MINUTES OF THE REGULAR MEETING HELD JUNE 16, 2015
MEMBERS PRESENT:

Mr. D. Cybalski, Chair, called this meeting to order at 10:00 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider one application regarding a variance to the City of Kitchener Sign By-law. The
Committee will not make a decision on this application but rather will make recommendations which
will be forwarded to the Committee of the Whole and Council for final decisions.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendation will be forwarded to City Council on Monday, June 29, 2015 at 7:00 p.m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant is requesting permission to legalize an existing
ground supported sign on the subject property located 12.06m (39.566’) from a ground
supported sign on an adjacent property rather than the required separation distance of 15m
(49.212’).
The Committee considered the report of the Planning Division, dated June 1, 2015, advising
that the subject property is located between Morgan Avenue near the intersection of King Street
East and Fairway Road South. The Zoning is C-6 in By-law 85-1 with an Official Plan
designation of Arterial Commercial Corridor.
The applicant is requesting a minor variance for permission to legalize an existing ground
supported sign with a 12.06 metres (39.567 feet) distance separation from a sign located on an
abutting property rather than the required separation distance of 15 metres (49.212 feet) of
section 680.11.13(a) of the Sign By-law.
In considering the requested variance to the Sign By-law, Planning staff offers the following
comments.
The existing sign with a separation distance of 12.06 metres from a sign on an abutting property
continues to meet the intent of the Sign By-law. The intent of the 15 metre separation distance
is to ensure that signage does not dominate the streetscape of the neighbourhood. The
streetscape is not dominated by signage as no other ground supported signs on abutting
properties are below the required 15 metre separation. Additionally, the reduced setback of

12.06 metres is appropriate as the existing location continues to allow for sizeable separation
distance between signs. The location of the existing sign does not encroach into the Driveway
Visibility Triangle (DVT), ensuring that it will not interrupt pedestrian or traffic visibility.
Furthermore, the existing location of the sign allows the applicant to clearly advertise their
services and the location of their business.
Staff is of the opinion that reduction of the separation distance for an existing ground supported
sign will not adversely affect the surrounding neighbourhood and is appropriate for the subject
property.
The Committee considered the report of the Region of Waterloo, Transportation Planner, dated
May 26, 2015, advising that they have no concerns with this application.

That the application of the Mike Lan Investments Ltd. requesting permission to legalize an existing
ground supported sign on the subject property located 12.06m (39.566’) from a ground supported
sign on an adjacent property rather than the required separation distance of 15m (49.212’), on
BE APPROVED
Part Lot 14, Plan 958, 2959 King Street East, Kitchener, Ontario, , subject to the
following conditions:
1. That the owner shall obtain a Sign Permit from the Planning Division.
2. That the owner shall ensure that the sign is in compliance with all other regulations of the
Sign By-law.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of Chapter 680 (Signs) of the City of Kitchener Municipal
Code is being maintained on the subject property.
