HomeMy WebLinkAboutINS-14-099 - Metrolinx Delegated AuthorityStaff Rport I r rc'.� ► t .R Infrastructure Services Department wmkitchener.ca REPORT TO: Committee of the Whole DATE OF MEETING: December 15, 2014 SUBMITTED BY: Hans Gross, Director Engineering, 519 - 741 -2200 x 7410 PREPARED BY: Shailesh Shah, Design Engineer, 519 - 741 -2200 x 7144 WARD(S) INVOLVED: Ward 10 DATE OF REPORT: December 11, 2014 REPORT NO.: INS 14 -099 SUBJECT: Delegation of Authority Pertaining to the Execution of Documents with Metrolinx Regarding the Railway Corridor RECOMMENDATION: That Council delegate signing authority to the Deputy Chief Administrative Officer, Infrastructure Services, to sign any documentation required to secure permission to undertake work within the rail corridor, including Grade Separation Agreements, Release of Liability documents, and /or Work Permit Agreements between the City of Kitchener and Metrolinx, on behalf of the City; said documentation to be to the satisfaction of the City Solicitor BACKGROUND: From time to time the City needs to directly or through its contractors perform work across the rail corridor located in Kitchener. Council has previously delegated authority to the General Manager, now Deputy Chief Administrative Officer, Infrastructure Services, to sign documentation on behalf of the City related to the undertaking of this work with Canadian Pacific Railway Company, or Goderich- Exeter Railway Company Limited and /or its parent company, Rail America. This authority is still required. REPORT: In September, 2014, Metrolinx acquired part of the rail corridor running through a large part of Kitchener and as a result we now need authorization to execute the necessary documentation to carry out any work that impacts the portion of the railway corridor owned by Metrolinx. This has come to light as a result of the Margaret Avenue bridge reconstruction. 10.-I Typically, the City will be asked to execute Grade Separation Agreements and Release of Liability documents with Metrolinx, and on occasion Work Permit Agreements should the City be undertaking the work directly. Engineering is typically involved and they review the situation to determine if the work they are proposing involves working within the railway corridor. Engineering makes the arrangements and pays any applicable fees from their budget, usually attributed to the specific project. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Improvement to infrastructures will continue to contribute to Quality of Life for residents in the City, by investing in infrastructure that will support our future growth. FINANCIAL IMPLICATIONS: Any fees payable pursuant to the agreements are funded within current budgets. COMMUNITY ENGAGEMENT: INFORM — This report has been posted to the City's website with the agenda in advance of the council / committee meeting. CONCLUSION: It is appropriate to have similar delegation granted to the DCAO, Infrastructure Services with respect to Metrolinx to ensure timely handling of necessary work.
