. Handy indicated that a considerable buffer will be provided and noted that the proposed lots are considerably deep with a number of existing trees. Ms. Luella Kains, Resident, appeared in opposition to the recommendation urging staff to creatively amend the proposal in order to save the trees impacted by the development. She requested that staff re-examine the location of the sanitary sewer in order to save the trees and noted that the existing subdivision adjacent to the subject lands has 11 services lots with only 4 homes built to date. Mr. A. Pinard responded to questions advising that provisions in the Site Plan Approval Process allow staff to request trees of substantial caliper to replace trees that are lost during development. A motion was brought forward by Councillor S. Davey to refer this matter to the Council meeting of June 30, 2014 in order that staff examines strengthening the conditions related to tree preservation or replacement. At the suggestion of Councillor Z. Janecki, Councillor Davey’s motion was modified to include examination of reducing the lot widths of lots six and ten in order to preserve the tree line. In addition, Councillor F. Etherington suggested that the deferral include information from staff on whether the subject lands would be considered during the Cultural Heritage Landscape Study. Councillor Davey agreed to include this request in his motion. Councillor B. Vrbanovic suggested that staff examine whether adjoining neighbours are willing to purchase property to protect the treeline and return with that information in the coming week. Davey - it was resolved: “That consideration of the recommendation contained in Community Services be referred to the Department report CSD-14-004 pertaining to 250 Woolwich Street, June 30, 2014 Council meeting , to allow staff time to gain additional information related to tree preservation and replacement on the subject lands and to determine if the property is included in the Cultural Heritage Landscape Study: That Zone Change Application ZC/11/14/W/GS (J. Sestan) requesting a change in zoning from Agricultural Zone (A-1) with Special Regulation Provisions and Property Detail to Residential Three (R-3), Residential Six (R-6) and Open Space (P-2) with Special Regulations and Property Detail be approved in the form shown in the ‘Proposed By-law’ dated, May 2014 attached to Community Services Department report CSD-14-004 as Appendix ‘B’; and, That the City of Kitchener grant an exemption to the City’s Sidewalk Policy I-1120 to have no sidewalk on the east side of Old Cottage Place; no sidewalk on Old Cottage Close, and that no sidewalk be extended along on the west side of Old Cottage Place where it currently terminates at 18 Old Cottage Place; and, That the City of Kitchener grant an exemption to the City’s Emergency Services Policy I- 1035 to allow for one emergency access to serve two cul-de-sacs instead of the required one cul-de-sac; and further, That the City of Kitchener, pursuant to Section 51(31) of the Planning Act R.S.O. 1990, Chapter P13 as amended, and delegation by-law 2002-64, grant draft approval to Plan of Subdivision Application 30T-11205, in the City of Kitchener, for Sestan Building Group, subject to the conditions outlined in Report CSD-14-004.” CSD-14-051 - DRAFT PLAN OF SUBDIVISION - 30T-08206 3. - OFFICIAL PLAN AMENDMENT - OP14/05/B/JVW - ZONE CHANGE APPLICATION - ZC08/35/B/JVW - WILLIAMSBURG SOUTH NEIGHBOURHOOD, IAN COOK CONSTRUCTION -AND- CSD-14-052 - DRAFT PLAN OF SUBDIVISION - 30T-09201 4. - ZONE CHANGE APPLICATION - ZC09/04/F/JVW - WILLIAMSBURG SOUTH NEIGHBOURHOOD, BIG SPRINGS FARMS LIMITED The Committee considered Community Services Department report CSD-14-051, dated June 4, 2014 recommending approval of a Draft Plan of Subdivision, Official Plan Amendment and Zone Change Application from Ian Cook Construction for South Estates G. P. Kitchener INC. and South Estates Kitchener Limited Partnership and simultaneously considered Community Services Department report CSD-14-052, dated June 4, 2014 recommending approval of a Draft Plan of Subdivision and Zone Change Application for Big Spring Farms. In addition, the Committee was in receipt this date of a revised “Proposed By-law” for Report CSD-14-052; a presentation from Mr. C. Pigeon on behalf of Big Springs Farms; and, correspondence from Mr. C. Tzekas, WeirFoulds, dated June 23, 2014. Ms. J. vonWesterholt gave a presentation detailing both Reports. Members requested elaboration on the environmental protections measures undertaken as part of the studies submitted for the proposed developments. Ms. vonWesterholt assured the Committee that the required approvals have been obtained from the Grand River Conservation Authority and studies have been submitted to the Ministry of Natural Resources as required. