Saunderson, Committee Administrator CSD-15-042 - NOISE EXEMPTION – CANADIAN CANCER SOCIETY 1. - RELAY FOR LIFE – RESURRECTION HIGH SCHOOL The Committee considered Community Services Department report CSD-15-042, dated May 7, 2015 recommending approval of a noise exemption to the Canadian Cancer Society for their Relay for Life Event, being held on June 12 and June 13, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Canadian Cancer Society, Waterloo Region Unit, for their Relay For Life Event at Resurrection High School, between the hours of 7:00 a.m., June 12 and 12:00 p.m., June 13, 2015, as outlined in Community Services Department report CSD-15- 042.” INS-15-023 - DRINKING WATER QUALITY MANAGEMENT STANDARDS OPERATIONAL 2. PLAN – ENDORSEMENT The Committee considered Infrastructure Services Department report INS-15-023, dated April 15, 2015 recommending endorsement of the Drinking Water Quality Management Standards Operational Plan. Ms. A. Mick was in attendance and responded to questions from the Committee. On motion by Councillor K. Galloway-Sealock - it was resolved: “That the Drinking Water Quality Management Standards Operational Plan, be re- endorsed in accordance with the Safe Drinking Water Act, 2002 and Regulation 188/07, as attached to Infrastructure Services Department report INS-15-023.” INS-15-039 - MELITZER CREEK CONSULTANT PURCHASE ORDER EXTENSION 3. The Committee considered Infrastructure Services Department report INS-15-039, dated May 14, 2015 recommending extension of a purchase order to Ahydtech Geomorphic for engineering services related to restoration work for Melitzer Creek and repair work for Melitzer Creek Trail Bridge. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an extension of the purchase order issued to Ahydtech Geomorphic for engineering services including detailed design, permitting, tendering and construction administration all related to restoration work along eroded sections of Melitzer Creek and repair work for Melitzer Creek Trail Bridge in the amount of $15,000., be approved, as outlined in Infrastructure Services Department report INS-15-039.” COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 25, 2015 - 25 - CITY OF KITCHENER CSD-15-045 - NOISE EXEMPTION – 49 WAKE ROBIN DRIVE 4. The Committee considered Community Services Department report CSD-15-045, dated May 7, 2015 recommending approval of a noise exemption to Fred Fraser, for an outdoor Lobster Boil and Barbecue, being held at 49 Wake Robin Drive on June 6, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Fred Fraser, for an annual Lobster Boil and Barbecue at 49 Wake Robin Drive, between the hours of 3:00 p.m. and 11:00 p.m., on June 6, 2015, as outlined in Community Services Department report CSD-15-045.” CSD-15-051 - NOISE EXEMPTION – YOUNG PRESIDENTS’ ORGANIZATION CHAPTER 5. - BINGEMANS The Committee considered Community Services Department report CSD-15-051, dated May 7, 2015 recommending approval of a noise exemption to Young Presidents’ Organization Chapter, for an event being held at Bingemans Park on June 5, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Young Presidents’ Organization Chapter, for an event being held at Bingemans, between the hours of 5:00 p.m. and 11:00 p.m., on June 5, 2015,as outlined in Community Services Department report CSD-15-051.” CSD-15-052 - NOISE EXEMPTION – GRAND RIVER AMAZING RACE 6. The Committee considered Community Services Department report CSD-15-052, dated May 7, 2015 recommending approval of a noise exemption to the Grand River Amazing Race, being held at Kiwanis Park on June 20, 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Grand River Amazing Race at Kiwanis Park, between the hours of 9:00 a.m. and 6:00 p.m., on June 20, 2015, as outlined in Community Services Department report CSD-15-052.” INS-15-040 - 2015 TRAFFIC CALMING PRIORITIES 7. The Committee considered Infrastructure Services Department report INS-15-040, dated May 11, 2015 regarding the traffic calming reviews proposed for 2015. On motion by Councillor K. Galloway-Sealock - it was resolved: “That traffic calming reviews be initiated in 2015, as outlined in Infrastructure Services Department report INS-15-040, for the following streets: • Zeller Drive – between Lackner Boulevard and Pebblecreek Drive; • Parkvale Drive – between Woodbine Avenue and Huron Road; and, • Rittenhouse Road – between Blockline Road and Erinbrook Drive.” COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 25, 2015 - 26 - CITY OF KITCHENER INS-15-018 - CITY OF KITCHENER AND WILMOT TOWNSHIP CROSS BORDER 8. SERVICING AGREEMENT The Committee considered Infrastructure Services Department report INS-15-018, dated May 4, 2015 recommending