SUBJECT: ENCROACHMENT AGREEMENT REQUEST – ROGERS
INSTALLATION AT AHRENS ST. & QUEEN ST. N

RECOMMENDATION:
“That, subject to obtaining all necessary approvals, the Mayor and Clerk be authorized to
execute an Encroachment Agreement, satisfactory to the City Solicitor, with Rogers
Communications Inc. for a flush-to-grade vault and conduit installation running
approximately 132m North East and 1m deep through the parklands of Civic Centre
Park.”
BACKGROUND:
Rogers Communications Inc. approached the City of Kitchener for permission to enter onto
parklands and install conduit 1m deep, which would connect to the existing vault at Queen St.
N. and Ahrens St. An installation of a vault is also necessary to service 100 Queen Street North
with a new fiber service.
REPORT:
Rogers Communications Inc. would like to be authorized to encroach for the purposes of
installing conduit to provide service to customers. An existing encroachment agreement
legalizes the existing pedestal on City parkland known as Civic Centre Park. Rogers
Communications Inc. would like to connect conduit 1m deep out of the existing vault at Queen
Street N. and Ahrens St. and run it for 132m North East through the parklands at 2.3m offset
from the property line which would allow for the required utility separation.
Rogers Communications Inc. is also proposing a flush-to-grade 36x60x36 vault within the
parklands opposite 100 Queen Street North to service the high rise at 100 Queen Street North.
Rogers Communications Inc. would ensure all restorations in a timely fashion.
Through the encroachment circulation process, it was discovered that there is a bus concrete
pad nearby some of the required work. Rogers Communications Inc. have ensured that

directional drilling of 1m in depth should avoid the concrete pad. There is an existing Allstream
vault, but there is no objection from MTS Allstream as long as Rogers Communications Inc.
maintains a standard clearance of 0.6m horizontal, 0.3m vertical and hand trench within 1.0m.
Furthermore, there is an existing underground Hydro plant within the area; however KW Hydro
does not foresee any issues. Rogers Communications Inc. has received the necessary
information from KW Hydro to avoid any Hydro plant.
Attached are drawings illustrating the location of the proposed connections.

FINANCIAL IMPLICATIONS:
The application fee of $264 has been paid in accordance with the City’s fee schedule. An
additional $225 processing fee has also been paid. The minimum encroachment fee of
$309/year will also be applicable if Council authorized this agreement.
COMMUNITY ENGAGEMENT:
Community engagement is not necessary for this process.
CONCLUSION:
Once support for authorizing the installment of conduit and the vault has been received from
Council, it will be in order to authorize the execution of an encroachment agreement with
Rogers Communications Inc.
