RECOMMENDATION: That Zone Change Application ZC15/02/L/KA (8 & 12 Louisa
Street) for the purpose of removing Holding Provision 6H from the lands specified on the
attached Map No.1, in the form shown in the "Proposed By-law" dated January 23, 2015,
attached to Report CSD-15-014 as Appendix A, be approved.

REPORT:
The subject lands are located at 8 & 12 Louisa Street and are zoned Medium Intensity Mixed
Use Corridor Zone (MU-2) and are located in a Mixed Use Corridor designation under the
Official Plan. The lands have recently received Site Plan Approval in Principle for a multiple
residential development. The development complies with zoning regulations. Before the Site
Plan receives final approval and a building permit may be issued, Holding Provision 6H must be
removed from the lands. Holding Provision 6H specifies that it shall not be removed until such
time as the lands have been consolidated with lands fronting King Street West and a site plan
has been approved, including appropriate buffering measures.
Staff confirm that the lands have been consolidated together with lands addressed as 672 —690
King Street West as well as with 18 Louisa Street (see Appendix "C"). Buffering measures have
been included in the Site Plan. As such, Planning staff recommend that Holding Provision 6H
be removed from the lands as shown on Map No.1 (Appendix "A").
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The Zone Change aligns with the Kitchener Strategic Plan as it ensures the implementation of
the community priority Development and will allow development that is consistent with
Provincial, Regional and City planning policy.
FINANCIAL IMPLICATIONS:
There are no financial implications associated with this recommendation.
COMMUNITY ENGAGEMENT:
INFORM - Notice of the intention to pass an amending by-law to remove Holding Provision 62H
will be advertised in The Record on February 13, 2015. (see Appendix "B"). Under the Planning
Act, no statutory public meeting or neighbourhood circulation are required for zone change
amendments to remove a holding provision. This report has been posted to the City's website
with the agenda in advance of the council / committee meeting.
CONCLUSION:
Planning staff are of the opinion that the requested Zone Change to remove Holding Provision
6H from the lands specified on the attached Map No.1 of Appendix"A" is appropriate at this time
since the requirements to remove the holding provision have been met. Planning Staff
recommend approval of the application as outlined in the Recommendation section of this
report.

WHEREAS it is deemed expedient to amend By-law 85-1 for the lands specified above;
NOW THEREFORE the Council of the Corporation of the City of Kitchener enacts as
follows:
1. Schedule Numbers 74 and 75 of Appendix "A" to By-law Number 85-1 are hereby amended
by changing the zoning applicable to the parcel of land specified and illustrated on Map No.
1, in the City of Kitchener, attached hereto, from Medium Intensity Mixed Use Corridor Zone
(MU-2)with Holding Provision 6H to Medium Intensity Mixed Use Corridor Zone (MU-2).

The purpose of this Zone Change Application is to remove Holding Provision 6H from the zoning of the above noted lands
as requirements for removal have been fulfilled.
This application will be considered by the Community and Infrastructure Services Committee on Monday, March 9, 2015,
Council Chambers, 2nd Floor, City Hall, 200 King Street West, Kitchener.