execution of a cross border service agreement between Wilmot Township and the City of Kitchener. Ms. A. Mick presented the Report and responded to questions from the Committee. On motion by Councillor D. Schnider - it was resolved: “That the Mayor and Clerk be authorized to enter into a Cross Border Agreement, subject to the satisfaction of the City Solicitor, with the Township of Wilmot to address the operational, maintenance and other requirements, as outlined in Infrastructure Services report INS-15-018.” INS-15-038 - 2014 STORMWATER MANAGEMENT AUDIT REPORT 9. The Committee considered Infrastructure Services Department report INS-15-038, dated May 20, 2015 regarding the 2014 Stormwater Management Audit Report. Mr. N. Gollan and Ms. Nicole Weber, AECOM presented the Report and responded to questions from the Committee. Mayor B. Vrbanovic and Councillor J. Gazzola entered the meeting at this time. On motion by Councillor Y. Fernandes - it was resolved: “That the 2014 Stormwater Management Audit Technical Memorandum be endorsed, as outlined in Infrastructure Services Department report INS-15-038.” INS-15-041 - TRUSSLER ROAD - TRAFFIC CALMING REVIEW 10. The Committee considered Infrastructure Services Department report INS-15-041, dated April 29, 2015 recommending the installation of various traffic calming measures on Trussler Road. Mr. J. Readman presented the Report and responded to questions from the Committee. On motion by Councillor S. Davey - it was resolved: “That painted roadway edge lines be installed along Trussler Road, as outlined in Infrastructure Services Department report INS-15-041; and, That a centreline be installed along Trussler Road; and, That three (3) “50 km/h” speed limit signs be installed at: 99 metres west of Ira Needles Boulevard facing northbound traffic; Waldau Crescent facing northbound traffic; Waldau Crescent facing southbound traffic; and further, That three (3) over-sized “No Heavy Trucks” signs with “$110. fine” tabs be installed at: 59 metres west of Ira Needles Boulevard facing northbound traffic; and, On both sides of Trussler Road immediately south of Highland Road West facing south bound traffic.” INS-15-042 - CLOSURE AND LEASE OF AGNES STREET AND DECLARATION OF 11. SURPLUS FOR EASEMENT PURPOSES The Committee considered Infrastructure Services Department report INS-15-042, dated May 8, 2015 regarding a portion of Agnes Street be closed and leased to the K-W Badminton Club COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 25, 2015 - 27 - CITY OF KITCHENER INS-15-042 - CLOSURE AND LEASE OF AGNES STREET AND DECLARATION OF 11. SURPLUS FOR EASEMENT PURPOSES (CONT’D) and that the closed portion of Agnes Street be declared surplus for possible easements to the affected agencies. Mr. J. Readman presented the Report and responded to questions from the Committee. At the request of Councillor P. Singh, staff were directed to consider other possible means for advertising the road closure that would be more economical than the local newspaper, as it is not a statutory requirement for the closure. On motion by Councillor F. Etherington - it was resolved: “That the closure of portions of Agnes Street, from Park Street to Dominion Street, as outlined in Appendix “A” of Infrastructure Services Department report INS-15-042, be approved in principle; and, That the Mayor and Clerk be authorized to enter into a lease agreement with the K-W Badminton Club Inc., subject to the satisfaction of the City Solicitor; and further, That the portion of Agnes Street to be closed, to be further described on a Reference Plan to be prepared, be declared surplus to the City’s needs for the purpose of conveying possible easements for the affected agencies.” FCS-15-065 - 2014 DEVELOPMENT CHARGE RESERVE FUND 12. - PROPOSED CHANGES TO THE DEVELOPMENT CHARGES ACT – BILL 73 Pursuant to Chapter 25.10.9(J) (Procedure) of the Municipal Code, a motion was brought forward by Councillor Y. Fernandes to discuss the one item listed as Information Items on the Carried. Agenda, which was voted on and was The Committee considered Finance and Corporate Services Department report FCS-15-065, dated April 21, 2015 outlining the 2014 Development Charge Reserve Fund and the proposed changes to the Development Charges Act – Bill 73. Questions were raised regarding Table G and the Credit for Service Agreements, and whether there was a capacity limit on the number of service agreements that could be issued that would not adversely impact work being undertaken by the City. Mr. J. Willmer advised that staff have noted the question and would provide clarity on the request at a later date. ADJOURNMENT 13. On motion, this meeting adjourned at 3:22 p.m. D.
