Livingstone, Committee Administrator 1. CSD-14-101 - HERITAGE PERMIT APPLICATION HPA 2014-V-026 - 1112 DOON VILLAGE ROAD - PROPOSED DEMOLITION OF BUILDINGS -AND - 2. CSD-14-106 - HERITAGE PERMIT APPLICATION HPA 2014-V-027 - 1094 DOON VILLAGE ROAD - PROPOSED DEMOLITION OF BUILDINGS The Committee considered Community Services Department report CSD-14-101, dated September 15, 2014 recommending approval of Heritage Permit Application HPA 2014-V-026 to permit the demolition of the existing single detached dwelling, attached garage and shed at the property municipally addressed as 1112 Doon Village Road. The Committee also considered report CSD-14-106, dated September 15, 2014 recommending approval of Heritage Permit Application HPA 2014-V-027 to permit the demolition of the existing single detached dwelling, attached garage and shed at the property municipally addressed as 1094 Doon Village Road. In addition, the Committee was in receipt this date of correspondence dated September 30, 2014 from Mr. Richard Haalboom regarding 1112 Doon Village Road and 1094 Doon Village Road. Ms. M. Drake gave a presentation detailing the proposals stating that the Upper Doon Heritage Conservation District Plan (UDHCD) contains policies with regard to the demolition of non- historic buildings. She explained that the UDHCD does not give a presumption against demolition of a building where there are few or no complementary architectural or historical features on the non-historic building and elaborated that the composition of a new building will be encouraged to reflect the tone of the historic district. She indicated that the applicants each intend to submit Heritage Permit Applications for new single detached dwellings on each property in the future. She stated that the applicant from 1094 Doon Village Road also intends to apply for a severance through the Committee of Adjustment to convey a lot addition to the adjacent lands at 1112 Doon Village Road in order that both lots meet minimum lot frontages of 30.48 meters, a requirement of the Upper Doon Heritage Conservation District Plan and Zoning By-law. She reviewed the merits of both applications and stated that Heritage Planning staff are of the opinion that the demolition of the existing single detached dwellings, attached garages and sheds will not impair or negatively impact the significance of the UDHCD or the Doon Village Road streetscape. She indicated that the UDHCD representative was consulted and no concerns were expressed regarding the proposed demolitions. Mr. G. Zeilstra advised that Messrs. Vincent Robitaille and Paul Bostajian were in attendance to respond to questions from the Committee. Mr. K. Kirby expressed concerns that the demolition would change the character of the village of Doon. Ms. Kae Elgie addressed the Committee providing a cautionary anecdote regarding the subject applications and the negative impact the demolitions may have on the character of the village. Members expressed concern with approval of the demolition without having seen the applicants' redevelopment applications, particularly as Appendix 1 attached to Heritage Permit Application 2014-V-026 proposes development of a 4,500 sq. ft. house with a four car garage. Ms. Drake clarified the process advising that once an application is received, it would be circulated to the UDHCD representative for comment. She further advised that if the Representative does not have any concerns with the proposal, and upon the recommendation HERITAGE KITCHENER SEPTEMBER 30. 2014 -25- CITY OF KITCHENER 1. CSD-14-106 - HERITAGE PERMIT APPLICATION HPA 2014-V-027 - 1094 DOON VILLAGE ROAD - PROPOSED DEMOLITION OF BUILDINGS (CONT'D) from staff, it would be approved. She elaborated that the applicants had wanted to attain approval for the demolitions before proceeding further with the redevelopment process. Mr. Zeilstra indicated he was in receipt of comments from Ms. A. Hooykaas who was not in attendance this date. Mr. Zeilstra read the comments which expressed concern with the size of the garage and impact to the streetscape on Doon Village Road. A motion was brought forward by Mr. Kirby to not permit the demolition of either 1112 or 1094 Doon Village Road which was then voted on and was lost. On motion by Ms. E. Rudland, the recommendation contained within Report CSD-14-101 for 1112 Doon Village Road was brought forward for consideration. Mr. Stevens advised he would be abstaining from the vote. The motion was then voted on and was lost. Mr. Zeilstra invited Mr. Robitaille and Mr. Bostajian to address the Committee. Mr. Bostajian addressed the concerns of the Committee advising that conceptually the garage would be obstructed from street view due to the layout of the proposed residential dwelling. He further advised that he is seeking approval for the demolition prior to submitting a development application as it is a necessary step in their process prior to applying to the Committee of Adjustment. Mr. Robitaille stated that the current owner of 1122 Doon Village Road has neglected