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 23, 2014 -37- CITY OF KITCHENER CSD-14-051 - DRAFT PLAN OF SUBDIVISION - 30T-08206 3. - OFFICIAL PLAN AMENDMENT - OP14/05/B/JVW - ZONE CHANGE APPLICATION - ZC08/35/B/JVW - WILLIAMSBURG SOUTH NEIGHBOURHOOD, IAN COOK CONSTRUCTION -AND- CSD-14-052 - DRAFT PLAN OF SUBDIVISION - 30T-09201 4. - ZONE CHANGE APPLICATION - ZC09/04/F/JVW - WILLIAMSBURG SOUTH NEIGHBOURHOOD, BIG SPRINGS FARMS LIMITED (CONT’D) With regard to parking within the proposed sites, Ms. vonWesterholt agreed to follow-up with Councillor P. Singh regarding the ability of the proponent to accommodate the parking requirements within the proposed draft plans of subdivision. Mr. Christopher Tzekas, WeirFoulds, appeared on behalf of the West Side Property Owners Group. Mr. Tzekas requested deferral of the planning matters to allow discussions to take place amongst all parties in order to resolve the concerns detailed in the correspondence distributed this date. Mr. Paul Britton, MHBC Planning, appeared on behalf of Activa Group stating that his client owns property east of the subject lands. He expressed concerns that the proposed plan will fix the intersection at Rosenberg Way and indicated that Activa would support participation to finalize the design of the intersection. He expressed exception to the conditions related to the extension of the Middle Strasburg Sanitary Trunk Sewer EA within the Reports CSD-14-052 and CSD-14-051 which state “or any addendum hereto” as the Draft Approval should be implemented in accordance with the approved Environmental Study Report and not to any contemplated addendum. He elaborated that Rosenberg Way is a ‘Schedule C’ road and should have been subject to a Class Municipal Environmental Assessment. Mr. E. Riek responded to questions regarding the alignment of the Middle Strasburg Sanitary Trunk Sewer advising that the EA was approved prior to completion of the Rosenberg Secondary Plan. He indicated that as the road network and plans of subdivision are finalized, the location of the Trunk Sewer may be shifted slightly to follow the roadway and potentially reduce depths. He noted that an addendum to the EA would not be required and that a technical memo completed by a consultant would be sufficient to complete this shift as the intent of the EA would remain unchanged. Mr. Chris Pigeon, GSP Group, appeared on behalf of Big Springs Farms, and noted that the technical team was in attendance to answer questions. He referred to the presentation distributed this date and gave an overview of the plan of subdivision and proposed vision as an adult oriented master planned community. He detailed the proposed landuses and stated that the design is based on healthy lifestyle, social interaction, alternative transportation, urban streetscape and connectivity. He indicated the subject lands are ‘Priority B’ and the plan conforms to the Rosenberg Secondary Plan. He referred to the presentation noting that the heritage vista is preserved between the Henhoeffer House and the Schoolhouse located in the proposed plan, as suggested by Heritage Kitchener. With regard to the submission provided by Mr. Tzekas, he indicated that over 30 meetings have taken place between the development group and Mr. Tzekas clients. Members expressed concern that Fischer-Hallman Road would be widened to four lanes, thereby impeding pedestrian crossing. Mr. Pigeon explained that the Fischer-Hallman Road is underway and the Plan contemplates a pedestrian connection under Fischer-Hallman Road with additional land to be provided by Big Springs Farms if required. Mr. Kevin Fergin, Stantec, was in attendance to respond to questions regarding the Middle Strasburg Sanitary Trunk Sewer alignment which is required to be advanced to service the subject lands. He explained the diagrams detailed within the package distributed this date by Mr. Pigeon as well as the location and impact to the perched watertable as approved by GRCA. Mr. Pigeon noted that that his clients are satisfied with staff’s recommendation at this time and may revisit certain conditions through the detailed design phase. