HomeMy WebLinkAboutFCS-15-075 - Committee of Adjustment REPORT TO: Committee of the Whole DATE OF MEETING: June 1, 2015 SUBMITTED BY: Dianna Saunderson, Secretary-Treasurer, Committee of Adjustment (519-741-2200 ext. 7277) PREPARED BY: Holly Dyson, Administrative Clerk (519-741-2200 ext. 7594) WARD(S) INVOLVED: 2 and 10 DATE OF REPORT: May 21, 2015 REPORT NO.: FCS-15-075 SUBJECT:Fence Variance – 255 Briarmeadow Drive Sign Variance – 51 Breithaupt Street ___________________________________________________________________________ RECOMMENDATION: “That the application of Richard and Danielle Wagner (FN 2015-001 – 255 Briarmeadow Drive) requesting permission to install a wood fence having a height of 1.82m (6’) located 0.23m (0.754’) from the exterior side lot line abutting Tisdale Court rather than the required setback of 1.5m (4.921’), on Block 47, Registered Plan 58M-190, 255 Briarmeadow Drive, BE APPROVED Kitchener, Ontario, , subject to the following conditions: 1. That the owner shall submit a landscape plan to the satisfaction of the Manager of Site Development and Customer Service by August 1, 2015. 2. That the 1.82 metre high wooden fence shall not be built within the 4.5 metre Driveway Visibility Triangle (DVT) for the neighbouring property municipally address as 7 Tisdale Court.” - and - “That the application of the 2184647 Ontario Ltd. & Breithaupt Block Inc. (SG 2015-004 – 51 Breithaupt Street) requesting permission to install a roof-top sign on a building exceeding 6m, having a sign area of 26.09 sq.m. (280.83 sq.ft.) rather than the maximum sign area of 10 sq.m. (107.639 sq.ft.); a sign height of 3.003m (9.852’) rather than the permitted maximum height requirement of 3m (9.842’); and, for the roof sign to extend beyond the perimeter of the building having visible supports, whereas the By-law does not permit signs to extend beyond the perimeter of the building or for visible sign support structures without screening, on Lots 205 to 212, Part Lot 204, Plan 376, Part Lot 33, BE APPROVED Streets and Lanes, 51 Breithaupt Street, Kitchener, Ontario, , subject to the following condition: 1. The Committee of Adjustment met as a standing committee of City Council on Tuesday May 19, 2015, consider one application pursuant toChapter 630 (FENCES) of the City of one application pursuant to Chapter 680 (SIGNS) of the Kitchener Municipal Code and City of Kitchener Municipal Code. These recommendations are being forwarded to you on behalf of the Committee of Adjustment for your consideration. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment operates as a Standing Committee of City Council, and as such represents efficient and effective government. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: INFORM - As directed by the Sign By-law and Fence By-Law, notice of Applications for Variance to the Sign By-law and Fence By-law are published in the Record 15 - 18 days prior to the Committee of Adjustment meeting at which the application will be considered. Notice of an application is also mailed to property owners within 30 metres of the subject property. INFORM - This report has been posted to the City’s website with the agenda in advance of the council / committee meeting. ENTRUST – The Committee of Adjustment is a Quasi-Judicial Committee of citizen members operating as a Standing Committee of City Council.