the property and indicated the intent is to redevelop the properties as it is cost prohibitive to adaptively reuse the existing structures. He advised that he is familiar with the criteria within the UDHCD and would use material and a design that is compatible to the neighbourhood. A motion was brought forward by Mr. Kirby to refer consideration of HPA-V-026 for 1112 Doon Village Road to the Heritage Kitchener meeting of November 4, 2014 to allow the applicant to return with additional information on the proposed redevelopment. The motion was then voted on and was lost. On motion by Mr.J. Stevens- it was resolved: "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-V-027 be approved to permit the demolition of the existing single detached dwelling, attached garage and shed at the property municipally addressed as 1094 Doon Village Road, in accordance with the supporting information submitted with the application." Mr. Kirby left the meeting at 5:10 p.m. The meeting continued without quorum present. 3. CSD-14-107 - HERITAGE PERMIT APPLICATION HPA 2014-V-028 - 191 KING STREET WEST - PROPOSED DECK, DOOR AND MECHANICAL EQUIPMENT The Committee considered Community Services Department report CSD-14-107, dated September 12, 2014 recommending approval of Heritage Permit Application HPA 2014-V-028 to permit the construction of a deck and the installation of a door and mechanical equipment on the rear elevation of the property municipally addressed as 191 King Street West. Ms. M. Drake presented the Report. HERITAGE KITCHENER SEPTEMBER 30. 2014 -26- CITY OF KITCHENER 3. CSD-14-107 - HERITAGE PERMIT APPLICATION HPA 2014-V-028 - 191 KING STREET WEST - PROPOSED DECK, DOOR AND MECHANICAL EQUIPMENT(CONT'D) Mr. John Clinkett addressed the Committee in support of the Heritage Permit Application. He referred to the elevation drawings for the proposed restaurant and noted efforts to mitigate physical and visual impact of the mechanical equipment. On motion by Ms. E. Rudland - it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2014-IV-028 be approved to permit the construction of a deck and the installation of a door and mechanical equipment on the rear elevation of the property municipally addressed as 191 King Street West, in accordance with the supporting information submitted with the application subject to the following conditions: i) That all options for locating the mechanical equipment be examined and a preferred option that minimizes the physical and visual impact be approved by heritage planning staff prior to issuance of a building permit; and, ii) That the final building permit drawings be reviewed and heritage clearance provided by heritage planning staff prior to the issuance of a building permit." 4. 1805 OLD HURON ROAD -PROPOSED DEMOLITION OF LISTED BUILDINGS The Committee considered the Notice of Intention to Demolish Listed Buildings municipally addressed as 1805 Old Huron Road. Ms. M. Drake addressed the Committee referring to an Internal Memo dated September 23, 2014 she had prepared and had distributed via email on September 25, 2014, regarding the Notice of Intention to Demolish Listed Buildings 1805 Old Huron Road. She advised that an assessment had been completed by a Heritage Consultant which deemed the property to be on the border of meeting the criteria for listing on the Municipal Heritage Register. She reviewed the site visit noting that there was no evidence of a log house and indicated that the recommendation requests photographs to be taken during removal of the cladding for documentation as well as salvaging the heritage attributes for local rehabilitation projects. Ms. Karen Doehn was in attendance to respond to questions from the Committee. On motion by Ms. S. Thomson - it was resolved: "That the property municipally addressed as 1805 Huron Road does not warrant designation under the Ontario Heritage Act and therefore pursuant to Section 27(1.3)of the Ontario Heritage Act, the property should be removed from the Municipal Heritage Register in order to permit the demolition of the single detached dwelling and barn; and, That the owner be encouraged to carefully remove layers of cladding covering the west annex in order to expose the suspected log house so that Heritage Planning staff may document it with photographs prior to demolition; and further, That the owner be encouraged to salvage the heritage attributes identified in the statement of significance and make them available to companies or individuals who require such materials for local rehabilitation projects." 5. CULTURAL HERITAGE LANDSCAPE STUDY UPDATE The Committee was in receipt this date of a presentation by Mr. L. Bensason regarding the Kitchener Cultural Heritage Landscape Study. Mr. Bensason presented the background of the Study, including the steps that were taken to reach the current status. He indicated that the consultant's report will be considered at the November 4, 2014 Heritage Kitchener meeting. He advised that further details and information is available at www.kitchener.ca/chls.
