HomeMy WebLinkAboutINS-15-042 - Closure and Lease of Agnes St & Declarationof Surplus for Easement Purposes Staff Rport I r rc'.�► t .R Infrastructure Services Department wmkitchener.ca REPORT TO: Community and Infrastructure Services Committee DATE OF MEETING: May 25, 2015 SUBMITTED BY: Justin Readman, Director of Transportation Services 519-741-2200 x7038 PREPARED BY: Jeff Kolnick, Traffic Technologist 519-741-2200 x7152 WARD(S) INVOLVED: Ward 9 DATE OF REPORT: May 8, 2015 REPORT NO.: INS-15-042 SUBJECT: CLOSURE AND LEASE OF AGNES STREET AND DECLARATION OF SURPLUS FOR EASEMENT PURPOSES RECOMMENDATION: That the closure of portions of Agnes Street, from Park Street to Dominion Street (see attached Schedule "A") be approved in principle, and that the Mayor and Clerk be authorized to enter into a lease agreement with the K-W Badminton Club Inc., subject to the satisfaction of the City Solicitor; and, That the portion of Agnes Street to be closed, to be further described on a Reference Plan to be prepared, be declared surplus to the City's needs for the purpose of conveying possible easements for the affected agencies. BACKGROUND: Agnes Street is located in Ward 9 and is a one-way street primarily serving as access to the KW Badminton Club at 69 Agnes Street and its parking area. The closure of Agnes Street will also allow for the lands to be leased to the K-W Badminton Club (Club), with the portion of the closed road being used as a parking lot for additional parking for the Club. So long as the Club operates as a non-profit organization, the land will be leased to the Club for nominal consideration in the amount of one ($1) dollar. REPORT: The process for closure of each portion of the roadway will follow the A+ EA process, which includes signs posted on the affected roadways. Part of the process will include the circulation to Agencies of the proposed closures in order to determine if any easements will be required. ***This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. 11 - 1 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: This initiative falls under the Community Priority of Quality of Life. "Work with partners, including all orders of government, to create a culture of safety in our community." FINANCIAL IMPLICATIONS: As part of the road closure process the following, with estimated associated costs, is required- - $5000 for the procurement of a reference plan - $1200 for an Advertisement as per the requirements of the bylaw - $300 for Registry Office Disbursements for the registration of the bylaw and possible easements - $400 for the manufacture and placement of signs at each end of the proposed closure. These items will be funded out of various accounts. The closure of this roadway will reduce future operating budgets as the area will be maintained by the KW Badminton Club. COMMUNITY ENGAGEMENT: INFORM — This report has been posted to the City's website with the agenda in advance of the council / committee meeting. CONSULT — The KW Badminton Club has been consulted on the proposed closure and lease.
