INS-14-090 - ON-STREET PARKING REGULATIONS -WATERLOO STREET The Committee considered Infrastructure Services Department report INS-14-090, dated October 21, 2014 recommending approval of a parking prohibition at anytime on the south side of Waterloo Street. Mr. J. Readman reviewed the report, advising that this matter came about in response to concerns with vehicles parking on the roadway which can make two-way traffic unsafe and impede sightlines through the curve. Ms. Lorrie Shantz, area resident, was in attendance and addressed the Committee in opposition to the proposed parking prohibition. She advised that there is very limited parking in this area, adding the City's survey was sent to 16 households and only 9 responses were received. She attributed this low response rate to the number of residents in the area where English is not their first language. She encouraged the City to postpone consideration of this matter to allow for greater public consultation. Mr. Alesandar Kolbas, area resident, was in attendance and addressed the Committee in opposition to the proposed parking prohibition. He stated that he intends to operate an architecture business out of his home and the loss of on-street parking could have a negative impact on his ability to meet with potential clients. In response to questions, Mr. Readman confirmed that vehicle collisions have occurred in the subject section of Waterloo Street and agreed to provide statistics on the exact number of collisions. A motion was brought forward by Councillor S. Marsh to defer consideration of the subject parking prohibition to the February 2, 2015 Community and Infrastructure Services Committee meeting, to allow time for additional public consultation, which should include an option to adjust the parking in the area to improve sightlines leading to the intersection. On motion by Councillor S. Marsh - it was resolved: "That consideration of the following recommendation be deferred to the February 2, 2015 Community and Infrastructure Services Committee meeting, to allow time for additional public consultation,which should include an option to adjust the parking in the area to improve sightlines leading to the intersection: `That the Uniform Traffic By-law be amended so that parking be prohibited at anytime on the south side of Waterloo Street from Shanley Street to a point 65 metres west thereof, as outlined in Infrastructure Services Department report INS-14-090."' COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE DECEMBER 8.2014 -61 - CITY OF KITCHENER 2. INS-14-087 - ON-STREET PARKING REGULATIONS -AHRENS STREET EAST The Committee considered Infrastructure Services Department report INS-14-087, dated September 30, 2014 recommending approval that parking be permitted for a maximum of 15 consecutive minutes on the south side of Ahrens Street East. On motion by Councillor J. Gazzola- it was resolved: "That the Uniform Traffic By-law be amended to permit parking for a maximum of 15 consecutive minutes on the south side of Ahrens Street East from a point 13 metres east of Queen Street North to a point 31 metres east thereof, as outlined in Infrastructure Services Department report INS-14-087." 3. INS-14-089 - ON-STREET PARKING REGULATIONS -NEWBURY DRIVE The Committee considered Infrastructure Services Department report INS-14-089, dated October 16, 2014 recommending approval of a parking prohibition at anytime on the south/west side of Newbury Drive. On motion by Councillor J. Gazzola- it was resolved: "That the Uniform Traffic By-law be amended to prohibit parking at anytime on the south/west side of Newbury Drive from a point 65 metres east of Burnaby Crescent to a point 25 metres east thereof, as outlined in Infrastructure Services Department report INS-14-089." 4. INS-14-093 - ALL WAY STOP TRAFFIC CONTROL - MOUNT LAUREL CRESCENT AT BRIDLEWREATH STREET The Committee considered Infrastructure Services Department report INS-14-093, dated November 21, 2014 recommending approval of the installation of an all-way stop at the intersection of Bridlewreath Street and Mount Laurel Crescent/Donnenwerth Drive. On motion by Councillor J. Gazzola- it was resolved: "That the Uniform Traffic By-law be amended to permit an all-way stop to be installed at the intersection of Bridlewreath Street and Mount Laurel Crescent/Donnenwerth Drive, as outlined in Infrastructure Services Department report INS-14-093." 5. INS-14-094 - ALL WAY STOP TRAFFIC CONTROL - COUNTRY HILL DRIVE AT CENTURY HILL DRIVE The Committee considered Infrastructure Services Department report INS-14-094, dated November 21, 2014 recommending approval of the installation of an all-way stop at the intersection of Country Hill Drive and Century Hill Drive. On motion by Councillor J. Gazzola- it was resolved: "That the Uniform Traffic By-law be amended to permit an all-way stop to be installed at the intersection of Country Hill Drive and Century Hill Drive, as outlined in Infrastructure Services Department report INS-14-094." 6. INS-14-095 - ON-STREET PARKING REGULATIONS -AMHERST DRIVE The Committee considered Infrastructure Services Department report INS-14-095, dated November 6, 2014 recommending approval of a parking prohibition on both sides of Amherst Drive between Pinnacle Drive and Durham Street. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE DECEMBER 8.2014 -62 - CITY OF KITCHENER 6. INS-14-095 - ON-STREET PARKING REGULATIONS -AMHERST DRIVE (CONT'D) On motion by Councillor J. Gazzola- it was resolved: "That the Uniform Traffic By-law be amended to prohibit parking from Monday to Friday, 8:00 a.m. to 4:00 p.m., on both sides of Amherst Drive between Pinnacle Drive and Durham Street, as outlined in Infrastructure Services Department report INS-14-095." 