SUBJECT: T15 -029 Fischer Park Skatepark Construction
RECOMMENDATION:
That Tender T15 -029 Fischer Park Skatepark Construction, be awarded to Gateman -
Milloy Inc, Kitchener, Ontario at their tendered price of $691,266.90, including provisional
items and contingencies of $25,000., plus H.S.T. of $89,864.70, for a total of $781,131.60.
BACKGROUND:
Fischer Park was identified and approved through the Skatepark Planning Study (2012) as a
preferred site for skatepark development. Design of the skatepark began in 2014, this process
included 3 public workshops and a public meeting in early 2015. The skatepark design includes
both bowl and street course elements for skateboards, bmx bikes and scooters. This works also
includes a park trail, tree planting and benches /tables. The development of the Fischer Park
Skatepark aligns with the objectives of the Leisure Facilities Master Plan Update (2013) and the
Parks Strategic Plan (2010).
REPORT:
Tenders were advertised publicly in the Daily Commercial News, on the City of Kitchener
website and the internet through the Ontario Public Buyers Electronic Tendering Information
System. Documents were picked up by thirty (30) interested parties and by the closing date of
Thursday April 30, 2015, four (4) tenders had been received.
The tenders were reviewed by R. Crago, van der Zalm + associates inc. the City's Consultant
for the project and A. Dewitt, Landscape Architect who concur with the above recommendation.

The City of Kitchener's purchasing policies and practices ensure openness, fairness and
transparency in the procurement of goods and services.
FINANCIAL IMPLICATIONS:
The net cost for this tender (A), is fair and reasonable for a purchase of this scope, but the upset
limit exceeds the budget allowance (B) provided within the budget. Additional funding for this
purchase is provided by the existing surplus balance in the Community Trail General Provision
account. The amount available in this account is sufficient to fund this transfer. There is
expected to be no surplus or deficit (E).

COMMUNITY ENGAGEMENT:
INFORM - Potential vendors are informed of bid opportunities through the public posting of bid
documents as outlined in the City's Purchasing By -Law. Vendors, local media and the general
public are informed of purchasing recommendations to Council through the public reports which
are included with the Council agenda the week prior to the Council meeting.