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 23, 2014 -38- CITY OF KITCHENER CSD-14-051 - DRAFT PLAN OF SUBDIVISION - 30T-08206 3. - OFFICIAL PLAN AMENDMENT - OP14/05/B/JVW - ZONE CHANGE APPLICATION - ZC08/35/B/JVW - WILLIAMSBURG SOUTH NEIGHBOURHOOD, IAN COOK CONSTRUCTION -AND- CSD-14-052 - DRAFT PLAN OF SUBDIVISION - 30T-09201 4. - ZONE CHANGE APPLICATION - ZC09/04/F/JVW - WILLIAMSBURG SOUTH NEIGHBOURHOOD, BIG SPRINGS FARMS LIMITED (CONT’D) Mr. Peter Smith appeared on behalf of South Estates in support of staff’s recommendation for approval of the draft plan of subdivisions and associated Official Plan Amendment and Zone Change. He addressed the issues stated by Mr. Tzekas, stating that the development plans have received input and involvement from all parties through the all stages. He noted that the Plan of Subdivision was submitted in 2008 and numerous complex issues have been resolved to date. In response to questions, Mr. Smith stated that South Estates Plan of Subdivision would proceed concurrently or subsequent to the development of Big Springs Farms, as noted in the conditions. The following motion contained within Community Services Department report CSD-14-051, South Estates G.P. Kitchener Inc. and South Estates Kitchener Limited Partnership, was then Carried Unanimously voted on and was on a recorded vote. On motion by Councillor K. Galloway-Sealock - it was resolved: “That Official Plan Amendment Application OP/14//B/JVW (South Estates G.P. Kitchener INC. and South Estates Kitchener Limited Partnership) requesting a change in the land use designation from Low Density Residential One to Neighbourhood Park, in the form shown in the proposed Official Plan Amendment attached to Community Services report CSD-14-051 as Appendix ‘A’ be adopted and forwarded to the Region of Waterloo for approval; and, That Zone Change Application ZC/08/35/B/JVW (South Estates G.P. Kitchener INC. and South Estates Kitchener Limited Partnership) requesting a change in zoning from Agricultural Zone (A-1) to Residential Six Zone (R-6), Community Institutional Zone (I- 2), Public Park Zone (P-1), Open Space Zone (P-2), Hazard Zone (P-3) in the form th shown in the ‘Proposed By-law’ dated June 4, 2014, attached to Community Services Department Report CSD-14-051 as Appendix ‘B’ be approved; and further, That the City of Kitchener, pursuant to Section 51(31) of the Planning Act R.S.O. 1990, Chapter P13 as amended, and delegation by-law 2002-64, grant draft approval to Plan of Subdivision Application 30T-08206, in the City of Kitchener, (South Estates G.P. Galloway-Sealock - it was resolved: “That Zone Change Application ZC/09/04/F/JVW (Big Springs Farms Limited) requesting a change in zoning from Agricultural Zone (A-1) to Residential Six Zone(R- 6), Residential Eight Zone (R-8), Residential Nine Zone (R-9), Mixed Use One Zone, Community Institutional Zone (I-2), Public Park Zone (P-1), Open Space Zone (P-2), Hazard Lands (P-3) in the form shown in the revised ‘Proposed By-law’ distributed June 23, 2014 be approved; and further, That the City of Kitchener, pursuant to Section 51(31) of the Planning Act R.S.O. 1990, Chapter P13 as amended, and delegation by-law 2002-64, grant draft approval to Plan of Subdivision Application 30T-09201, in the City of Kitchener, for Big Springs Farms Limited, subject to the conditions outlined in Community Services Department report CSD-14-052.” CSD-14-049 - OFFICIAL PLAN AMENDMENT – OP13/04/E/KA 5. - ZONING BY-LAW AMENDMENT – ZC13/15/E/KA - 83 ELMSDALE DRIVE, CITY OF KITCHENER / NOVACORE COMMUNITIES CORPORATION The Committee considered Community Services Department report CSD-14-049, dated May 26, 2014 recommending approval of an Official Plan Amendment and Zone Change Application for 83 Elmsdale Drive. Ms. K. Andrel presented the Report. Ms. Andrel responded to questions, stating that the proposed development is a walkable community and elaborated that the Urban Design Brief has a focus on pedestrian circulation with linkages to parks and pedestrian islands. Members expressed concern with traffic flow and indicated that traffic signals should be considered and noted concern about access to McLennan Park across Ottawa Street. Ms. Andrel stated that the Traffic Impact Study did not warrant signalization and indicated that turning lanes have been proposed. Councillor P. Singh indicated he would like the development to return to Council during the development process. Ms. Andrel explained that the Site Plan Approval process is not a public process and that the proposed Urban Design Brief is before the Committee this date to give strength to existing policies. Mr. Pinard elaborated that if significant changes are proposed