That all options for locating the mechanical equipment be examined and a preferred option that minimizes the physical and visual impact be approved by heritage planning staff prior to issuance of a building permit; and, 2. That the final building permit drawings be reviewed and heritage clearance provided by heritage planning staff prior to the issuance of a building permit. BACKGROUND: The Community Services Department is in receipt of Heritage Permit Application HPA-2014-IV- 028 which is seeking permission to construct a deck and install a door and mechanical equipment on the rear elevation of the property municipally addressed as 191 King Street West. REPORT: The subject property is located on King Street West directly across the street from Kitchener City Hall and is commonly known as the Public Utilities Commission (PUC) building. The property is designated under Part IV of the Ontario Heritage Act and subject to a heritage conservation easement agreement. The designating by-law identifies the exterior of the building, in particular the King and Gaukel Street facades. The purpose of the alterations is to facilitate the conversion of the main floor of the building to a restaurant. The deck will provide an outdoor entertainment area, the door will provide access from the main restaurant to the outdoor entertainment area and the mechanical equipment is required for the kitchen. The deck will be 20 feet by 45 feet in size, extending across the entire width of the rear elevation of the building and cantilevering over the existing ramp and parking lot. The deck will be constructed with steel, concrete and tempered glass. All steel components will be powder coated grey to complement the limestone of the building. A concrete slab will be used for the floor. Steel and tempered glass will be used for the railing. The door will be installed within the existing window opening on the far right side of the rear elevation of the building. The door will be fully glazed with an aluminum frame to match the existing windows. The plans show the mechanical equipment exiting the rear elevation between the first and second floor and extending to the roof. Heritage Planning and Urban Design staff have expressed concern with the visual impact of the mechanical equipment to the exterior of this important and prominent building in the downtown. Staff have requested the applicant to examine alternatives that avoid or minimize the visual impacts. At minimum, these alternatives should consider location (e.g. interior versus exterior; internal side yard versus rear yard), size (e.g. two storey vent with hood versus hood only) and colour (e.g. raw steel versus powder coated grey to complement the limestone of the building). In particular, staff have requested the applicant to examine internal alternatives that use the plumbing space behind the washrooms or that create a new shaft from the main floor to the roof. The applicant has agreed to have this information available for the September 30th Heritage Kitchener committee meeting. In reviewing the merits of the application, City staff note the following: 3 - 2 ■ The exterior of the building is identified as a heritage attribute; however, the designating by- law and the heritage conservation easement place specific emphasis on the King and Gaukel Street facades; ■ No alterations are proposed to the King and Gaukel Street facades; ■ The deck will be located on the rear elevation and designed with colours and materials to soften the visual impact and complement the limestone of the building; ■ Physical impacts to the building will be minimized because only the concrete piers supporting the deck will be attached to the foundation of the building; ■ The existing window opening will not be altered; ■ The door will be installed in the existing window opening and designed with materials that match the existing windows; ■ The applicant has agreed to examine alternatives for the mechanical equipment; and, ■ The deck and door will not detract from the character of the building. As a result, Heritage Planning staff are of the opinion that the construction of the deck and installation of a door will not impair or negatively impact the significance of the property. Heritage Planning staff are also of the opinion that concerns regarding the impact of mechanical equipment can be addressed through a condition. Heritage Permit Applications also support the Development Community Priority to honour and protect our heritage.
