The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m. for the period January 12, 2015 and ending August 31, 2015. BACKGROUND: As a part of the improvements to the City's storm water management and water quality construction, stream naturalization will be completed in the stream reach north of Victoria St as a continuation of the 2014 work. REPORT: This project will involve the removal of the 500 m concrete channel from Victoria Street to Fenwick Park and it will be replaced with a winding more natural creek. This work is part of the continuation of the work that was recently completed at Filsinger Park just south of Victoria Street. As part of the construction work, the contactor will be required to undertake bypass pumping of flows in the stream during portions of the project. This will require the use of pumps which will operate 24 hours per day, 7 days per week. 6 - 1 Ongoing communication with Council was circulated via email with details of the noise exemption on October 1, 2014 prior to the commencement of the phase 1 work in 2014 to advise of noise to be expected from the project and the noise exemption at that time was detailed as Filsinger Park Stream Naturalization project Tender T14-063 for October 1, 2014 to April 30, 2015. The 2015 portion of the work outlines other specifics of the work continuing beyond April 2015 as originally proposed. A preliminary noise exemption was granted by staff through an email to members of Council for this phase 2 work. The bypass pumps are noise mitigated to reduce the impact of their operation. A plywood enclosure will also be constructed and every attempt made to keep the pumps away from the residential areas. In order to minimize the noise to the extent possible it is anticipated that pumps will no longer be required once the instream construction is completed by the original timeline of April 2015. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: This initiative falls under the Community Priority of Quality of Life. "Work with partners, including all orders of government, to create a culture of safety in our community." The implementation of improved traffic flow and safety will provide positive direction for motorists. FINANCIAL IMPLICATIONS: None. COMMUNITY ENGAGEMENT: INFORM —All affected residents and property owners have been advised of this project, including proposed night-time pumping information on the operations through public notifications, including: • Letters to all residents in the area. • Monthly e-newsletters to all residents that registered through public meetings and/or the project website. • A project website has been set up for the public to review for information and communication with a newsletter sign up as an option for ongoing improved communications. This construction will involve the removal of the 500 m of concrete channel from Victoria Street to Fenwick park and it will be replaced with a winding and more natural creek. This work is a continuation of the work that was recently completed at Filsinger Park just south of Victoria Street and will look very similar. The approximate duration of the project is from January 2015 to April 2015, weather permitting. In order to ensure public safety and maintain separation from the heavy construction equipment, the trail along the channel will be closed. Alternative routes via roadways are recommended. Regular updates will be posted on our project website at www.kitchener.ca/Filsinge . You can also sign up to receive enewsletters on the website. As part of this work, trees and other vegetation will have to be removed from the system in order to create a winding channel. Some of this material will actually be used in the new channel (buried into the banks to help protect it from high flows). A key benefit of this work will be to restore the creek to a more natural state and improve water quality and fish habitat. The work will also result in an upgraded pedestrian bridge near Fenwick park. This work will help to reduce sediment (soil, debris, etc.) that currently flows directly into Victoria Park Lake by allowing soil to be deposited onto the banks during large flows. Vegetation will continue to grow through this soil. Construction access is proposed to be off of Victoria Street and therefore we do not expect to have to close any roadways as part of the construction. As part of the construction works, the contractor will likely require to undertake some bypass pumping of flows in the stream during portions of the project. This will require the use of pumps which will operate 24 hours a day, and 7 days a week and therefore a noise bylaw exemption will be requested. It is our intent to minimize the noise to the extent possible and it is anticipated that pumps will no longer be required once instream construction is completed (anticipated to be by end of March 2015).