7. INS-14-098 - NOISE EXEMPTION - HIGHWAY 401 RECONSTRUCTION AND WIDENING (MTO) The Committee considered Infrastructure Services Department report INS-14-098, dated November 20, 2014 recommending approval of a noise exemption to the Ministry of Transportation (MTO) for the Highway 401 reconstruction and widening project for the period of April 1, 2015 to November 30,2018. Several members expressed concern with the length of the term for the proposed noise exemption, suggesting that it would be preferable to only provide a one year exemption to allow flexibility when dealing with any issues that may arise during the reconstruction project. On motion by Councillor J. Gazzola- it was resolved: "That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be exempt from the provisions of Article 6 (Construction Work) of the City of Kitchener Municipal Code Chapter 450 (Noise)for the Highway 401 reconstruction and widening project, reference WP 4-00-00, between the hours of 7:00 p.m. and 7:00 a.m. from April 1, 2015 to April 1, 2016." 8. CSD-14-108 - BOULEVARD PARKING PROGRAM The Committee considered Community Services Department report CSD-14-108, dated November 25, 2014 recommending that parking continue to be permitted on the boulevard (paved area of a driveway between the sidewalk and the curb/road edge)from December 1st to March 31st of each year. Mr. S. Turner reviewed the report, advising that the majority of feedback received from the pilot project run in Ward 5 last year was positive. At the request of Councillor J. Gazzola, Mr. Turner agreed to provide additional information prior to the December 15, 2015 Council meeting with respect to any concerns Planning staff may continue to have with respect to permitting parking on boulevards. Several members indicated that while they were supportive of implementing the boulevard parking program on a permanent basis in Ward 5, it would be preferable to implement the program as a one year pilot in the remainder of the City. On motion by Councillor Gal loway-Sealock- it was resolved: "That parking on the boulevard (paved area of a driveway between the sidewalk and the curb/road edge), be permitted in Ward 5 from December 1st to March 31st, annually, subject to the conditions, as outlined in Community Services Department report CSD- 14-108; and further, That parking on the boulevard (paved area of a driveway between the sidewalk and the curb/road edge), be permitted from December 1st to March 31st as part of a one year pilot project in Wards 1-4 and Wards 6-10." CSD-14-108 - BOULEVARD PARKING PROGRAM (CONT'D) Clause 1 — Carried Unanimously on a recorded vote. Clause 2—Carried on a recorded vote. In Favour: Mayor B. Vrbanovic and Councillors B. loannidis, S. Davey, S. Marsh, D. Schnider, K. Galloway-Sealock, Y. Fernandes and Z. Janecki. Contra: Councillors J. Gazzola, P. Singh and F. Etherington. 9. INS-14-086 - ACTIVA HOLDINGS INC. DRAINAGE PETITION The Committee considered Infrastructure Services Department report INS-14-086, dated October 28, 2014 regarding a Petition of Drainage to secure a legal outlet for stormwater management for Activa's Gravel Ridge Trail Lands, as per the requirements of the Ontario Drainage Act. In addition, the Committee was in receipt this date of correspondence from Activa Holdings Inc., dated August 22, 2014, requesting the City to process the subject petition. Ms. L. Cooper reviewed the report, advising that the proposed development on the subject lands would require a private stormwater management pond, which will treat the water for quality and will match pre to post development runoff volumes. She added that at the meeting held with area stakeholders, no objections were expressed to the subject petition. She noted that the developer has agreed to be responsible for all costs and the City will bear no expense for this project. Mr. Larry Masseo, Activa Holdings Inc., was in attendance in support of the Petition for Drainage Works, advising that as part of a review of a Zone Change Application submitted for the subject lands, the City required that a legal drainage outlet be created. He stated that this required an agreement with the adjacent property owners; however, to date they have not been able to reach such an agreement. Accordingly, the subject petition has been submitted as per the legal procedure stipulated by the Drainage Act. In response to questions, Ms. L. MacDonald advised that the City can ultimately choose not to proceed with the petition, in which case the petitioner then has the right to appeal the decision to the Minister at a tribunal. She noted that given the date of when the petition was filed with the City,Activa is currently eligible to file an appeal. Councillor K. Galloway-Sealock expressed concern that as the Ward Councillor she did not participate in the stakeholders' meeting and suggested that additional discussions should be held with area residents. A motion was brought forward by Councillor Galloway-Sealock to defer consideration of the recommendation contained in Report INS-14-086 to the December 15, 2014 Council meeting, to allow additional time for consultation with the area landowners. On motion by Councillor Gal loway-Sealock- it was resolved: "That consideration of the following recommendation, be deferred to the December 15, 2014 Council meeting, to allow additional time for consultation with the area landowners: `That the Petition for Drainage to secure a legal outlet for stormwater management for Activa's Gravel Ridge Trail Lands, Part Lot 130, Part 6 of Ref. Plan 58R-3628, German Company Tract, be approved to proceed and be processed, as outlined in Infrastructure Services Department report INS-14-086; and, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE DECEMBER 8.2014 -64- CITY OF KITCHENER 9. INS-14-086 - ACTIVA HOLDINGS INC. DRAINAGE PETITION (CONT'D) That a copy of the subject Petition for Drainage as well as the City's decision regarding this matter, be circulated to the Grand River Conservation Authority (GRCA);and further, That an Engineering Consultant be retained to complete the third party engineer's report for a legal outlet for stormwater per the requirements of the Ontario Drainage Act."' 10 ADJOURNMENT On motion, this meeting adjourned at 4:31 p.m. C.
