SUBJECT: Noise Exemption — Region of Waterloo Stage 1 — Light Rail
Project
RECOMMENDATION:
That the Region of Waterloo and its contractor(s) be exempt from the provisions of
Chapter 450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work
during the Region of Waterloo Stage 1 — Light Rail Project in the City of Kitchener. The
request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m.
for the period March 1, 2015 and ending December 31, 2015.
BACKGROUND:
As a part of Grandlinq Contractor's design and build of the Stage 1 of the Region of Waterloo's
Light Rail Transit (LRT) project major road reconstruction will be taking place over the course of
the next few years in the City of Kitchener. This includes the installation of infrastructure,
utilities, servicing and rail components which will encompass an aggressive schedule for
completion of the project for full operation in 2017.
REPORT:
This project is extensive and will require a noise exemption for construction activities in the 2015
construction year for the purpose of accelerating the schedule and construction activities to
improve productivity during the construction season, shorten durations, and disruptions as they
pertain to businesses, their customers, delivery schedules and to encompass delays due to
other unforeseen scheduling and weather conditions.
Staff and Council have been advised and/or part of various planning project teams over the past
months to review and approve various aspects of the LRT project with awareness of the scope
of the upcoming project.

Grandlinq staff have been working cooperatively with Transportation Planning Division Staff to
co-ordinate construction operations to reduce traffic impacts with the schedule for completion, of
which, the noise exemption is key to maintaining the schedule and minimize the duration of the
overall project timelines. Project work under the noise exemption would include the following
locations of LRT project works:
• Section 4— King Street from Union Boulevard to Victoria Street
• Section 5 — King Street from Victoria Street to Francis Street, Duke Street from Francis
Street to Frederick St, Frederick Street from Duke Street to Charles Street
• Section 6—Charles Street from Victoria Street to Benton Street
• Section 7—Charles Street from Benton Street to Ottawa Street
• Section 8— Borden Avenue from Charles Street to end of the road
• Section 9—Ottawa Street from Charles Street to Mill Street
• Section 10 — Huron Spur from Palmer Avenue to south of Hayward Avenue, Hayward
Avenue from Hanson Avenue to Courtland Avenue, Courtland Avenue form Hayward
Avenue to Manitou Drive, North of Fairway Road from Courtland Avenue to Fairview
Park Mall.
The construction activities that would take place between 7:00 p.m. to 7:00 a.m. could include
the following:
• Concrete placement (track, sidewalks, curb & gutter, bridge & wall structures, LRT
stops)
• Aggregate and asphalt placement (all roads rebuilds listed above)
• Material movement (aggregates, track material, equipment)
• Removal and replacement of wet utilities (sewer &water)
• Track installation prior to concrete placement
Grandlinq has a website which provides construction updates relative to current and upcoming
work of which the noise information will be published.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This initiative falls under the Community Priority of Quality of Life. "Work with partners, including
all orders of government, to create a culture of safety in our community." The implementation of
improved traffic flow and safety will provide positive direction for motorists.
FINANCIAL IMPLICATIONS:
None.
COMMUNITY ENGAGEMENT:
The majority of unduly noise (i.e. underground installations, piling works) will be conducted
during regular daytime operations in order to comply with existing bylaws and to minimize after
hours noise to residents.

INFORM — Notification will be provided to all businesses and residents within 125 metres of the
project limits as is protocol consistent with the Region of Waterloo LRT communications process
as well as via the following:
• Letters to all businesses/residents in the area.
• An ION project website has been set up for the public to review for information and
communication with a newsletter sign up as an option for ongoing improved
communications — ION Construction website: www.rideion.ca and ION website:
www.regionofwaterloo.ca/rapidtransit
• Communications staff available from the Region of Waterloo and Grandlinq via a 24 hour
hotline.
• Project boards onsite with all contact information for the public on display.

Request of Noise by-law exemption
Dear Mr. Carmichael
GrandLinq Contractors has been contracted to design and build Stage 1 of the Waterloo LRT and
would like to formally request a noise by-law exemption for construction activities in the 2015
construction year starting on March 1, 2015- December 31, 2015. Grandlinq Contractors is
requesting this exemption for the purpose of accelerating schedule and construction activities to
improve productivity during the construction season, shorten durations and disruptions as they
pertain to businesses,'their customers and their delivery schedules and to have the ability to make
up for lost time in the event of delays. Not all of this work will be at night but this serves as a broad
description of potential night work.
Upon approval of this exemption, Grandlinq Contractors would notify all businesses and residents
within 125 meters of all after hours work. This construction notice would also contain Grandlinq's
24 hours a day 17 days a week hotline for construction questions and complaints,
