SUBJECT: Noise Exemption — MTO Highway 7/85 Improvements and
Franklin Street Bridge Over Highway 8
RECOMMENDATIONS:
That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be exempt from
the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6
Construction Work during the Highway 7/85 improvements project. The request for the
noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m. for the period
May 1, 2015 and ending September 30, 2015, and further,
That the Ministry of Transportation, Ontario (MTO) and its contractor(s) be exempt from

Construction Work during the rehabilitation of the Franklin Street bridge over Highway 8.
The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00
a.m. for the period July 1, 2015 and ending September 30, 2015.
BACKGROUND:
The MTO has engaged the engineering firm MMM Group to administer the contract for the
ongoing Highway 7/85 improvements, as well as the rehabilitation of the Franklin Street bridge
over Highway 8, both within the City of Kitchener. The Highway 7/85 improvements will be
completed during the May to August, 2015 time period, while the Franklin St bridge
rehabilitation will be completed during the July to August, 2015 time period.
In order to maintain safe and efficient traffic flow on Highway 7/85 during daytime periods, a
portion of the work will have to be completed during afterhours (7:00 pm to 7:00 am). In order to
ensure the opening of the Franklin Street bridge before school start in the beginning of
September, afterhours work may be required to ensure meeting the completion deadline.

REPORT:
This project will include the following improvements and construction operations:
Highway 7/85 Improvements
Highway improvements are being completed in order to accommodate the future development
of the new Highway 7. This work is scheduled for construction from May to August of 2015.
This project includes structural improvements to three (3) bridge structures along the K-W
Expressway, including widening of the Guelph Street overpass, as well as lowering the Guelph
Street roadway to accommodate vertical clearances for the widened bridge.
After hours work that is required includes surface course paving that will be conducted during
overnight hours. Highway traffic, minimal in volume during overnight hours, will be required to
detour using local Regional and City roadways.
The idling of construction equipment will be kept to a minimum, as well as equipment being
maintained in good working order to minimize construction related noise.
In order to maintain efficient and effective highway capacity during the peak traffic periods
during day time hours, it has been requested to complete some of this work during evening and
overnight hours.
Franklin Street Bridge Rehabilitation
The Franklin Street bridge will require structural repairs that will necessitate the closure of
Franklin Street. This bridge rehabilitation work has been scheduled for July and August of 2015
in order to have Franklin Street reopened for the start of the school year in the 1St week of
September, 2015.
While Franklin Street will be closed to vehicular traffic, the rehabilitation work has been
designed to allow for pedestrian and cyclist traffic to use the bridge. This will maintain a
functional connection for residents south of this bridge structure to access the grocery,
commercial and restaurant uses on the north side of the bridge.
Afterhours work is not anticipated, but may be required in order to maintain the project
schedule, allowing for the opening of Franklin Street in a timely fashion. This afterhours work
may include delivery of materials and the placement of concrete to complete the repairs.
The idling of construction equipment will be kept to a minimum, as well as equipment being
maintained in good working order to minimize construction related noise.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This initiative falls under the Community Priority of Quality of Life. "Work with partners, including
all orders of government, to create a culture of safety in our community." The implementation of
improved traffic flow and safety will provide positive direction for motorists.

FINANCIAL IMPLICATIONS:
None.
COMMUNITY ENGAGEMENT:
INFORM — Before the commencement of the work at both locations, notices will be delivered to
all affected property owners, advising of the project details, including after hours works. This
notification will include project contact information that provides residents / property owners with
a 24 hour/ 7 day a week contact number, should concerns arise.
The closure of Franklin Street will be signed on-road in advance of the project, advising
motorists of the impending closure.

Highway 7185 Improvements from Krug Street to Lancaster Street

and
Highway 81 Franklin Street Underpass (G.W.P. 168-89-00)
Dear Mr. Readman:
MMM Group (formerly McCormick Rankin) has been retained by the Ministry of Transportation
(MTO) to complete a Detail Design and Class Environmental Assessment Study for pavement
resurfacing and bridge rehabilitations on Highway 85 and Highway 7185 within the Region of
Waterloo. The existing highway infrastructure requires rehabilitation to maximize its useful service
life.
The original study area was divided into two projects:
Contract 1 - Project A: Highway 85 from 0.1 km south of Lancaster Street to 0.4 km north of
Regional Road 15 (King Street)
Contract 2 - Project B: Highway 7185 from Krug Street northerly to 0.1 km south of Lancaster
Street
Contract 1: Project A has essentially been completed with only minor works remaining. This work
is expected to be completed by late April, 2015.
Contract 2: Project B includes highway resurfacing, repairs to 3 bridge locations, widening of the
Guelph Street overpass for the future East to North ramp from Highway 7New to Highway 85 and
the lowering of Guelph Street to provide the necessary vertical clearances for the widened bridge.
Contract 2 is scheduled to begin in May and be completed by September of 2015. It will be
followed by a third contract to initiate the construction of Highway 7New. Details on the Highway
7New work will be forwarded to the City separately.

The purpose of this letter is to request for an exemption from City of Kitchener By-law 2000-71,
Chapter 450, Article 6, Section 450.6.1 (May 8, 2000), which prohibits the sound or noise arising
between the hour of 7 o'clock p.m. of any day and 7 o'clock a.m. of the following day from any
excavation or construction work whatsoever, including the erection, demolition, alteration or repair
of any building or structure except in case of urgent necessity.
The basis for this request is to allow for the paving work within the City of Kitchener. Echelon
surface course paving will be required through the core/collector of Highway 85 from Krug Street
northerly to Lancaster Street. This resurfacing work is anticipated to take place during the Summer
of 2015 (i.e. July and August) and will require traffic to be re-routed onto local and regional roads for
the duration of the nightly surface asphalt works. Night work is required to minimize traffic delays on
the expressway during the daytime and peak periods. The Highway 85 core/collector is expected to
be closed for four to six nights (approximately 10 p.m. to 6 a.m.) in each direction to accommodate
the echelon surface course paving.
Please note that the idling of construction equipment will be kept to a minimum and that equipment
will be maintained in good working order to minimize construction related noise. Every effort will be
made to avoid unnecessary or unreasonable noise during the proposed rehabilitation and paving
work.
Highway 81 Franklin Street Underpass (G.W.P. 168-89-00)
MMM Group (formerly McCormick Rankin) has been retained by the Ministry of Transportation
(MTO) to complete a Detailed Design and Class Environmental Assessment Study for repairs to the
Highway 8 1 Franklin Street Underpass structure in the City of Kitchener. The bridge repairs will
require the closure of the Franklin Street Bridge at Kingsway Drive to vehicle traffic. The closure is
currently anticipated to occur during July and August of 2015 for a period of 9 weeks.
The 9 week closure is necessary to permit the repairs to be completed. Given the importance of
the structure for local pedestrian and cyclist movement, the work has been designed to permit
pedestrians and cyclists through the work area for the duration of the contract. There may be some
critical operations by the Contractor where pedestrian/cyclist traffic will not be permitted. Sufficient
notice will be provided to the public about when the bridge will be closed for these operations.

be required at Franklin Street for the delivery of materials and the placement of concrete to
complete the repairs.

made to avoid unnecessary or unreasonable noise during the proposed rehabilitation and paving
work.

Adjacent property owners will be notified for both projects (Contract 2 and Highway 8 1 Franklin
Street Underpass) of construction activities taking place afterhours. These property owners will also
be provided with the Contractor contact information, who will be available 2417 to address any
concerns relating to the construction activities.
