HERITAGE KITCHENER MINUTES
MAY 5, 2015 CITY OF KITCHENER
The Heritage Kitchener Committee met this date, commencing at 4:00 p.m.

CSD-15-037 - HERITAGE PERMIT APPLICATION HPA 2015-V-006

- 137 QUEEN STREET SOUTH
- REPAIR TO BRICKWORK AND REPLACEMENT OF STEEPLES
The Committee considered Community Services Department report CSD-15-037, dated April
17, 2015 recommending approval of Heritage Permit Application HPA 2015-V-006 to permit
repair to the brickwork and replacement of the two steeples at the property municipally
addressed as 137 Queen Street South. Ms. M. Drake presented the Report.
On motion by Mr. S. Burrows -
it was resolved:
“That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA-2015-V-006 be approved to permit repair to the brickwork and replacement of the
two steeples at the property municipally addressed as 137 Queen Street South, in
accordance with the supporting information submitted with the application, as outlined in
Community Services Department report CSD-15-047, and subject to the following
condition:
i) That the final building permit drawings be reviewed and heritage clearance
provided by heritage planning staff prior to the issuance of a building permit.”

HERITAGE VALUE OR INTEREST ON THE MUNICIPAL HERITAGE
REGISTER
The Committee considered Community Services Department report CSD-15-035, dated April
16, 2015 recommending listing various properties on the Municipal Heritage Register (MHR).
Ms. M. Drake presented the Report advising that recommendations arising from this item
would be considered by Council at the meeting of June 1, 2015.
Mr. Doug Cornwall, 418 Glasgow Street, appeared in opposition to listing his property on the
Municipal Heritage Register. He advised his comments were provided to staff in written
correspondence which was circulated in the agenda package and did not wish to address the
Committee further.
Ms. Susan Mavor presented the history of the Dominion Tire Factory, 101 Glasgow Street/149
Strange Street, in support of listing the property on the Municipal Heritage Register. Ms. Mavor
advised of the design, historical and contextual value of the property indicating its importance
in the socio-economic impact and vitality of the City.
Ms. Mavor gave a presentation in support of listing 418 Glasgow Street on the Municipal
Heritage Register. She stated that in her research of the rubber industry in the Westmount
Neighbourhood, the history of the property was revealed emphasizing the heritage significance
of the home which was once part of the Westmount Farm.
Mr. Victor Labreche, Labreche Patterson and Associates, appeared in opposition to listing
1333 King Street East on the Municipal Heritage Register. He stated that he had sent
correspondence to staff on behalf of the Owner of the property in opposition to listing the
property. He noted that based on their review, listing the property would be at odds with the
policies of the secondary plan against the intensification policies within the Official Plan and
the intent of the Mixed-use Zoning corridor.

In response to questions from the Committee, Mr. Labreche stated that the property is
currently vacant and the garage located on the property will eventually require demolition as it
is an impediment to the redevelopment of the block. He indicated that in his opinion, the
building at 1333 King Street East has been kept in good repair but is not historically significant
and therefore should not be listed on the Municipal Heritage Register.
Ms. Prijna Gingerich and Mr. Jim Oakley addressed the Committee in opposition to listing 825
King Street West, on the MHR. Ms. Gingerich expressed concern that the listing places
potential restraints on redevelopment or partial demolition for housing or medical purposes.
She explained that the Church is experiencing financial difficulty due to a declining
congregation
and wants to explore options in the future once the development of the ION has been
completed. She expressed concern that listing the property on the MHR removes the flexibility
that was envisioned for the future.
Ms. Kae Elgie, President, Architectural Conservancy Ontario-North Waterloo Region Branch,
commended the Committee on the variety of properties proposed for listing on the MHR and
encouraged members to list all of the properties as non-designated properties of cultural
heritage interest.
Messrs. Ted Parkinson and Lane Burman, Mount Hope Breithaupt Park Neighbourhood
Association, appeared in support of listing 111 Ahrens Street West as being of cultural heritage
value or interest on the MHR. Mr. Parkinson explained how the furniture industry has been
significant historically to the Region and stated that the Krug Furniture Factory is an important
landmark that has been in existence for over 100 years. He encouraged the Committee to
recommend listing the property on the MHR to ensure conservation and prevention of future
demolition. Mr. Burman provided contextual information, stating that Hartman Krug started the
Krug Furniture Company and that it is still managed by the family. He encouraged preservation
of the important landmark in the neighbourhood.
Mr. Paul Kanwall appeared in opposition to listing 535 Park Street on the MHR as a non-
designated property of cultural heritage value or interest. He stated that it is a medical building
built in 1973 and he would like to modernize the exterior to provide lift access. He expressed
concern that listing the property would prevent the renovation.
Ms. M. Drake provided clarification stating that planning approvals would require that all
options were explored for design and integration with the building. She added that if planning
approvals are not required, Mr. Kanwall could apply for a building permit. She assured the
Committee that she would liaise with Mr. Kanwall to explore what information would be
required for the accessible lift.
On motion by Mr. S. Miladinovic -
it was resolved:
“That pursuant to Section 27 of the Ontario Heritage Act, the following properties be
listed on the Municipal Heritage Register each as a non-designated property of cultural
heritage value or interest, in accordance with the respective Statement of Significance,
as outlined in Appendix 'A' of Community Services Department report CSD-15-040:

listed on the Municipal Heritage Register each as a non-designated property of cultural
heritage value or interest, in accordance with the respective Statement of Significance,
as outlined in Appendix 'A' of Community Services Department report CSD-15-040.”
On motion by Councillor Z. Janecki -
it was resolved:
“That pursuant to Section 27 of the Ontario Heritage Act, 418 Glasgow Street be listed
on the Municipal Heritage Register each as a non-designated property of cultural
heritage value or interest, in accordance with the respective Statement of Significance,
as outlined in Appendix 'A' of Community Services Department report CSD-15-040.”

