SUBJECT: Performance Securities Policy Review

BACKGROUND:
The City's Performance Securities Policy (1-1080) provides direction on taking performance
securities (usually as a letter of credit) to ensure that sites are developed per their approved Site
Plan. Section 41 of the Planning Act is the provincial legislation that gives a municipality the
authority to request performance securities through site plan approval. The current policy was
last updated in 2008 (Appendix A). The purpose of this report is to inform Council that staff is
initiating an update to the Performance Securities Policy.
REPORT:
The primary purpose for this review is to better address large-scale and more complex
developments. Staff has found that the policy is geared to one-building projects rather than
multi-building developments that are constructed over several years. The policy should ensure
that the process for releasing site securities is reasonable and efficient for the development
industry while meeting the City's expectations.
The review of the Performance Securities Policy will evaluate the most effective approach
moving forward for the following items:
• Large-scale and multi-year construction projects;
• An evaluation of the alternative calculation for performance securities;
• How performance securities should address other aspects of site plan approval (such as
elevations); and,
• Other minor revisions to update the policy to address efficiencies and current practices.

Staff will review best practises by other municipalities as well as conduct internal and external
consultation in preparing the updated policy over the next several months.
KEY DELIVERABLES:
The key deliverable for this project is a staff report that includes recommendations for an
updated Performance Securities Policy and, potentially, updated standard language for the
Section 41 agreement. Any explanatory brochures/documents available to applicants through
the website would be updated following Council's decision.

The Performance Securities Policy Review aligns with the Development community priority and
Efficient and Effective Government by ensuring attractive and safe development through an
efficient and effective application process.

COMMUNITY ENGAGEMENT:
The Performance Securities Policy Review will include stakeholder engagement through the
primary themes of "INFORM" and "CONSULT" from the City's Community Engagement
Strategy.
INFORM — This report has been posted to the City's website with the agenda in advance of the
council / committee meeting. Staff will reach out to key stakeholders to make them aware of the
policy update.
CONSULT— Stakeholders will be given an opportunity to provide feedback on the current policy
and proposed changes to the policy within the scope of the review.