during the Site Plan Approval process which requires modifications to the Urban Design Brief, the matter would return for the consideration of Council. He noted that the Urban Design Brief is comparable in detail to a draft plan of subdivision application and would be implemented as outlined. Mayor C. Zehr suggested that an additional clause be added to the recommendation within Report CSD-14-049 directing staff to consider a more comprehensive review of pedestrian and traffic movement at the Elmsdale and Ottawa Street Intersection and mid-block intersection with Ottawa Street. Mr. Tony DiFuscio, NovaCore Communities, appeared in support of staff’s recommendation. He described the success of NovaCore and commended the City of Kitchener for leadership in brownfield remediation. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 23, 2014 -40- CITY OF KITCHENER CSD-14-049 - OFFICIAL PLAN AMENDMENT – OP13/04/E/KA 5. - ZONING BY-LAW AMENDMENT – ZC13/15/E/KA - 83 ELMSDALE DRIVE, CITY OF KITCHENER / NOVACORE COMMUNITIES CORPORATION (CONT’D) Ms. Heather Holbrook, GSP Group, gave a presentation in support of the subject applications. She indicated that a holistic approach to development has been proposed, noting that the development would be phased in over time. With regard to a signalized crossing to access McLennan Park, she requested support from the Committee with the next step being to seek Regional approval. Carried Unanimously, A motion was brought forward by Councillor P. Singh and was that pursuant to Section 25.4.11 of Chapter 25 (Council Procedure) of the Municipal Code, the proceedings of the Committee this date shall be allowed to continue beyond 11:00 p.m. to conclude matters as listed on the agenda. On motion by Councillor P. Singh the recommendation contained within report CSD-14-049 was brought forward for consideration with an added clause for staff to consider a more comprehensive review of the vehicle and pedestrian movement On motion by Councillor P. Singh - it was resolved: “That Official Plan Amendment Application OP13/04/E/KA for City of Kitchener (83 Elmsdale Drive) requesting a change in designation from Municipal Services and Public Utilities District to Neighbourhood Mixed Use Centre with Special Policy 54 to permit a mixed use development on the parcel of land specified and illustrated as the ‘Area of Amendment’ on Schedules ‘A’ and ‘A1’, in the form shown in the Official Plan Amendment attached to Community Services Department report CSD-14-049 as Appendix ‘A’ be adopted, and accordingly forwarded to the Region of Waterloo for approval; and, That Council request that the Regional Municipality of Waterloo amend section 15.D.12 of the Final New Official Plan to add a new Site Specific Policy (to be numbered accordingly) and in the form shown on the ‘Amendment to Final New Official Plan’; to amend Map 2 to identify as Neighbourhood Node the parcel of land specified an illustrated as the ‘Area of Amendment’ on Schedule I; to amend Map 3 to change the designation from Major Infrastructure and Utilities to Mixed Use for the parcel of land specified an illustrated as the ‘Area of Amendment’ on Schedule II; and to amend Map 5 to add a new Site Specific Special Policy to the lands to permit a mixed use development on the parcel of land specified an illustrated as the ‘Area of Amendment’ on Schedule III, all as attached to Community Services Department report CSD- 14-049 as Appendix ‘B’; and, That Zone Change Application ZC13/15/E/KA for the City of Kitchener (83 Elmsdale Drive) requesting a change from General Industrial Zone (M-2) to Neighbourhood Shopping Centre Zone (C-2) with Special Regulation Provision 649R, Special Use Provision 436U and Holding Provision 71H on the parcel of land specified and illustrated as the ‘Subject Area’ on Map No. 1, in the form shown in the ‘Proposed By-law’ dated May 20, 2014, attached to Report CSD-14-049 as Appendix ‘C’ be approved; and, That the Urban Design Guidelines for 83 Elmsdale Drive, dated May 8, 2014, and attached to Report CSD-14-049 as Appendix ‘E’, be adopted, and that staff be directed to apply the Urban Design Guidelines through the Site Plan Approval process; and further, That staff be directed to give consideration to a more comprehensive review of the vehicle and pedestrian movement at the Elmsdale and Ottawa Street intersection and the mid-block intersection with Ottawa Street, through the Site Plan Approval process.” PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES JUNE 23, 2014 -41- CITY OF KITCHENER ADJOURNMENT 6.