listed on the Municipal Heritage Register each as a non-designated property of cultural
heritage value or interest, in accordance with the respective Statement of Significance,
as outlined in Appendix 'A' of Community Services Department report CSD-15-040.”

it was resolved:
“That pursuant to Section 27 of the Ontario Heritage Act, 825 King Street West be listed
on the Municipal Heritage Register each as a non-designated property of cultural
heritage value or interest, in accordance with the respective Statement of Significance,
as outlined in Appendix 'A' of Community Services Department report CSD-15-040.”
On motion by Councillor Z. Janecki -
it was resolved:
“That pursuant to Section 27 of the Ontario Heritage Act, 160 Margaret Avenue be
listed on the Municipal Heritage Register each as a non-designated property of cultural
heritage value or interest, in accordance with the respective Statement of Significance,
as outlined in Appendix 'A' of Community Services Department report CSD-15-040.”

On motion by Councillor J. Gazzola -
it was resolved:
“That pursuant to Section 27 of the Ontario Heritage Act, 535 Park Street be listed on
the Municipal Heritage Register each as a non-designated property of cultural heritage
value or interest, in accordance with the respective Statement of Significance, as
outlined in Appendix 'A' of Community Services Department report CSD-15-040.”
11 YOUNG STREET (MAYFAIR HOTEL)

Mr. L. Bensason addressed the Committee advising that at the April 23, 2015 meeting, Council
withdrew the intention to designate 11 Young Street under part IV of the Ontario Heritage Act.
He stated members were in receipt of correspondence and information regarding the
chronology of events related to the withdrawal. He provided a summary of events that lead to
the Chief Building Official ordering the demolition of the building; and, highlighted the requests
that have been made of the owner relative to the heritage attributes of the building.
Mr. Bensason read the Council resolution of April 23, 2015 which directed staff to consult with
Heritage Kitchener at the meeting this date on the best practices for the future preservation of
heritage buildings in the City of Kitchener, with a report to be provided back to Council at a
future date. He stated that the matter is likely to be an extended discussion and reviewed the
current best practices in use by Heritage Planning staff, including: a comprehensive process
for identification; the completion of the cultural heritage landscape study for identification of
cultural heritage landscapes; the current Official Plan (OP) and the new OP, currently under
appeal, contain heritage policies; listing and conservation easements/agreements to protect
heritage attributes; property standards by-law for Group ‘A’ properties in heritage conservation
districts; designated properties to properly maintain and repair heritage attributes; change
management through heritage review of development planning building applications; advice to
owners; grant program to ensure that funds are allocated in an appropriate way; and,
consistent advice in accordance with heritage policy and regulations. He stated that future
discussions may introduce new methods for consideration, or a review of current practices as
a means to begin discussions.
Ms. Kae Elgie, President, Architectural Conservancy Ontario-North Waterloo Region Branch,
addressed the Committee advising that an online petition has been initiated with the intention
of saving the Mayfair Hotel. She inquired why the Committee was not given the opportunity to
provide input on the potential preservation of the building; and, if the process would have been
different, if the building had been previously designated under the Ontario Heritage Act.
Mr. Bensason responded advising that due to the imminent safety issue, the decision to
withdraw the intention to designate had to be made quickly. He explained that under the
Heritage Act, a withdrawal of an intention to designate does not require consultation by the
Heritage committee. He further advised that if a Designating By-law had been passed, the
Owner would have made an application to demolish. The application would then come to the
Committee under the Act, and the Committee would make a recommendation to Council, who
would make the final decision.
Mr. Frank Etherington, resident, addressed the Committee advising he resides downtown in a
house built in 1904, and has deep regard for heritage buildings. He expressed appall at the
demolition and that Heritage Staff were not consulted prior to the order for demolition. He
expressed concern at the number of historically significant buildings in the City that have been
demolished, such as the Barra Castle, and indicated that the Mayfair Hotel could have been
successfully preserved.
Mr. Simone Panziera, Architect, addressed the Committee in opposition to the process,
indicating that in his opinion the Engineers Report may have been exaggerated and that the
structure is not so unstable that it could not be preserved.

A discussion took place regarding the condition of 11 Young Street, reported in the engineers
report and detailed in the Council Minutes of April 23, 2015. Members expressed concern that
Heritage Kitchener was circumvented as they were not asked to consider the matter in an
advisory capacity, and inquired how the matter could receive additional consideration by
Council. It was suggested by staff that Council representatives on Heritage Kitchener could
request that the matter of designation of the Mayfair Hotel be reconsidered by Council and that
at this time, the designation of 11 Young Street was outside of the scope of the Committee as
a decision had already been rendered by Council.

Mr. L. Bensason presented an update on the heritage status of the convent located at 79
Moore Avenue and 56-68 Shanley Street, advising that at the April Heritage Kitchener Meeting
a recommendation was passed to publish a Notice of Intention to designate the property under
Part IV of the Ontario Heritage Act. He stated that as part of the discussions with the Diocese,
it was agreed that if the proposed demolition was withdrawn, the City would not require
designation. As a result, staff recommended no action be taken to designate in order to
continue with the discussions regarding reuse of the convent building.
In response to questions from the Committee, Mr. Bensason stated that the intention is to
allow a reasonable amount of time to find a tenant and use for the building. He advised that the
entire property meets the criteria for designation and that the commitment at this time is to set
aside designation and work cooperatively with the Diocese to find a suitable reuse of the
building.
